1. Acceptance of Terms
Welcome to Fitvi! These Terms of Use ("Terms", "Agreement") govern your access to and use of the Fitvi mobile application ("App", "Service", "Fitvi") developed and operated by KIkc ("we", "us", "our", "Company", "Developer").
By downloading, installing, accessing, or using Fitvi, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.
1.1. Legal Agreement
These Terms constitute a legally binding agreement between you ("User", "you", "your") and KIkc. By using Fitvi, you represent that:
You are at least 13 years of age
You have the legal capacity to enter into this Agreement
You will comply with all applicable laws and regulations
1.2. Changes to Terms
We reserve the right to modify, update, or replace these Terms at any time. Changes will be effective:
Immediately upon posting for non-material changes
30 days after notification for material changes
We will notify you of material changes through:

Email to your registered email address
Notice displayed when you open the App
Your continued use of the App after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the App and may delete your account.

Certain features or services may be subject to additional terms and conditions, which will be presented to you when you access those features. Those additional terms are incorporated into these Terms by reference.
2. Intellectual Property Rights
2.1. Ownership of the App
Fitvi and all of its components are the exclusive property of KIkc. This includes, but is not limited to:
Application Code and Software:
All source code, object code, and executable code
Software architecture and design
Algorithms and data structures
Database schemas and structures
API designs and implementations
Backend infrastructure and cloud functions
All current and future versions of the App
User Interface and Design:
Visual design, layout, and color schemes
Graphical user interface (GUI) elements
Icons, buttons, and navigation elements
Screen flows and user experience (UX) design
Animations, transitions, and visual effects
Typography and font implementations
All design mockups and prototypes
Content and Media:
Workout plans, routines, and exercise descriptions
Exercise demonstrations (videos, images, animations)
Fitness guides, articles, and educational content
Nutrition information and meal plans
Motivational content and tips
Audio files, sound effects, and music
Graphics, photographs, and illustrations
Logos, trademarks, and brand elements
Data and Databases:
Exercise database and classifications
Muscle group information
Calorie and nutrition databases
User interface text and copy
App metadata and descriptions
Proprietary Technology:
Activity recognition algorithms
Step counting and distance calculation methods
Calorie burn estimation algorithms
Workout recommendation engine
Progress tracking systems
Data synchronization technology

User manuals and guides
API documentation

2.2. Intellectual Property Protection
All intellectual property rights in and to the App are owned by or licensed to KIkc, including but not limited to:
Copyright: All original works of authorship
Trademarks: Fitvi name, logo, and brand elements
Trade Secrets: Proprietary algorithms, business methods, and processes
Patents: Any patented or patent-pending technology (current or future)
Database Rights: Compilations and databases
Design Rights: Visual design and user interface elements
The App and all its components are protected by:
Copyright laws of Kyrgyzstan, United States, European Union, and international copyright treaties
Trademark laws and regulations
Trade secret laws
International intellectual property agreements (Berne Convention, WIPO Copyright Treaty, etc.)
2.3. Restrictions on Use
You are expressly prohibited from:
Copying and Reproduction:
Copying, reproducing, or duplicating the App or any part thereof
Creating copies of the App's code, design, or content
Making derivative works based on the App
Reverse engineering, decompiling, or disassembling the App
Extracting source code from the App by any means
Modification and Alteration:
Modifying, adapting, or translating the App
Creating modifications, plugins, or extensions
Altering any copyright notices, trademarks, or proprietary markings
Removing or obscuring any intellectual property notices
Distribution and Transfer:
Distributing, sublicensing, leasing, or lending the App
Selling, renting, or transferring access to the App
Making the App available over a network for use by multiple devices
Providing the App as a service (SaaS) to third parties
Bundling the App with other software or products
Commercial Exploitation:
Using the App's code, design, or content in your own projects
Building competing products or services using our intellectual property
Extracting data, algorithms, or methods for commercial use
Creating training materials or courses based on our content
Technical Interference:
Attempting to gain unauthorized access to the App's servers or systems
Interfering with or disrupting the App's functionality
Bypassing security measures or access controls
Introducing viruses, malware, or harmful code
Automated data scraping, mining, or harvesting
Trademark Misuse:
Using Fitvi trademarks without written permission
Creating confusion about the source or sponsorship of products
Using our brand elements in domain names, social media handles, or product names
Registering trademarks similar to Fitvi
2.4. Limited License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
Download and install the App on devices you own or control
Use the App for personal, non-commercial fitness tracking purposes
Access and use App features as intended
This license does NOT include the right to:
Use the App for commercial purposes
Sublicense, sell, or distribute the App
Modify or create derivative works
Reverse engineer or decompile the App
Use the App's intellectual property in any way not expressly permitted
This license automatically terminates if you violate these Terms.
2.5. User-Generated Content
Content You Create:
When you create content in the App (workout logs, progress photos, notes, custom routines), you retain ownership of that content. However, you grant us a worldwide, royalty-free, non-exclusive license to:
Store and display your content within the App
Use aggregated, anonymized data derived from your content for analytics
Back up your content for account recovery purposes
We do NOT claim ownership of your personal fitness data, photos, or workout logs.
Restrictions on Your Content:
You may not upload, post, or share content that:
Infringes on others' intellectual property rights
Contains copyrighted material without permission
Violates any laws or regulations
Is offensive, harmful, or inappropriate
2.6. Third-Party Content
Some content in the App may be licensed from third parties. Such content remains the property of the respective owners and is subject to their terms and licenses.
2.7. Reporting Infringement
If you believe any content in the App infringes your intellectual property rights, please contact us at:

2.8. Enforcement
We actively protect our intellectual property rights and will take legal action against:
Unauthorized copying, distribution, or modification of the App
Creation of competing products using our intellectual property
Trademark infringement or brand misuse
Reverse engineering or security breaches
Any other violations of our intellectual property rights
Violations may result in:
Immediate account termination
Legal action for damages and injunctive relief
Criminal prosecution (where applicable)
Reporting to app stores and authorities
3. User Accounts and Registration
3.1. Account Creation
To use Fitvi, you must create an account by providing:
Full name
Valid email address
Password (minimum 8 characters)
Age/date of birth
Basic fitness information (optional but recommended)
You agree to provide accurate, current, and complete information during registration and to update it as necessary.
3.2. Account Security
You are responsible for:
Maintaining the confidentiality of your password
All activities that occur under your account
Notifying us immediately of any unauthorized access
Using a strong, unique password
Not sharing your account credentials with others
We are not liable for any loss or damage from your failure to maintain account security.
3.3. Account Eligibility
Minimum age: 13 years old
Users 13-17 must have parental/guardian consent
One account per person
Accounts are non-transferable
3.4. Account Termination
By You:
You may delete your account at any time through App settings
Deletion is permanent and cannot be undone
All personal data will be deleted within 30 days (see Privacy Policy)
By Us:
We may suspend or terminate your account if:
You violate these Terms
You engage in fraudulent or illegal activity
You abuse the App or other users
Your account has been inactive for over 2 years
We discontinue the Service
Required by law
We will provide notice when reasonably possible, except in cases of serious violations or legal requirements.
4. Acceptable Use Policy
4.1. Permitted Uses
Fitvi is intended for personal fitness tracking, including:
Recording workouts and physical activities
Tracking fitness progress and goals
Viewing personalized workout recommendations
Monitoring health metrics (steps, calories, etc.)
Accessing fitness content and educational materials
4.2. Prohibited Uses
You may not use Fitvi to:
Illegal Activities:
Violate any local, national, or international laws
Engage in fraudulent activities
Promote illegal substances or activities
Harass, threaten, or harm others
Misuse of Service:
Create multiple accounts (except with permission)
Share accounts with others
Use bots, scripts, or automated tools
Overload or interfere with App infrastructure
Bypass security measures or access controls
Attempt to hack, probe, or test vulnerabilities
Inappropriate Content:
Upload harmful, offensive, or explicit content
Share content that violates others' privacy
Post spam or unsolicited commercial messages
Distribute malware or harmful code
Abuse of Features:
Manipulate workout data or statistics
Create fake progress or achievements
Abuse in-app purchase systems
Exploit bugs or glitches for advantage
Intellectual Property Violations:
Upload copyrighted content without permission
Use others' trademarks or brand elements
Claim ownership of our content or features
4.3. Consequences of Violations
Violations may result in:
Warning or temporary suspension
Permanent account termination
Legal action for damages
Reporting to authorities (for illegal activities)
5. Subscriptions and Payments
5.1. Free and Premium Features
Fitvi offers:
Free Version: Basic fitness tracking with advertisements
Premium Subscription: Advanced features, ad-free experience, exclusive content
5.2. Subscription Terms
Billing:
Subscriptions are billed through Google Play Store (Android) or Apple App Store (iOS)
Subscription fees are charged at the beginning of each billing period
Prices are displayed in your local currency
Auto-Renewal:
Subscriptions automatically renew unless canceled at least 24 hours before the current period ends
Your account will be charged for renewal within 24 hours prior to the end of the current period
You can manage or cancel subscriptions through your app store account settings
Free Trials:
Free trial periods (if offered) will be clearly disclosed before purchase
If you don't cancel before the trial ends, you will be charged for a subscription
Trial eligibility is limited to new subscribers only
5.3. Cancellation and Refunds
Cancellation:
You can cancel your subscription at any time through your app store account
Cancellation takes effect at the end of the current billing period
You will retain access to premium features until the end of the paid period
Refunds:
All purchases are processed through Google Play or Apple App Store
Refund requests must be submitted through your app store within their refund period
We do not directly process refunds; contact Google or Apple customer support
Refund policies are subject to app store terms and conditions
Exceptions:
In exceptional circumstances (e.g., billing errors, unauthorized charges), contact us at kitkeyxxz@outlook.com
We will work with you and the app store to resolve the issue
5.4. Price Changes
We reserve the right to change subscription prices at any time. Price changes will:
Not affect current subscribers until their next renewal
Be communicated at least 30 days in advance
Allow you to cancel before the new price takes effect
5.5. In-App Purchases
Additional features or content may be available through one-time in-app purchases. These purchases:
Are non-refundable (except as required by law or app store policy)
Are tied to your account and non-transferable
May have expiration dates (if clearly disclosed)
6. Privacy and Data Protection
6.1. Privacy Policy
Your use of Fitvi is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

