The UK’s new “earned settlement” model will replace the simple five-year settlement route with a more complex system where:
the baseline settlement period becomes 10 years for most people
many workers will follow a 15-year route
additional penalties and accelerators can change the timeline, including:
+5 years for claiming certain benefits
+20 years for overstaying or entering unlawfully
–1 year for very high English language scores (C1 level)
–5 years for consistently high earnings (around £50,270+ per year)
–5 years for people with NQF6 and above
Because settlement (ILR) would be delayed:
Citizenship will also be pushed much further out (ILR plus 12 months).
People who already have ILR will not be affected. However, anyone who does not yet have ILR — including people already several years into a five-year route — could be moved onto the new, longer system if these proposals are applied retrospectively.
The Isle of Man has not yet announced any decision on these proposals.
