UV Index: Sun & Tan Tracker ("the App") is provided by Ertuğrul Sarı. By downloading, installing, accessing, or using the App, you agree to the following terms and conditions. If you do not agree with these terms, you should not use the App.
The App is designed to help users monitor the local UV index, track tanning sessions, estimate safe sun-exposure time based on a self-reported skin type, receive reminders to reapply sunscreen, and log sun-exposure history to Apple Health. The App is available for personal, non-commercial use and is intended for informational and wellness purposes only.
The App is not a medical device and does not provide medical advice. UV index readings, sunburn-risk estimates, SPF burn-time calculations, vitamin-D estimates, and skin-type self-assessments inside the App are general informational tools. They are not a clinical diagnosis, a dermatological evaluation, or a personalized medical recommendation. The App does not detect, diagnose, treat, cure, or prevent any disease, including but not limited to skin cancer, sunburn, photosensitivity disorders, vitamin D deficiency, heat exhaustion, or eye damage. You are solely responsible for your sun-exposure decisions, your sunscreen use, and any health outcome resulting from time spent in the sun. Always consult a qualified dermatologist or healthcare professional before relying on the App to guide your behavior, particularly if you have a history of skin cancer, photosensitivity, melanoma in your family, are pregnant, are taking photosensitizing medication, or are caring for a child.
The App is intended for users who are at least 13 years of age, or 16 in the European Economic Area. By using the App, you represent that you meet this requirement.
The App offers optional premium subscription plans that unlock additional features. Subscriptions are managed and billed through Apple's App Store and are subject to Apple's terms and conditions.
The current plans are:
Weekly: €4.99 per week, with a 3-day free trial for new subscribers.
Annual: €39.99 per year, billed yearly.
The following terms apply to every subscription:
Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date. Your payment method is charged at confirmation of purchase and at each renewal.
Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
You can manage or cancel your subscription at any time through Settings → [Your Name] → Subscriptions on your iPhone.
All purchases are processed by Apple. Refund requests must be submitted directly to Apple via https://reportaproblem.apple.com/. We do not process refunds directly.
Pricing and the features available under any subscription tier may change. Existing subscribers will be notified of material changes in accordance with Apple's policies.
The UV index, hourly forecast, sunrise, sunset, and temperature shown in the App are retrieved from Open-Meteo, a public weather data service. By using these features, you acknowledge and agree that:
UV and weather data are estimates produced by atmospheric models and may be inaccurate, delayed, or unavailable due to network conditions, model error, or upstream outages.
The App's burn-time, vitamin-D, and reminder calculations are derived from this third-party data combined with your self-reported skin type and exposure pattern. They inherit the inaccuracy of their inputs and are not personalized medical advice.
We are not liable for any health, safety, or lifestyle decisions you make based on UV data shown in the App.
We may change the weather data provider or the calculation models used by the App at any time without notice.
With your explicit permission, the App reads existing UV exposure samples from Apple Health and writes one UV exposure sample for each completed tan session containing the average UV index, the duration, and the start time. We do not write any other data to Apple Health, and we never upload HealthKit data to our servers or to any third party. We are not responsible for inaccuracies in HealthKit data, which originates from Apple, your device, and any other connected apps or devices that contribute samples to your Health profile. You can revoke read or write permission at any time via the Apple Health app or iOS Settings.
With your "While Using the App" permission, the App reads your coarse location (approximately hundred-meter accuracy) to fetch the UV forecast for your current point and to display a city and country label. We are not responsible for inaccuracies in location data returned by iOS, including geocoding errors that may attribute the wrong city to a coordinate. You can revoke location access at any time via iOS Settings. When access is revoked, the App falls back to whichever named location you most recently selected.
As a user, you agree to the following:
Lawful use: You agree to use the App only for lawful purposes and in compliance with all applicable laws.
Non-commercial use: The App is intended for personal, non-commercial use only.
Personal responsibility for sun exposure: You acknowledge that the App is informational only, that exposure to ultraviolet radiation carries inherent health risks including sunburn, premature skin aging, eye damage, heat-related illness, and skin cancer, and that you are solely responsible for the decisions you make about time in the sun, sunscreen choice and reapplication, protective clothing, and shelter, regardless of what the App displays or recommends.
Prohibited activities: You agree not to reverse engineer, decompile, or disassemble the App; attempt to circumvent rate limits or subscription checks; use automated systems, bots, or scripts to interact with the App; or engage in any activity that disrupts the App's operation, the operation of Apple's services, or the operation of Open-Meteo.
Intellectual property: You agree not to copy, distribute, modify, or create derivative works from the App's content, code, design, or branding without express written permission from the App owner.
