## 1. Acceptance of Terms

By downloading, installing, accessing, or using Exterior Paint Visualizer (the "App"), you agree to these Terms of Use ("Terms") and our Privacy Policy. If you do not agree, do not use the App.

You must be at least 13 years old to use the App. If you are under the age of majority in your jurisdiction, you represent that you have permission from a parent or legal guardian.

## 2. Description of Service

Exterior Paint Visualizer is an AI-powered exterior paint visualization app that helps users preview paint colors on house exterior photos. The App may allow you to:

- Take or upload a house exterior photo

- Select paintable exterior areas such as siding, trim, shutters, doors, garage doors, brick, stucco, or other surfaces

- Choose paint colors, color names, hex values, brands, and paint codes

- Add custom notes or prompt text for the visualization

- Generate AI-powered exterior paint previews

- Compare before-and-after images with a slider

- Save, share, or review generated previews

- Use optional premium features, subscriptions, credits, or ad-free access where offered

The App is provided for visualization, inspiration, and informational purposes only. It does not provide professional painting, architectural, construction, engineering, real estate, legal, HOA, permit, or building-code advice.

## 3. AI Generation and Third-Party Services

The App uses third-party services and AI image generation technologies to process user inputs and create paint visualization outputs. Generation requests may include your uploaded image, selected paint colors, paint codes, selected paintable surfaces, and custom prompt text.

Exterior paint generation is sent through a Cloudflare Worker proxy operated for this App and may be processed by Replicate using the google/nano-banana model. Where configured, the App may also use OpenAI services to help analyze a house exterior photo or generate a better prompt. Other third-party services may support subscriptions, payments, advertising, diagnostics, app reviews, sharing, hosting, and app-store distribution.

We are not responsible for outages, delays, pricing changes, policy changes, degraded output quality, or service interruptions caused by third-party providers.

## 4. User Responsibilities

You are responsible for using the App only in compliance with applicable laws, app-store rules, these Terms, and any third-party service terms that apply to your use.

You may not:

- Upload images or text that you do not have the right to use

- Upload illegal, explicit, hateful, harassing, defamatory, violent, or harmful content

- Infringe copyright, trademark, privacy, publicity, or other rights

- Use the App to identify, target, harass, or harm another person

- Scrape, copy at scale, reverse engineer, decompile, or attempt to extract source code, datasets, prompts, model details, or infrastructure

- Bypass credits, subscriptions, paywalls, usage limits, security controls, or access restrictions

- Misuse purchases, refunds, trials, promotions, or subscription systems

- Resell the App, generated outputs, or access to the App as a standalone bulk design, image-generation, or data service without our written permission

- Use the App in a way that overloads, disrupts, or harms the App, its providers, or other users

We may suspend, limit, or terminate access if we believe there is abuse, fraud, security risk, or a violation of these Terms.

## 5. Photos, Outputs, and Intellectual Property

You retain any rights you have in the original photos, text, and other materials you submit to the App. By using the App, you grant JanoGroup LLC and its service providers a limited license to process your submitted content only as needed to operate the App, provide requested features, generate outputs, troubleshoot issues, maintain security, and comply with legal obligations.

JanoGroup LLC and its licensors retain all rights in the App, software, interface, branding, designs, systems, documentation, and related materials.

Subject to these Terms and your compliance with applicable laws, you may use generated paint previews for personal home planning, personal visualization, sharing with painters or contractors for your own project, and personal social sharing. You are responsible for ensuring that your use of any generated output does not violate third-party rights or applicable laws.

AI-generated outputs may not be unique. Similar or identical outputs may be generated for other users.

## 6. Subscriptions, Credits, Premium Features, and Billing

The App may offer optional subscriptions, trials, premium features, credits, ad-free access, or other in-app purchases. Billing is handled by the applicable app marketplace or payment provider, such as Apple App Store or Google Play. Subscription access may be managed through RevenueCat.

Prices, billing periods, included credits, renewal terms, trial terms, and available features are shown in the App or applicable app-store listing and may change over time. Subscriptions renew automatically unless canceled according to the app marketplace's rules. You are responsible for managing and canceling subscriptions through your app-store account settings.

