## Agreement to Terms
By downloading, installing, or using EchoNote (the "App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.
## Description of Service
EchoNote is a note-taking application that allows users to:
- Create and manage notes
- Record and transcribe audio
- Import and process documents, images, and audio files
- Generate summaries using AI services
- Organize notes with tags and categories
## User Accounts and Subscriptions
### Free Tier
- Users can create up to 3 notes for free
- Additional features may be limited in the free tier
### Premium Subscription
- Premium subscriptions are available through in-app purchases
- Subscriptions are managed by Apple's App Store and RevenueCat
- Subscription terms, pricing, and auto-renewal policies are governed by Apple's terms
- You can manage your subscription through your Apple ID account settings
## User Responsibilities
### Acceptable Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the App to create, store, or share illegal, harmful, or offensive content
- Violate any applicable laws or regulations
- Infringe upon intellectual property rights
- Attempt to reverse engineer, decompile, or hack the App
- Use automated systems to access the App
- Interfere with or disrupt the App's functionality
### Content Ownership
- You retain all ownership rights to content you create in the App
- You are solely responsible for the content you create, store, or share
- We do not claim ownership of your notes or content
## AI Services
### ChatGPT Integration
- The App uses OpenAI's ChatGPT service for AI-powered features
- Your transcription text is sent to OpenAI for processing when you use AI features
- OpenAI's terms of service apply to data sent to their service
- We are not responsible for OpenAI's processing of your data
### On-Device AI
- When available, the App may use on-device AI processing
- On-device processing does not send data to external servers
## Limitations and Disclaimers
### Service Availability
- We do not guarantee that the App will be available at all times
- The App may experience downtime for maintenance or updates
- We reserve the right to modify or discontinue the App at any time
### Data Loss
- While we implement data protection measures, you are responsible for backing up your data
- We are not liable for any loss of data, notes, or content
- We recommend regularly exporting or backing up your important notes
### Accuracy
- AI-generated summaries and transcriptions may contain errors
- We do not guarantee the accuracy of transcriptions or AI-generated content
- You should review and verify all AI-generated content
## Intellectual Property
### App Ownership
- The App, including its design, features, and functionality, is owned by us
- All trademarks, logos, and service marks are our property
### User Content
- You grant us a limited license to process your content as necessary to provide App functionality
- This license is limited to providing services within the App
## Subscription Terms
### Auto-Renewal
- Premium subscriptions automatically renew unless cancelled
- You can cancel your subscription at any time through your Apple ID account settings
- Cancellation takes effect at the end of the current billing period
### Refunds
- Refund requests are handled through Apple's App Store
- We do not process refunds directly
- Apple's refund policy applies to all purchases
### Price Changes
- We reserve the right to change subscription prices
- Price changes will be communicated in advance
- Existing subscriptions will continue at the current price until renewal
## Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PAST 12 MONTHS
- WE ARE NOT RESPONSIBLE FOR THIRD-PARTY SERVICES (OpenAI, RevenueCat, Apple)
## Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another party
## Termination
### By You
- You may stop using the App at any time
- You can delete the App from your device
- Cancelling your subscription does not delete your data
### By Us
We may terminate or suspend your access to the App if you:
- Violate these Terms of Use
- Engage in fraudulent or illegal activity
- Misuse the App or its services
## Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by:
- Posting updated Terms in the App
- Updating the "Last Updated" date
- Providing notice through the App
Continued use of the App after changes constitutes acceptance of the new Terms.
## Governing Law
These Terms are governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.
## Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through:
