Over the years, the Evergreen Homeowners Association (the “Association”) has developed these Rules and Regulations to address community issues that are not outlined in the Declaration of Covenants and Restrictions, in accordance with Article V, Section 5.1.18.
The Association reserves the right to alter, amend, modify, repeal or revoke these Rules and Regulations and any consent or approval given hereunder at any time by resolution of the Executive Board.
Wherever in these Rules and Regulations reference is made to “Unit Owners”, such term shall apply to the owner of any unit, to his/her family, tenants whether or not in residence, employees, agents, visitors and to any guests, invitees or licensees of such Unit Owner, his/her family or tenant of such Unit Owner. Wherever in these Rules and Regulations reference is made to the Association, such reference shall include the Association and any Manager when a Manager is acting on behalf of the Association.
The normal business hours of the Executive Board will be Monday through Friday from 9:00 am to 5:00 pm EST, excluding all U.S. legal holidays. The Executive Board will respond to inquiries from Unit Owners during normal business hours, except for emergencies.
Unit Owners shall submit all questions, concerns, complaints or requests, in writing, to the Executive Board. Submissions may be sent via email, online form, USPS mail, or hand-delivered to the HOA’s President, Vice President, or Secretary. The Executive Board shall have 30 calendar days to respond to all submissions.
Resale certificates must be requested at least 10 days prior to the sale of a home. That will provide time for the Executive Board to determine if any changes need to occur to the property for compliance before a change in ownership.
All pets shall be housed inside a dwelling. No pet houses, runs, shelters, or structures of any kind are allowed on the outside of the dwelling. No commercial breeding of animals of any kind is allowed.
When outside, all pets must be accompanied by an individual and maintained on a leash (maximum 6’ length) at all times. No animals, including cats, shall be allowed to be unleashed or to roam freely. Unit Owners shall be responsible for cleaning up, removing and discarding in the proper receptacles all pet excrement produced by their animal immediately when walking their pet. Pet owners shall be fully responsible for any personal injury and/or property damage caused by their pets.
Please do not feed wild animals of any kind with 4 legs. Putting food out for cats will attract skunks, squirrels, groundhogs and other animals that may take up residence, damage property or spread disease. Please respect your neighbors’ property by not inviting unwanted wild animals.
The Association wants to promote our community’s “Tree Lined Streets”. If the original tree in your front yard was removed, please plant another. Some trees were removed to prevent damage to properties, or they may have been diseased. There are a variety of trees available with smaller root systems which would help our community’s image. Unit Owners are encouraged to replace any tree removed, but it is not required.
The Association will sponsor a community yard sale yearly in June, in conjunction with Konhaus Estates and other phases in our development. Personal yard sales, estate sales, or auctions when moving are permitted on an occasional basis. They are not intended to be used as an ongoing business. A small yard sign is permitted on the day of the sale, but must be removed immediately after the sale.
No political signs/flags are permitted in front yards or visible from the street.
Unit Owners are permitted to change the color of their unit’s exterior doors and shutters (if originally installed) to one of the six approved colors (Midnight Green, Tuxedo Gray, Wineberry, Mid America Black, Midnight Blue or Musket Brown). [Board clarification 4/11/2023]: Based upon past tradition, all the connected townhouses (within the same building) are to maintain the same color scheme for all exterior doors and shutters across the connected units. All unit owners (within the same building) must agree to any proposed change in color.
Unit Owners are permitted to use plastic, metal, decorative brick or concrete curbing for landscape edging.
Unit Owners are permitted to use a patio storage box for additional outdoor storage. A patio storage box is defined as a self-contained exterior cabinet, made from plastic, vinyl or resin, with one or two access doors. The patio storage box must be placed against the rear exterior wall of the home, or placed upon a rear patio or deck as close to the rear exterior wall as possible, and must not be visible from the street. The maximum size allowed is 54” (L) x 28” (W) x 72” (H). The color of a patio storage box should compliment the unit’s exterior colors.
Before any construction starts outside of your home, plans must be submitted to the Executive Board for review and approval. Failure to do so may result in an order to remove structures not in compliance with the Declaration of Covenants and Restrictions or these Rules and Regulations.
Nothing shall be done inside or outside any townhouse unit, which may impair the structural integrity of an adjacent, connected townhouse.
Rear additions, covered patio structures, sunrooms, decks, and concrete rear patios expanded from the original size must be permitted by Silver Spring Township to conform to their building codes and zoning ordinances. They must be in back yards only and match the original colors and styles of the original structure. They must not be visible from the street (beyond the sides of the original building).
The installation of a hot tub or spa shall require a permit issued by Silver Spring Township, and must be placed at the rear of the dwelling (either on a patio or immediately adjacent to the dwelling) and not visible from the street. All hot tubs and spas shall not be drained onto back yards, common areas, or down stormwater management drains, per Silver Spring Township’s ordinances.
No in-ground or above-ground pools shall be permitted.
No sports apparatus such as basketball hoops, hockey goals, etc. may be placed on driveways or streets. They may be used in the rear yard of the home, not visible from the streets. They may be used on common areas, except when mowing or maintenance is scheduled, and removed when play stops. No sports or social activities are allowed on the common areas after dusk.
No parking is allowed on the common areas at any time.
No skateboards (traditional or motorized), rollerblades, bicycles (traditional or electric), motorcycles, scooters or any other type of motorized vehicles are permitted on the common areas, including the walk paths. This is not intended to prohibit wheelchairs or other similar motorized vehicles designed for and used by disabled persons using the walking paths.
The following activities are not permitted on the common areas: setting off fireworks, hitting/driving/chipping golf balls, paintball, archery/crossbow or shooting of firearms.
The planting of flowers, trees, shrubs, or crops of any kind is not allowed on the common areas by Unit Owners.
The common areas are owned and maintained by the Association. The maintenance of the common areas is directed by the Executive Board only. The removal and replacement of trees is at the sole discretion of the Executive Board. The Association understands that trees play an important role to beautify our neighborhood and contribute to the well-being of our environment. Proposed locations will be examined before decision making to assess space requirements and compatibility with surrounding areas. However, the Association will not replace trees or any other plants for the benefit of screening or beautification of any Unit Owner’s dwelling.
No Unit Owner shall direct, supervise or in any manner attempt to assert control over or request favors of any employee or contractor engaged by the Association.
All waste and recyclable materials must be disposed of in a proper manner consistent with all applicable regulations of Silver Spring Township and any other governmental entity with jurisdiction. No waste disposal or recycling containers may be placed or otherwise stored on any exterior part of a unit or on the common areas. Waste disposal and recycling containers may not be placed curbside before dusk on the day immediately before the designated pickup day and must be removed by the end of the designated pickup day.
