TERMS AND AGREEMENT

Please read this agreement carefully. By paying the reservation fee and signing this document, you acknowledge that you have read, understood, and voluntarily agreed to all the terms and conditions stated herein. 

▪ BOOKING POLICY

Reservation Fee: A reservation fee equivalent to 50% of the total lesson fee is required to secure the client's scheduled lesson. The reservation fee shall be applied toward the total lesson fee upon completion of the lesson. A booking is considered confirmed only after the required payment has been received.

Cancellation: Reservation fee is strictly non-refundable. Client cancellation or no-show forfeits the reservation fee. 

Rescheduling: Allowed for severe weather, medical emergencies, family emergencies, vehicle breakdown, or other valid reasons subject to instructor approval. 

Schedule Availability: Rescheduled lessons depend on instructor availability. Requested dates are not automatically confirmed. The nearest available schedule will be offered. 

Client-Initiated Cancelling & Rescheduling: Client-initiated cancellations are generally not permitted and reservation fees are non-refundable. This is because the instructor reserves the scheduled time exclusively for the client and may incur preparation, transportation, fuel, and other related expenses. A client who fails to attend the scheduled lesson without an approved rescheduling arrangement shall be considered a no-show, and the applicable reservation fee shall be forfeited.

A requested rescheduling is not automatically confirmed merely because the client has requested it. The new schedule must be expressly confirmed by the instructor/administrator/manager, inform early the administrator or instructor for changes of schedule.. If the client declines the available rescheduled schedule or is unable to agree to another available schedule, the situation may be treated as a client-initiated cancellation, and the applicable non-refundable policy shall apply.

Instructor-Initiated Rescheduling: Reservation remains valid. The client receives priority on the nearest available schedule matching their availability. If the instructor is unable to proceed with the scheduled lesson due to an accident, medical emergency, sudden vehicle problem, unsafe road condition, severe weather, natural disaster, government restriction, or any other unforeseen circumstance affecting the instructor’s ability to safely conduct the lesson, the lesson shall be rescheduled rather than treated as a client cancellation.

The safety of the instructor and client shall always be the highest priority. The administrator/manager has to confirm or approve before cancel, postpone, or interrupt a lesson when continuing the lesson may reasonably pose a safety risk.

Refund Policy: General Rule: Reservation fees are non-refundable because they secure the instructor’s time and schedule.

Refunds are granted only in limited and exceptional circumstances, as determined by the administrator, including situations where the lesson cannot reasonably be conducted and rescheduling is not reasonably possible.

Where a refund is approved, the amount refunded may depend on the circumstances of the cancellation and any reasonable costs already incurred in connection with the scheduled lesson, including but not limited to:

• Instructor preparation and reserved time;

• Transportation or travel expenses;

• Fuel expenses;

• Other reasonable costs directly related to the scheduled lesson.

Accordingly, a refund, when granted, may not necessarily equal the full amount previously paid. Any refund amount shall be communicated to the client by the administrator.

▪ CLIENT REPONSIBILITIES

• Arrive on time. 

• Wear appropriate footwear. 

• Bring a valid Student Permit or Driver's License. 

• Below 18 years old: submission of a signed consent letter from their parent or legal guardian, together with the copy of the parent or legal guardian's valid government ID authorizing the client's participation. 

• Disclose medical conditions that may affect driving. 

• Be physically and mentally fit. 

• Follow all lawful instructor directions. 

• Observe traffic laws. 

• Do not participate under the influence of alcohol or illegal drugs. 

▪ USING THE INSTRUCTOR'S VEHICLE

• Use the vehicle responsibly. 

• No smoking. 

• No eating or drinking. 

• Damage caused by negligence or failure to follow instructions may be charged after assessment. 

• Any additional fuel expense beyond the agreed fuel allowance shall be shouldered by the client. The exact amount will not be estimated or collected on the spot immediately after the lesson. Additional fuel will be calculated based on the actual fuel expense and corresponding receipt(s) after the instructor has completed the lesson, returned to their home/area, and the client has also reached their destination. The final additional fuel amount will then be communicated to the client for settlement. This ensures that the client is charged based on the actual fuel expense and not an estimate or guess.

▪ LATE POLICY 

Late arrival: The lesson will still end at the originally schedule time. Late time will not be added or extended to the lesson. 

20 minutes No-Show Policy: The instructor travels to the client’s designated location, so clients are expected to be ready at the scheduled time. If the client has not arrived within 20 minutes of the scheduled lesson time, the reservation will be considered a no-show and the reservation fee will be forfeited. Requests to wait or messages sent within the 20-minute period do not extend or reset the 20-minute limit.

▪ ACCIDENTS, DAMAGES, & LIABILITY

• Driving lessons involve inherent risks, even with a qualified instructor. 

• Client-owned vehicle: Instructor is not responsible for vehicle damage except where required by law. 

• Instructor-provided vehicle: Client may be responsible for repair costs, penalties, towing, cleaning, and other losses resulting from reckless behavior or failure to follow instructions, subject to assessment. 

▪ Service Areas

EMG Driving Tutorial Services is based in Pampanga and currently provides driving tutorial services in Pampanga, Manila, Bulacan, and nearby areas.

Our driving lessons are conducted at the client's agreed location, subject to instructor availability, scheduling, and applicable travel arrangements. EMG does not currently have a physical office available for client visits.

For clients located outside our regular service areas, you may contact us and provide your location for inquiry. We may accommodate nearby or other areas depending on availability and travel requirements. Additional travel fees may apply depending on the client's location.

Service availability and rates may vary depending on the distance, location, and other travel considerations. Clients will be informed of any applicable additional charges before the booking is confirmed.

▪ DASHCAM POLICY

Lessons may be recorded for safety, security, documentation, incident review, and dispute resolution. 

▪ PRIVACY POLICY

Personal information is collected only for booking, scheduling, lesson records, and business administration, and kept confidential unless disclosure is required by law. 

▪ COMMUNICATION POLICY

Official confirmations, cancellations, and rescheduling must be made through the designated communication channel. 

▪ FORCE MAJEURE

Lessons may be postponed, cancelled, or rescheduled due to circumstances beyond the reasonable control of the instructor/administrator, including but not limited to:

• severe weather or unsafe weather conditions;

• flooding or other natural disasters;

• road closures or dangerous road conditions;

• government restrictions;

• vehicle breakdown;

• traffic incidents;

• accidents;

• medical emergencies;

• sudden illness;

• or other unforeseen circumstances affecting the safe conduct of the lesson.

Safety shall always take priority over the scheduled lesson.

▪ GENERAL TERMS & CONDITIONS

• The instructor has the authority to make immediate decisions during a lesson if a situation becomes unsafe. 

• Instructor determines routes and lesson progression. 

• This is a private driving lesson service, not LTO-accredited, and does not issue certifications. 

• Lessons focus on practical driving skills. 

• Clients are not permitted to bring companions during the lesson unless prior approval has been given by the instructor, to ensure safety and avoid distractions. 

• An assistant or companion may be present for operational and safety purposes. 

IMPORTANT NOTICE

This agreement is intended to set clear expectations between the instructor and the client. It does not waive any rights or responsibilities that cannot legally be waived under applicable law.
