These Terms of Use (“Terms”) govern your use of Fishing Forecast (“the app”). By using the app, you agree to these Terms.
1. App Purpose
Fishing Forecast is an informational fishing planning app. It helps users view fishing forecasts, tide movement, marine weather, wind, waves, rain, moon phase, solunar-style signals, map locations, and saved fishing spots.
The app is intended for general planning and recreational use only.
2. Not for Navigation or Safety-Critical Use
Fishing Forecast is not a navigation app and must not be used as the sole source for boating, fishing, marine travel, emergency, or safety-critical decisions.
Weather, tide, marine, and forecast data can be delayed, incomplete, inaccurate, unavailable, or different from real-world conditions.
You are responsible for checking official local marine forecasts, tide tables, safety alerts, regulations, and conditions before going out.
3. No Guarantee of Fishing Results
Fishing Forecast may provide fishing scores, tide windows, moon phase, weather signals, and other forecast indicators. These are estimates only.
We do not guarantee fish activity, catches, weather conditions, tide accuracy, or trip success.
4. Subscriptions and Purchases
Fishing Forecast offers optional auto-renewable subscriptions through Apple In-App Purchase.
Fishing Forecast Pro may unlock features such as:
- 7-day planning
- Premium tide windows
- Unlimited saved fishing spots
- Additional forecast and planning tools
Subscription options, duration, and price are shown in the app before purchase.
Payment will be charged to your Apple Account at confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current subscription period.
Your Apple Account may be charged for renewal within 24 hours before the end of the current period.
You can manage or cancel subscriptions in your Apple Account settings.
Refund requests are handled by Apple according to Apple’s policies.
5. Free and Pro Features
Some features may be available for free. Other features may require an active Pro subscription.
We may change, add, remove, or adjust free and paid features over time.
6. Acceptable Use
You agree not to:
- Misuse the app or interfere with its operation
- Attempt to access or reverse engineer private systems or APIs
- Use the app for illegal, harmful, or unsafe activities
- Rely on the app for emergency or safety-critical decisions
- Violate applicable laws, fishing rules, marine regulations, or local restrictions
7. Data and Third-Party Services
The app may use third-party services such as Apple MapKit, Apple CoreLocation, Apple StoreKit, AppActor, Open-Meteo, WorldTides, and AppMerge backend services.
These services may affect availability, accuracy, and performance. We are not responsible for outages, inaccuracies, delays, or changes caused by third-party services.
Your use of the app is also subject to our Privacy Policy.
8. Availability
We aim to keep the app reliable, but we do not guarantee that the app will always be available, uninterrupted, accurate, or error-free.
Forecast, tide, map, and weather coverage may vary by region.
9. Intellectual Property
Fishing Forecast, including its design, branding, text, graphics, software, and other content, is owned by us or licensed to us.
You may not copy, modify, distribute, sell, or reuse any part of the app without permission.
10. Disclaimer of Warranties
The app is provided “as is” and “as available.”
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy, availability, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, trip disruption, personal injury, property damage, or losses related to reliance on forecast, tide, weather, or map information.
12. Changes to the App or Terms
We may update the app or these Terms from time to time. If we make material changes, we will update the effective date above.
Your continued use of the app after changes means you accept the updated Terms.