7. Health and Fitness Disclaimers
7.1. Not Medical Advice
Fitvi is a fitness tracking tool, not a medical device or healthcare service.
The App provides general fitness information and tracking features
Content is for informational purposes only
The App does not provide medical advice, diagnosis, or treatment
Always consult a qualified healthcare professional before starting any exercise program
7.2. Health and Safety
You acknowledge and agree that:
Exercise involves inherent risks of injury
You are responsible for your own health and safety
You should consult a doctor before using Fitvi if you:
Have any pre-existing medical conditions
Are pregnant or nursing
Are taking medications that may affect exercise
Have a history of heart disease, high blood pressure, or other conditions
Are recovering from injury or surgery
Haven't exercised regularly in the past
Stop exercising and seek medical attention if you experience:
Chest pain or pressure
Severe shortness of breath
Dizziness or lightheadedness
Unusual fatigue
Nausea
Pain in your arms, neck, or jaw
Any other concerning symptoms
7.3. Accuracy of Information
We strive for accuracy but cannot guarantee:
The accuracy of calorie burn calculations
The precision of step counting or distance measurements
The correctness of exercise instructions
The suitability of workout plans for your specific needs
The reliability of third-party fitness data
Fitness tracking features are estimates based on algorithms and sensor data. Actual results may vary.
7.4. No Warranty of Results
We do not guarantee that using Fitvi will:
Help you achieve your fitness goals
Result in weight loss or muscle gain
Improve your health or fitness level
Prevent injury or illness
Your results depend on many factors including your effort, consistency, diet, genetics, and overall lifestyle.
7.5. Assumption of Risk
By using Fitvi and following workout recommendations, you voluntarily assume all risks associated with:
Physical exercise and fitness activities
Following workout plans or nutritional information
Using fitness equipment
Participating in physical challenges
8. Third-Party Services and Integrations
8.1. Third-Party Platforms
Fitvi integrates with third-party services including:
Google Play Store / Apple App Store (distribution and payments)
Firebase / Google Cloud Platform (hosting and analytics)
Advertising networks (Google AdMob, Facebook Audience Network, Unity Ads)
Payment processors (Google Play Billing, Apple Pay)
Your use of these services is subject to their respective terms and policies. We are not responsible for third-party services or their practices.
8.2. Third-Party Links
The App may contain links to external websites, products, or services. We do not endorse or control these third-party resources and are not responsible for:
Their content, accuracy, or availability
Their privacy practices or data collection
Products or services offered
Any damages or losses from your use
Review third-party terms and privacy policies before engaging with external links.
8.3. Advertising
We display third-party advertisements in the free version of the App. Advertisers may:
Collect data about your device and app usage
Use cookies and tracking technologies
Show personalized ads based on your interests

8.4. Wearable Device Integration
If you connect Fitvi with fitness trackers or smartwatches:
Data sharing is subject to the device manufacturer's terms
We are not responsible for data accuracy from third-party devices
Connection may be terminated by the device manufacturer
Compatibility is not guaranteed
9. Disclaimers and Limitation of Liability
9.1. "AS IS" and "AS AVAILABLE" Basis
Fitvi is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:
Warranties of merchantability
Fitness for a particular purpose
Non-infringement
Uninterrupted or error-free operation
Accuracy, reliability, or completeness of content
Security of data transmission
Freedom from viruses or harmful components
We do not warrant that:
The App will meet your specific requirements
The App will be available at all times
All errors will be corrected
The App is compatible with all devices
Results will be achieved through use of the App
9.2. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
We (KIkc, our affiliates, officers, directors, employees, agents, and licensors) shall not be liable for any:
Indirect, Incidental, or Consequential Damages:
Loss of profits, revenue, or data
Business interruption
Loss of goodwill or reputation
Personal injury or property damage
Punitive or exemplary damages
Direct Damages:
Our total liability for all claims related to the App shall not exceed the greater of:
Amount you paid for the App in the 12 months before the claim

