The following questions are not resolved in the public record:
What is the final operational classification of the Grove Avenue facility?
As of October 2026, there is a fire alarm panel update in the RVA Permits Portal, and unresolved details related to racking and shelving.
Is there an executed lease or operational agreement with the Commonwealth?
Yes, but awaiting Certificate of Occupancy / CZC as of October 2026.
Were standard Commonwealth review processes completed or required?
Environmental Impact Report was advised as required in 2023 by DGS.
Confirmed as not reviewed for applicability or exemption in 2026 by DEQ. FGS is seeking clarification on this topic.
Will lease payements be withheld by DoA to VMFA ReCo due to this gap?
What is the status of revision to the original Plan of Development for The Dream Wall public permanent art installation?
As of October 2026 - the revised POD is not approved, and construction is not started. Gravel / Rock is in the parking lot of The Studio School.
The facility could operate as a privately owned and controlled storage building, without Commonwealth lease or operational authority.
This could be possible in the future if the current 10-year lease is not renewed, or the commonwealth leasehold interests change from the current agreement.
The facility was constructed privately and then leased to the Commonwealth in May 2026. It is unresolved if the commonwealth requirements were resolved for this arrangement.
Alex Nyerges, a commonwealth employee, signed documents on behalf of the Owner / Private VMFA Real Estate Company LLC. He also characterized the decision to construct the new facility as his own rather than retrofit other available options prepared for review.
The facility currently has a 10-year lease with option to renew in 2036, so there is nothing formal guaranteeing a permanent institutional use of the facility, at this time.
The facility is now leased to or operated by the Commonwealth; although, lease payments are awaiting a final approved certificate of occupancy / CZC.
It is unclear if there will be a renewal of the initial 10-year term. Prior representations about the plan reflected a preference for a 30-year term as minimum for zoning approval. The "by-right" approach also modified the term expectations.
Certain statuatory requirements exist for facilities constructed-for, leased-by, or operated by a government agency. The DEQ Environmetnal Impact Review is the primary area of unresolved requirement - especially with the addition of The Dream Wall permanent public art installation as a revision to the original plan of development and installation post-lease with the commonwealth.
This was a suggested mode of operation presented in a 2022 SmithGroup Memo. They recommended a storage facility for expansion followed by a workshop-use.
