Welcome to FitPose Ai Workout Analysis (the "App"). These Terms and Conditions ("Terms") form a legally binding agreement between you ("User," "you," or "your") and Digital Dhandha ("Company," "we," "us," or "our") governing your access to and use of our mobile software applications, cloud systems, and automated analysis features.

By installing, accessing, or utilizing any portion of the App, you agree to be bound entirely by these Terms. If you do not accept these provisions, do not use the application.

 1. Account Eligibility and Agreement

To create an account and utilize our automated biomechanical review features, you must be at least 18 years of age and hold the legal capacity to form a binding contract under your regional jurisdiction. If you are under the legal age, you may only use this App under the explicit supervision and consent of a parent or legal guardian who agrees to monitor your physical activities and remain bound by these Terms.

 2. Description of the AI Analysis Service

FitPose Ai Workout Analysis leverages automated artificial intelligence (AI) models to evaluate user-submitted video recordings of athletic exercises. The application provides digital posture visual mappings, tracking feedback, and biometric metrics to guide general physical form awareness.

 3. Subscription Architecture & Unlimited Fair Use Policy (FUP)

We offer premium subscription options on both a recurring monthly and an annual (yearly) cycle billed through the Google Play Store and Apple App Store ecosystems.

* Strict Non-Refundable Policy: All payments and subscription purchases made within or in connection with the App are strictly non-refundable. We do not issue partial refunds, pro-rated cash returns, or credits for any unused billing periods or unused scan quotas.

* No Hard Cap Boundaries: Both our monthly and annual premium plans grant you unlimited video analysis runs within your active billing cycle. Your access will never be shut off or hard-blocked for standard high-volume scanning.

* Dynamic Processing Optimization (FUP): To ensure optimal cross-platform infrastructure health and manage our global cloud compute load, a Fair Use Policy threshold of 150 video scans per billing month applies across all accounts.

* Service Track Tuning: If your account processes 150 scans or fewer within a single billing month, your files are routed through our high-speed, high-fidelity data processing pipeline. If you exceed 150 scans in a month, your access remains fully unlimited, but our backend dynamically routes your subsequent videos to our standard-tier economy processing engine for the remainder of that billing cycle. This may result in minor variations in video turnaround speed, response depth, or layout metrics. The account automatically resets to the high-speed processing track at the commencement of your next billing month.

* Proration and Adjustments: Moving from a monthly subscription track to an annual plan triggers immediate processing via app store node rules. Any remaining time value on your monthly statement is calculated as a financial credit and automatically deducted from your initial annual statement.

 4. Promotional Trials and Volatility Clause

From time to time, the Company may offer temporary introductory bonuses or promotional paths, including but not limited to:

* A single (1) free initial analysis run upon account registration.

* A three (3) day trial period attached to an annual registration, granting temporary premium access capped at five (5) video evaluations per day, which must be canceled 24 hours prior to expiration to avoid automatic storefront charging.

> Promotional Flex Rule: You explicitly acknowledge that all trial counts, duration windows, free credit allotments, and introductory campaigns are promotional courtesies and not permanent features of the App. Digital Dhandha reserves the absolute right to alter, shrink, scale back, terminate, or modify the terms of any

free trial or credit offers at any time, across any region, without prior notification or liability.

 5. AI Analytical Disclaimer and Absolute Medical Waiver

> CRUCIAL SAFETY MANDATE: PLEASE READ CAREFULLY

> The form advice, skeletal alignment lines, posture warnings, and workout summaries displayed inside this App are compiled entirely by automated computer algorithms. They do not involve human review.

* Not Professional Training Advice: The App provides informational and educational data. It does not provide professional medical evaluation, sports medicine therapy, orthopaedic diagnostics, or certified human personal training programs.

* Inherent Risk of Weightlifting: Engaging in physical exercise, resistance training, and weightlifting involves serious intrinsic risks of acute bodily injury, chronic strains, structural damage, permanent disability, or death. You acknowledge that you are voluntarily exercising and assume 100% of the physical and financial risks involved.

* System Tracking Anomalies: Computer vision models are subject to variable environmental conditions, camera frame rate drops, loose apparel overlapping, poor lighting distortions, and mathematical variance. The analysis may occasionally misinterpret your physical movement. Never rely on the App to validate structural safety or override your body's personal pain barriers. Always seek advice from a certified medical practitioner or physical human trainer before performing heavy or unfamiliar lifting configurations.

 6. Video Content License and Prohibited Content Policy

* Media Ownership: You maintain full copyright ownership over any video files or camera streams you upload into the App.

* Processing Transmission License: By uploading a video file, you grant Digital Dhandha a limited, secure, global, royalty-free, revocable license to temporarily ingest, compress, host, transmit, and process your media file through our backend servers and integrated processing nodes solely to execute your requested posture feedback.

* Strict Prohibited Content Standard: You are strictly prohibited from uploading, transmitting, or processing any video content that is illegal, unlawful, harassing, defamatory, or contains nudity, sexual content, pornography, or child abuse/exploitation material (CSAM).

 7. Limitation of Liability and Indemnification

To the maximum extent permitted under applicable consumer protection legislation:

* As-Is Software Delivery: The application is delivered entirely on an "as-is" blueprint without any express or implied guarantees regarding diagnostic accuracy, server uptime, or system stability.

* Total Financial Liability Cap: In no event shall Digital Dhandha, its developers, founders, or operators be held legally liable for any direct, indirect, incidental, special, or consequential damages. This includes, without limitation, physical injuries, muscle tears, medical expenses, emergency overhead, loss of device data, or subscription costs resulting from your execution of forms recommended or evaluated by the AI engine.

* User Indemnity: You agree to fully indemnify, defend, and hold harmless Digital Dhandha from any claims, liability losses, legal fees, or hardware damage arising out of your violation of these Terms or your unsafe application of fitness feedback.

 8. Terminations and Zero-Tolerance Abuse Violations

We reserve the right to instantly suspend, block, or permanently terminate any user account without prior notice or warning at our sole discretion.

> Zero-Tolerance Content Enforcement: If our automated monitoring systems or administrative logs identify that a user has uploaded illegal content, sexual or pornographic videos, or any material involving child abuse, we reserve the absolute right to immediately and permanently block that user from the App. This enforcement applies immediately and unconditionally, even if the user is an active, paid subscriber. In the event of a block due to prohibited content or safety violations, the user

forfeits all remaining subscription time, and absolutely no refunds will be issued.

Furthermore, we reserve identical block rights if our cloud logs identify malicious API scraping, unauthorized bot distribution, payment exploitation, or account-sharing frameworks that manipulate our infrastructure.

 9. Governing Law and Legal Jurisdiction

These Terms and your operational relationship with the App shall be governed by, and interpreted exclusively under, the laws of the Republic of India, without applying any conflict of law parameters. Any formal legal disputes, mediation claims, or actions arising out of these terms shall be settled exclusively within the competent jurisdictions and courts located in Mumbai, Maharashtra, India.
