Terms of Service for the Mobile Application

1. General Provisions
1.1. These Terms of Service ("Terms") govern the relationship between Alexey Sakharov (the "Developer," "we," "us," or "our") and any individual who installs or uses the Field Area Measure mobile application (the "App," "you," or "user").
1.2. By installing or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not install or use the App.
2. Governing Law and Jurisdiction
2.1. These Terms are governed by the laws of the Republic of Kazakhstan.
2.2. Any disputes arising from or in connection with these Terms shall be resolved by the competent courts of the Republic of Kazakhstan, unless otherwise required by mandatory law.
3. Age Requirements
3.1. The App is intended for users of any age.
3.2. If you are a minor, you must obtain consent from a parent or legal guardian if required by the laws of your jurisdiction.
4. License to Use
4.1. The Developer grants you a non-exclusive, non-transferable, revocable license to use the App for personal or professional purposes in accordance with its intended functionality.
4.2. You may not:
- disassemble, decompile, reverse-engineer, or modify the App
- bypass technical limitations or security features
- use the App to create derivative works without the Developer's written permission
5. Subscription and Payment
5.1. The App may be distributed under a subscription model.
5.2. If a free trial is offered, it begins upon purchase confirmation.
5.3. Unless canceled before the end of the trial, the subscription will automatically renew and be charged in accordance with the app store's policies.
5.4. Subscriptions can be managed or canceled through the app store; access continues until the end of the current paid period. Refunds follow the policies of the respective store.
6. Measurement Accuracy Disclaimer
6.1. The App provides area, distance, and perimeter measurements based on GPS data and satellite imagery. All measurements are approximate and intended for informational purposes only.
6.2. Measurement accuracy depends on GPS signal quality, device capabilities, satellite imagery resolution, and environmental conditions. We do not guarantee the precision or correctness of any measurement.
6.3. Measurements obtained through the App must not be used as a substitute for professional land surveys, legal boundary determinations, or other purposes that require certified accuracy.
6.4. The Developer is not responsible for any decisions, actions, or consequences based on measurements obtained through the App.
7. Privacy and Data
7.1. The App may collect anonymous usage data such as session frequency, settings, and feature usage to improve service quality and analytics.
7.2. The App uses your device's GPS location for core functionality (map positioning, area and distance calculations). Location data is processed locally on your device and is not transmitted to our servers.
7.3. The App uses third-party services including Google Maps SDK (for map display and satellite imagery) and Firebase (for anonymised analytics and crash reporting). Use of these services is subject to their respective privacy policies.

8. User-Generated Content
8.1. The App allows you to create measurements, attach photos, and add metadata (names, notes, icons). All such content ("User Content") is stored locally on your device.
8.2. You retain full ownership of your User Content. We do not access, collect, or store your User Content on any server.
8.3. When you use the App's export features (KML, GeoJSON, GPX, CSV, PDF, Image), the exported files are shared only through the method you choose (e.g., AirDrop, email, Files app). We do not receive copies of your exports.
9. Intellectual Property
9.1. All rights in the App — including code, design, databases, trademarks, and other elements — remain the property of the Developer.
9.2. Unauthorised copying, distribution, or reuse of any part of the App is prohibited and may result in legal liability.
10. Third-Party Services
10.1. The App integrates the following third-party services:
- Google Maps SDK — for satellite imagery and map display, subject to the Google Maps Terms of Service (https://cloud.google.com/maps-platform/terms)
- Firebase Analytics and Crashlytics — for anonymised usage analytics and crash reporting, subject to the Firebase Terms of Service (https://firebase.google.com/terms)
- Apple App Store — for distribution and payments, subject to Apple's terms
10.2. Your use of these third-party services is governed by their respective terms and privacy policies.
11. Disclaimer of Warranties and Limitation of Liability
11.1. The App is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose.
11.2. The Developer is not liable for:
- any direct or indirect loss or damage resulting from use of the App
- failures, errors, or data loss due to circumstances beyond our control (e.g., hardware issues, third-party services, network problems)
- any decisions or actions taken based on measurements, data, or information obtained through the App
11.3. The App does not offer professional advice (technical, surveying, legal, etc.); use is at your own risk.
12. Term and Termination
12.1. These Terms take effect upon your installation or use of the App and remain in force until the App is deleted.
12.2. Deleting the App terminates your license and ends the agreement, though any paid subscription will remain active until the current billing period ends.
13. Changes to the Terms
13.1. We may update these Terms from time to time.
13.2. The latest version will be published in the App or app store listing. Continued use after any update constitutes your acceptance of the revised Terms.
14. Dispute Resolution
14.1. We aim to resolve disputes amicably and encourage users to contact us first.
14.2. If resolution cannot be reached, disputes will be settled in accordance with Section 2.
