Welcome to ExamPrep ("ExamPrep," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the ExamPrep mobile application (the "App"). By downloading, installing, or using the App, you ("User," "you") agree to be bound by these Terms. If you do not agree, do not use the App.
1.1 The App is designed for students, including those under the age of 18. If you are under 18, you confirm that a parent or legal guardian has reviewed and consented to these Terms and to our [Privacy Policy] on your behalf.
1.2 Parents/guardians are responsible for supervising a minor's use of the App and for any consequences arising from that use.
1.3 We reserve the right to request age verification and to suspend or terminate access for any user who provides false information about their age.
2.1 ExamPrep provides practice questions, mock tests, progress tracking, and related study tools ("Content") for general educational and self-assessment purposes only.
2.2 We make no representation, warranty, or guarantee — express or implied — regarding:
the accuracy, completeness, currency, or correctness of any question, answer, explanation, or Content in the App;
your performance, marks, rank, or result in any actual board examination, entrance examination, or competitive examination (including but not limited to JEE, NEET, or any school/board examination);
that use of the App will result in improved grades, scores, or any specific academic outcome.
2.3 The App is a supplementary study aid, not a substitute for classroom instruction, official textbooks, or guidance from qualified teachers. You are solely responsible for verifying any information against official curricula and syllabi and for your own exam preparation and performance.
2.4 Content may contain errors, omissions, or outdated information despite our efforts to maintain quality. We do not warrant that Content is error-free.
3.1 You must create an account (via Google Sign-In or other supported method) to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
3.2 You agree to provide accurate information and to notify us promptly of any unauthorized use of your account.
3.3 We reserve the right to suspend, restrict, or terminate any account, at our sole discretion, without notice, for any actual or suspected violation of these Terms, misuse of the App, or any activity we consider harmful to the App, other users, or third parties.
You agree not to:
copy, scrape, reproduce, resell, redistribute, or create derivative works from any Content without our prior written consent;
reverse-engineer, decompile, or attempt to extract the source code of the App, except where such restriction is prohibited by applicable law;
use any automated means (bots, scripts) to access the App or its data;
attempt to gain unauthorized access to our systems, other users' accounts, or data;
upload or transmit any content that is unlawful, defamatory, obscene, or infringes any third party's rights;
use the App in any way that violates applicable local, state, national, or international law.
We reserve the right, but have no obligation, to monitor use of the App and to remove content or restrict access at our sole discretion.
5.1 All Content, trademarks, logos, software, and underlying technology in the App are owned by us or our licensors and are protected by applicable intellectual property laws.
5.2 We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial, educational use, subject to these Terms.
5.3 No other rights are granted. Nothing in these Terms transfers ownership of any intellectual property to you.
6.1 The App uses third-party services, including but not limited to Google Firebase (authentication, database, analytics, crash reporting, cloud messaging) and Google AdMob (advertising).
6.2 The App may display advertisements from Google and its advertising partners. We do not control, endorse, or take responsibility for the content of third-party advertisements, the products/services advertised, or the practices of third-party advertisers. Your interactions with advertisements are solely between you and the advertiser.
6.3 We are not responsible for the availability, content, accuracy, or practices of any third-party service, website, or platform linked from or integrated into the App.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
7.1 The App and all Content are provided "AS IS" AND "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted/error-free operation.
7.2 We do not warrant that: (a) the App will be uninterrupted, timely, secure, or error-free; (b) any defects will be corrected; (c) the App is free of viruses or other harmful components; or (d) results obtained from use of the App will be accurate or reliable.
7.3 Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you to the extent prohibited by applicable law.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
8.1 In no event shall ExamPrep, its owners, developers, officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of academic opportunity, loss of data, loss of goodwill, or any damages resulting from (a) your use of or inability to use the App; (b) any errors, mistakes, or inaccuracies in Content; (c) any unauthorized access to or use of our servers and/or personal information stored therein; (d) any interruption or cessation of the App; (e) any bugs, viruses, or the like; or (f) any exam result, academic outcome, or decision made in reliance on the App.
8.2 Our total aggregate liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the greater of (a) the amount you paid us, if any, in the twelve (12) months preceding the claim, or (b) INR 500. Since the App is free to use, this cap will typically be INR 500 or the applicable statutory minimum, whichever is legally enforceable.
8.3 These limitations apply regardless of the legal theory on which a claim is based (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
8.4 Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law (for example, liability for fraud, or death or personal injury caused by our gross negligence, where such exclusion is not permitted).
You agree to indemnify, defend, and hold harmless ExamPrep and its owners, developers, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use or misuse of the App; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any content you submit through the App.
10.1 We may suspend or terminate your access to the App at any time, with or without cause, with or without notice, including for violation of these Terms.
10.2 Upon termination, your right to use the App ceases immediately. Sections 2, 5, 7, 8, 9, 11, and 12 shall survive termination.
10.3 You may stop using the App and delete your account at any time through the App's settings, where available, or by contacting us.
11.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles.
11.2 Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed mutually by the parties. The seat and venue of arbitration shall be Hyderabad, Telangana, India, and the arbitration proceedings shall be conducted in English.
11.3 Jurisdiction: Subject to Section 11.2, the courts at Hyderabad, Telangana, India shall have exclusive jurisdiction over any matter not subject to arbitration.
11.4 Class Action Waiver: To the extent permitted by applicable law, you agree that any dispute resolution proceeding will be conducted only on an individual basis and not as a class, consolidated, or representative action.
We may modify these Terms at any time. Material changes will be notified through the App or by updating the "Last updated" date above. Continued use of the App after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.
13.1 Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
13.2 Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
13.3 No Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
13.4 Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
13.5 Force Majeure: We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, internet/network failures, government actions, or third-party service outages (including Firebase, Google Play Services, or AdMob).