The App integrates with third-party services including Apple Health, Apple location services, the Apple App Store, Apple's notification system (including Live Activities), and Open-Meteo (a public weather service). You agree that:
We are not responsible for the availability, performance, accuracy, or data practices of any third-party service.
Third-party services may be changed, discontinued, or altered at any time, potentially affecting App features.
Your use of any third-party service is subject to that service's own terms and privacy policies.
The App is provided "as is" and "as available" without any warranty, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not guarantee that the App will be error-free, uninterrupted, or secure, that UV forecasts, burn-time calculations, vitamin-D estimates, or reminders will be accurate, timely, delivered, or suitable for any purpose, or that the App will work in conjunction with any specific device, operating-system version, or third-party service.
To the fullest extent permitted by applicable law, Ertuğrul Sarı shall not be liable for any direct, indirect, special, incidental, consequential, or exemplary damages arising from your use of or inability to use the App. This includes but is not limited to:
Sunburn, skin damage, melanoma, non-melanoma skin cancer, premature aging, photosensitivity reactions, eye damage, heat exhaustion, dehydration, vitamin D deficiency or toxicity, or any other health outcome arising from sun exposure decisions made while using the App.
Inaccurate, delayed, missing, or unavailable UV forecast data sourced from Open-Meteo or any successor weather provider.
Inaccurate or missed reminders, notifications, peak-UV warnings, or safe-again alerts.
Loss of data including saved locations, tan session history, or profile information stored on your device.
Issues with subscriptions or payments processed through Apple.
Failures, downtime, or data loss caused by Apple, Open-Meteo, or any other third-party service the App depends on.
Inaccuracies in HealthKit data sourced from Apple or connected devices.
Any decision you make about sun exposure, sunscreen use, time outdoors, or care for your skin while using the App is done entirely at your own risk. We are not responsible for any errors, inaccuracies, or consequences that result from using the App. Where applicable law does not permit the full exclusion of liability, our total aggregate liability to you for any and all claims arising under or relating to these Terms or the App is limited to the amount you actually paid to Apple for the App's subscription in the twelve (12) months immediately preceding the event giving rise to the claim, or one hundred euros (€100), whichever is lower.
All rights, title, and interest in the App, including its design, code, graphics, algorithms, and branding, remain the sole property of Ertuğrul Sarı and are protected by applicable intellectual property laws. You are granted a non-exclusive, non-transferable, revocable license to use the App for personal use only. This license does not grant you any rights to copy, distribute, or modify the App's content or assets without express permission.
We reserve the right to update, modify, or discontinue the App or any of its features at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the App. In the event of discontinuation, unused subscription periods will be subject to Apple's refund policies.
We reserve the right to terminate or suspend your access to the App at any time if we have reason to believe you are in violation of these Terms. Termination does not entitle you to refunds unless required by Apple's policies or applicable law.
By using the App, you also agree to our Privacy Policy, which explains how we handle data, location data, Apple Health integration, and third-party services. The Privacy Policy is accessible within the App and on our official website.
You acknowledge that these Terms are concluded between you and Ertuğrul Sarı only, and not with Apple Inc. Apple is not responsible for the App or its content. The following Apple-specific provisions apply:
Scope of license: The license granted to you for the App is limited to a non-transferable license to use the App on Apple-branded devices that you own or control, as permitted by the Apple Media Services Terms and Conditions.
Maintenance and support: Ertuğrul Sarı is solely responsible for providing any maintenance and support services with respect to the App. Apple has no obligation to furnish any maintenance or support services.
Warranty: Ertuğrul Sarı is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
Product claims: Ertuğrul Sarı, not Apple, is responsible for addressing any claims relating to the App or your possession and/or use of the App, including (a) product liability claims, (b) any claim that the App fails to conform to any applicable legal or regulatory requirement, (c) claims arising under consumer protection, privacy, or similar legislation, and (d) any claim under or pursuant to applicable health and safety legislation.
Intellectual property rights: In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Ertuğrul Sarı, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
Legal compliance: You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-party beneficiary: You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
Any disputes arising in connection with these Terms will be subject to mediation or arbitration as per the laws of Turkey. These Terms are governed by the laws of Turkey, and any unresolved disputes will be subject to the exclusive jurisdiction of the competent courts in Turkey. Users may have additional rights under applicable local laws, including the GDPR in the EU, the UK GDPR in the United Kingdom, the CCPA in California, or the KVKK in Turkey.
We may update or modify these Terms at any time. Any changes will be reflected by an updated "Last Updated" date at the top of this document. Your continued use of the App after changes constitutes your agreement to the updated Terms.
