Terms of Use for Element Snap

Please read these Terms of Use ("Terms") carefully before using the Element Snap Chrome Extension (the "Service") operated by BuckDev68  ("us," "we," or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Service, you agree to be bound by these Terms.

1. The Service

Element Snap provides users with tools to capture web elements ("Screenshots") and use Artificial Intelligence ("AI") to generate related content, such as code, social media posts, and descriptions ("Generated Content").

We offer two tiers of service:

"Free" Plan: Provides access to basic features and limited AI usage.

"Premium" Plan: Provides access to all advanced AI features, subject to the terms of your subscription.

2. Payments, Subscriptions, and Refunds

A. Merchant of Record (Paddle)

We use Paddle.com as our Merchant of Record (MoR). Paddle is the reseller of our Service and handles all billing, payments, and subscription management on our behalf.

When you purchase a "Premium" Plan, you are entering into an agreement with Paddle. All payment processing is handled by them, and your payment data is subject to Paddle's Privacy Policy.

B. Subscriptions

Premium plans are billed on a subscription basis (monthly or yearly). Your subscription will automatically renew at the end of each billing cycle unless you cancel it. You can manage or cancel your subscription through the billing portal provided to you by Paddle.

C. Refunds

All requests for refunds must be directed to **Paddle.com**. As our Merchant of Record, they are responsible for processing all refund requests in accordance with their own policies.

3. User Accounts

To access certain features of the Service (including all AI features), you must register for an account. We use Firebase Authentication (a Google service) for account creation. You are responsible for safeguarding your account and for any activities or actions under your account.

4. Generated Content & AI Disclaimer

A. User Responsibility

You are solely responsible for the content (images, HTML) you upload to the Service. You agree not to use the Service to process any content that is illegal, harmful, or infringes on the rights of others.

B. NO WARRANTY ON AI CONTENT

The AI-generated content (code, text, etc.) is provided on an "AS IS" basis. We make no warranties or representations about the accuracy, completeness, or reliability of any Generated Content.

You agree to use the Generated Content at your own risk. We are not liable for any damages or losses (e.g., from using buggy AI-generated code) resulting from your use of the Generated Content.

5. Acceptable Use

You agree not to use the Service to:

• Reverse engineer, decompile, or disassemble the Service.

• Generate content that is hateful, defamatory, or discriminatory.

• Violate any applicable local, national, or international law.

• Abuse the Service with an excessive volume of requests.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Service will cease.

7. Limitation of Liability

In no event shall Element Snap, nor its directors or employees, be liable for any indirect, incidental, or consequential damages resulting from your use of the Service or the AI-generated content.

8. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes. By continuing to use the Service after those revisions become effective, you agree to be bound by the revised terms.
