Welcome to Evershift Daily.
These Terms of Service ("Terms") govern your use of Evershift Daily, provided by Astro Hound Studios ("we," "our," or "us").
By downloading, accessing, purchasing, or using Evershift Daily, you agree to these Terms. If you do not agree, do not use the app.
Evershift Daily is a daily puzzle game intended for personal, non-commercial entertainment.
You must be legally permitted to use Evershift Daily and agree to these Terms where you live. If you are not old enough to enter into a binding agreement, a parent or legal guardian must agree on your behalf.
Evershift Daily is licensed, not sold, to you. Your use of the app is also subject to Apple’s App Store rules and the Apple Licensed Application End User License Agreement.
Evershift Daily may include daily towers, archived towers, characters, abilities, progression, streaks, statistics, achievements, reminders, and leaderboards.
As the game evolves, we may add, remove, repair, or rebalance gameplay features. We may also correct a tower, schedule, score, or result when a bug, exploit, or configuration problem affects gameplay or fairness.
Some features require an internet connection, Game Center, or other Apple services. We cannot guarantee that every online feature will always be uninterrupted or available on every device.
Evershift Daily uses Game Center for player identity, leaderboards, and achievements.
If you participate in a public leaderboard, other players may see information associated with your leaderboard entry. This may include your Game Center display name, avatar or initials, completion time, rank, and a country flag based on the Region selected on your device.
By participating, you allow Evershift Daily to display that information as part of the leaderboard. Evershift Daily’s separate Privacy Policy will explain how this information is processed.
You agree not to:
Cheat, exploit bugs, manipulate timers, or submit fabricated scores
Use bots, scripts, automation, modified clients, or unauthorized software
Bypass score validation, purchase verification, or security measures
Reverse engineer or attempt to extract Evershift Daily’s source code, except where the law expressly permits it
Disrupt the app, its online services, or another player’s use of the game
Use Evershift Daily for an unlawful or fraudulent purpose
We may reject or remove scores affected by cheating, exploitation, technical errors, or activity that violates these Terms. We may also restrict access to online features when reasonably necessary to protect the game and its players.
Evershift Daily may offer optional Pro access through monthly or yearly auto-renewable subscriptions and a one-time lifetime purchase.
The benefits, price, and billing period for each option are displayed in the app before purchase. Prices may vary by country or region.
Monthly and yearly subscriptions automatically renew until cancelled through your Apple Account. Apple processes payment and may charge for renewal within 24 hours before the current subscription period ends.
You can manage or cancel a subscription in your Apple Account settings. Cancelling prevents future renewals, but access generally continues until the end of the period already paid for.
A lifetime purchase is a one-time purchase that provides non-expiring access to the associated Evershift Daily Pro entitlement. It does not guarantee that Evershift Daily, its online services, or every individual feature will remain available indefinitely.
Eligible purchases may be restored using the Apple Account that originally completed the purchase. Apple handles billing and refund requests under its policies and applicable law.
We may improve or replace individual Pro features as Evershift Daily develops. We will respect active paid access and applicable consumer and App Store requirements.
Scores, streaks, achievements, medals, characters, and other in-game content have no cash value and cannot be sold or transferred.
Some progress is stored on your device, while certain features may synchronize through Game Center or Evershift Daily’s online services. Device changes, app deletion, loss of account access, or technical problems may affect saved progress.
Evershift Daily, including its software, gameplay, characters, artwork, animation, audio, music, text, design, and branding, is owned by or licensed to Astro Hound Studios and is protected by applicable intellectual-property laws.
You may not copy, sell, distribute, modify, or reproduce any part of Evershift Daily without permission, except where applicable law expressly permits it.
We may update Evershift Daily to add features, make balance changes, repair bugs, improve security, or maintain compatibility with Apple platforms.
We may suspend or discontinue part or all of the app or an online service when reasonably necessary. We do not guarantee uninterrupted access, permanent compatibility with every device, or indefinite availability of online features.
To the maximum extent permitted by law, Evershift Daily is provided on an “as is” and “as available” basis.
Astro Hound Studios does not guarantee that the app will always be uninterrupted, error-free, or free from loss of progress or service interruptions.
To the maximum extent permitted by law, Astro Hound Studios will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of Evershift Daily.
Nothing in these Terms limits consumer rights, warranties, or liabilities that cannot legally be limited or excluded.
You may stop using Evershift Daily at any time.
We may restrict access to online features if you materially violate these Terms, compromise the security or integrity of the service, or engage in cheating, fraud, abuse, or unlawful conduct.
We may update these Terms as Evershift Daily changes or as required for legal, security, or operational reasons.
Updated Terms will be posted in the app and/or on our website with a revised “Last Updated” date. Your continued use of Evershift Daily after updated Terms become effective constitutes acceptance of those Terms.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, except where the consumer laws of your place of residence require otherwise.