Errors, bugs, or technical issues
Unauthorized access to your data

9.3. Jurisdictional Limitations
Some jurisdictions do not allow limitations on implied warranties or liability for incidental/consequential damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
9.4. Your Sole Remedy
Your sole and exclusive remedy for dissatisfaction with the App is to stop using it and delete your account.
10. Indemnification
You agree to indemnify, defend, and hold harmless KIkc, our affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
Your use or misuse of the App
Your violation of these Terms
Your violation of any laws or regulations
Your violation of any third-party rights (including intellectual property rights)
Your user-generated content
Your negligence or willful misconduct
Exercise-related injuries or health issues
Any false or misleading information you provide
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, at your expense.
11. Dispute Resolution
11.1. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Kyrgyzstan, without regard to conflict of law principles.
11.2. Jurisdiction
You agree to submit to the personal and exclusive jurisdiction of the courts located in Kyrgyzstan for the resolution of any disputes arising from or related to these Terms or your use of the App.
11.3. Informal Resolution
Before filing any formal dispute, you agree to first contact us at kitkeyxxz@outlook.com to attempt to resolve the issue informally. Provide:

Description of the dispute
Desired resolution
We will respond within 30 days and work in good faith to resolve the matter.
11.4. Arbitration (If Applicable)
For disputes that cannot be resolved informally, both parties agree to binding arbitration in accordance with [Arbitration Rules of Kyrgyzstan / International Chamber of Commerce].

Nothing in these Terms prevents either party from seeking injunctive relief in court for:

Any claim or dispute must be filed within one (1) year after the cause of action arises. After one year, the claim is permanently barred.
12. Service Availability and Modifications

24/7 uninterrupted access
Error-free operation
Compatibility with all devices or operating systems
Availability in all countries or regions
12.2. Maintenance and Downtime
We may temporarily suspend the App for:

Infrastructure upgrades
Legal compliance
We will provide advance notice when possible, but emergency situations may require immediate action without notice.
12.3. Modifications to the App
We reserve the right to:

Discontinue certain services
We are not obligated to maintain any specific feature indefinitely.
12.4. Service Termination
We may discontinue Fitvi entirely at our discretion. If we do, we will:

Allow you to export your data
Refund any unused premium subscription fees (prorated)
13. User Conduct and Community Guidelines
13.1. Respectful Behavior
If Fitvi adds social or community features in the future, you agree to:
Treat other users with respect
Not harass, bully, or threaten others
Not discriminate based on race, religion, gender, etc.
Respect others' privacy
13.2. Accurate Information
Provide truthful information in your profile
Do not impersonate others
Do not create fake accounts
Do not misrepresent your identity or credentials
13.3. Appropriate Content
If you can share content with others:
Do not post offensive, explicit, or inappropriate material
Do not share copyrighted content without permission
Do not spam or send unsolicited messages
Do not promote dangerous or illegal activities
14. Copyright and DMCA
14.1. DMCA Compliance
We comply with the Digital Millennium Copyright Act (DMCA) and will respond to valid notices of copyright infringement.
14.2. Filing a DMCA Notice
If you believe content in Fitvi infringes your copyright, send a written notice to:

14.3. Counter-Notice
If your content was removed due to a DMCA notice and you believe it was a mistake, you may file a counter-notice including:
Your physical or electronic signature
Identification of the removed content and its former location
Statement under penalty of perjury that removal was a mistake or misidentification
Your name, address, and consent to jurisdiction
Date and signature
We will forward your counter-notice to the original complainant and may restore the content after 10-14 business days unless they file a legal action.
15. Export Control and Sanctions
You agree to comply with all export control laws and regulations, including:
U.S. Export Administration Regulations
International Traffic in Arms Regulations
Sanctions programs administered by OFAC
You represent that:
You are not located in a country subject to U.S. embargo or sanctions
You are not on any government list of prohibited or restricted parties
You will not export or re-export the App to prohibited destinations
16. Severability and Waiver
16.1. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable:
The remaining provisions will remain in full force
The invalid provision will be modified to be enforceable while achieving its intent
The invalidity will not affect other provisions
16.2. Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us.
17. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms for specific features, constitute the entire agreement between you and KIkc regarding Fitvi and supersede any prior agreements or understandings.
18. Assignment
You may not transfer or assign your rights or obligations under these Terms without our written consent. We may assign or transfer our rights and obligations at any time, including in connection with a merger, acquisition, or sale of assets.