Credits, if offered, may be consumed when you generate or regenerate a paint visualization. Credits may expire, reset, or not roll over depending on the plan or offer shown in the App. We may modify credit amounts, feature availability, pricing, or usage limits to reflect service costs, product changes, or abuse prevention needs.

Refunds are handled by the applicable app marketplace or payment provider except where required by law.

## 7. Paint Color and Accuracy Disclaimer

AI-generated previews are estimates. They may be incomplete, inaccurate, unrealistic, unavailable, or visually different from real-world paint results. Actual appearance can vary based on surface material, existing paint, preparation, lighting, shadows, weather, camera settings, screen calibration, paint brand, finish, product availability, and application method.

Paint names, brand references, color codes, and hex values are provided for convenience and visualization. They may not match current manufacturer catalogs, local availability, pricing, or exact physical paint samples.

Before purchasing or applying paint, you should verify all colors, product codes, samples, finishes, surface preparation requirements, warranty terms, local rules, HOA rules, historic district requirements, permits, and contractor recommendations.

## 8. No Professional Advice

The App and its outputs are not a substitute for advice from qualified painters, contractors, architects, engineers, designers, inspectors, code professionals, attorneys, or other professionals.

Do not rely on the App for structural modifications, safety decisions, code compliance, permitting, property valuation, legal compliance, or any decision where professional judgment is required.

## 9. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how information may be collected, used, processed, stored, and shared, including photos, prompts, paint selections, subscription status, device-related information, advertising data, and local app settings.

## 10. Third-Party Links and Services

The App may contain links to third-party websites, app-store pages, paint brands, retailers, service providers, or sharing destinations. We do not control and are not responsible for third-party content, products, pricing, availability, policies, or practices.

Your interactions with third-party services are governed by their own terms and privacy policies.

## 11. Disclaimers and Limitation of Liability

THE APP, SERVICES, AND OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, JANOGROUP LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, RELIABILITY, AND ERROR-FREE OPERATION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JANOGROUP LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, GOODWILL, PROPERTY VALUE, BUSINESS OPPORTUNITY, OR REPUTATION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO USE THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR $50 IF YOU PAID NOTHING.

Some jurisdictions do not allow certain limitations, so some of the above limitations may not apply to you. In those cases, liability will be limited to the maximum extent permitted by law.

## 12. Indemnification

You agree to defend, indemnify, and hold harmless JanoGroup LLC, its affiliates, personnel, contractors, licensors, and service providers from and against claims, losses, damages, liabilities, costs, and expenses, including reasonable legal fees, arising from:

- Your use or misuse of the App or generated outputs

- Content you upload, submit, save, share, or export

- Your violation of these Terms or applicable law

- Your violation of third-party rights

- Paint purchases, property changes, contractor work, or other actions you take based on App outputs

## 13. Termination

You may stop using the App at any time and may cancel subscriptions through your app-store account settings. We may suspend, restrict, or terminate access to the App if we believe you violated these Terms, misused the App, created risk for us or others, or if required by law or provider policy.

After termination, rights granted to you under these Terms end, but sections that by their nature should survive will continue to apply, including intellectual property, disclaimers, limitation of liability, indemnification, privacy, and dispute provisions.

## 14. Governing Law and Disputes

These Terms are governed by the laws of Delaware, USA, without regard to conflict-of-law rules, except where your local consumer protection laws require otherwise.

Before filing a claim, you agree to contact us at janogroupllc@gmail.com and try to resolve the dispute informally. If a dispute cannot be resolved informally, it will be handled in the state or federal courts located in Washington, DC, unless applicable law requires another forum.

## 15. Changes to These Terms

We may update these Terms from time to time to reflect app changes, service provider changes, legal requirements, pricing changes, or operational updates. When we make changes, we may update the effective date above, post the revised Terms, or provide notice through app updates or related websites where appropriate.

Continued use of the App after a Terms update means you accept the revised Terms.

## 16. General Provisions

These Terms and the Privacy Policy form the entire agreement between you and JanoGroup LLC regarding the App. If any provision is found unenforceable, the remaining provisions will remain in effect. We may assign these Terms in connection with a merger, acquisition, sale of assets, or legal transfer. Our failure to enforce any provision is not a waiver.
