Effective date: 2026-09-30
These Terms of Service ("Terms") govern your use of SameDrive, provided by Dvelop42 ("we," "us," or "our"). Please read them before using the app. By using SameDrive, you agree to these Terms to the extent an agreement may validly be formed that way under applicable law. If you do not agree, do not use the app.
SameDrive is a personal tool for exploring existing driving records, identifying recurring journeys and similar recorded paths, and comparing historical time, distance, and energy measurements. It uses data available through Tessie and offers optional Apple iCloud synchronization.
SameDrive is independently developed. It is not affiliated with, endorsed by, or operated by Tesla, Tessie, or Apple. Their names and trademarks belong to their respective owners.
You must be legally able to enter these Terms, or have the permission and supervision of a parent or guardian where legally permitted. The app is not intended for children under 13 or a higher applicable minimum age. You must also satisfy the eligibility rules of services you connect.
Only connect accounts, vehicles, and records you are authorized to access. If records relate to another driver or person, you are responsible for obtaining any necessary permission and complying with applicable privacy requirements. Do not use SameDrive for unauthorized monitoring.
Keep your device, Apple Account, and Tessie token secure. You are responsible for your own misuse of credentials and for taking reasonable precautions to prevent unauthorized access. Revoke a compromised token through Tessie. Do not send tokens or passwords to support.
The software license for the App Store version is governed by the Apple Standard Licensed Application End User License Agreement unless a different license is expressly supplied with the app. These Terms supplement that license concerning the service; they do not replace it or override mandatory App Store usage rules. If a software-license provision conflicts, the applicable software license controls that issue. Mandatory law always prevails.
Use the app lawfully and within the rights granted by its license. You may not bypass security controls, obtain records without authorization, interfere with connected services, exploit credentials, or redistribute or commercially exploit the app without permission. Restrictions do not prevent activities that applicable law expressly permits, including protected interoperability or security research.
We and our licensors retain rights in the app's software, design, and branding. You retain your rights in your own information and the names or other content you supply. You authorize only the processing and transfers needed to provide the features you choose, as explained in the Privacy Policy; these Terms do not transfer ownership of your driving records to us.
Use the app only when it is safe and lawful. Do not interact with it while driving or allow its notifications or comparisons to distract you.
SameDrive is not a navigation, traffic, emergency, vehicle-control, or safety-monitoring service. It does not certify routes or predict whether a route will be safe, faster, or more efficient. It is not a substitute for vehicle instruments, manufacturer guidance, or your own judgment.
Comparisons and summaries depend on the completeness and accuracy of third-party records and the app's statistical assumptions. A route grouping may be wrong, a location may be approximate, or a measurement may be missing or delayed. An observed difference does not establish its cause or guarantee a future result. Sample records are illustrative.
Do not treat the app as a guaranteed record for tax, reimbursement, insurance, legal, or other consequential purposes. Independently verify information needed for those purposes.
Importing personal history requires compatible Tessie access. iCloud features require a compatible Apple Account and available services and storage. Your device, network, operating system, account permissions, and providers can affect availability.
Apple, Tessie, and other connected providers operate under their own terms and policies. Their subscriptions, storage charges, or network charges, if any, are separate from SameDrive. Purchasing or using SameDrive does not include or guarantee access to a third-party service.
Third-party API changes, limits, outages, account restrictions, or discontinued services may affect or prevent features. We cannot guarantee uninterrupted access, a particular synchronization time, notification delivery, or continued compatibility with every provider or operating system.
Any price for SameDrive will be disclosed at the point of purchase. App Store billing and refund procedures apply to App Store purchases, together with any rights you have under applicable law. These Terms do not authorize an undisclosed subscription or recurring charge.
Our Privacy Policy explains how information is processed, stored, synchronized, and removed. Review it before connecting an account or enabling optional features.
You are responsible for retaining an independent copy of records that matter to you using the original provider or another suitable method. SameDrive is not a guaranteed backup or archival service. Synchronization can be delayed or interrupted, and device loss, storage failure, deletion, or changes to third-party services can make data unavailable.
Deleting local history does not delete the iCloud copy, other devices' copies, or original Tessie records. Disconnecting Tessie removes the token on that device but keeps saved history. Follow the separate controls described in the Privacy Policy if you want to remove all relevant copies or revoke access.
We do not obtain ownership of your data, and the responsibility to retain important records does not waive any non-excludable obligation we owe concerning that data.
We may update or modify the app for maintenance, security, compatibility, or product development. Features can change or be discontinued. Where required by law or an express purchase commitment, we will provide notice, continued access, refunds, or other remedies. Nothing here grants an unrestricted right to remove paid contractual benefits.
You may stop using the app at any time. Disconnect Tessie, manage your local and cloud copies as desired, and uninstall the app. Stopping use or uninstalling does not cancel subscriptions you have with other providers.
To the extent legally permitted, rights granted under these Terms may be suspended or terminated for a material breach. Where appropriate, we will give notice and a reasonable opportunity to remedy the breach; immediate action may be necessary to address unlawful activity, serious security risks, or a legal requirement. Provisions that by their nature need to continue, including ownership, accrued obligations, and lawful liability limitations, survive termination.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SAMEDRIVE AND ITS OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE EXTENT THEY MAY LAWFULLY BE DISCLAIMED.
We do not promise that the app or its outputs will be error-free, uninterrupted, complete, suitable for every purpose, or capable of restoring every lost record. No informal support statement creates a warranty beyond an express written commitment or an obligation imposed by law.
These limitations do not remove statutory warranties, consumer guarantees, or other rights that cannot lawfully be excluded.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DVELOP42 WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST BUSINESS OPPORTUNITIES, OR LOSS OF DATA ARISING FROM USE OF OR INABILITY TO USE SAMEDRIVE, EVEN IF SUCH LOSS WAS FORESEEABLE.
Subject to the exceptions below and the applicable Apple software license, our total liability arising from the app and these Terms is limited, to the extent lawful, to the greater of USD 100 or the amount you paid for SameDrive during the 12 months before the event giving rise to the claim. Amounts paid to independent third-party providers are not payments for SameDrive.
No limitation excludes or restricts liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that applicable law does not permit us to limit. If your jurisdiction does not permit a particular exclusion or cap, it does not apply to you to that extent. Your mandatory consumer remedies remain available.
Please contact us first so we can try to resolve a concern. Doing so is not a condition for exercising a legal right or meeting a legal deadline.
Applicable law determines which laws and courts govern a dispute. These Terms do not impose mandatory arbitration, waive participation in a class action, or take away a consumer's right to use courts or remedies available under mandatory local law.
If a provision is unenforceable, it applies only to the extent permitted and the remaining provisions continue where legally possible. A failure to enforce a provision on one occasion does not waive the ability to enforce it later.
We may revise these Terms and will update their effective date. We will give reasonable notice of material changes through the app or another appropriate channel before they take effect, except when an earlier change is required for legal or urgent security reasons. Where applicable law requires renewed agreement, we will obtain it. Changes will not retroactively remove accrued rights.
