Welcome to Durare – Push-Up Counter App (“the App”), operated and owned by Subhajit Rajak (“we,” “our,” or “us”).
By downloading, accessing, or using this App, you (“the user”) agree to be bound by these Terms and Conditions (“Terms”).
If you do not agree with these Terms, you must discontinue use of the App immediately.

1. Use of the App

Durare is a mobile application that uses face detection technology to count push-ups in real time.
The App is intended for personal fitness tracking and informational purposes only.
You agree to use the App only for lawful purposes and in accordance with these Terms.

2. Eligibility

By using the App, you confirm that:

• You are at least 13 years of age or older.

• You have the legal capacity to enter into this agreement.

• You will comply with all applicable local, state, national, or international laws.

3. User Accounts and Authentication

The App allows users to sign in via Google Sign-In.
When you create or access an account:

• You agree to provide accurate, current, and complete information.

• You are responsible for maintaining the confidentiality of your Google account credentials.

• You are responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that are used for fraudulent, abusive, or unauthorized purposes.

4. Permissions and Functionality

The App requires the following permissions to operate properly:

• Camera: Used for real-time face detection to count push-ups. No images or videos are recorded or stored.

• Internet Access: Used for Google Sign-In and data synchronization with Firebase.

• Notifications: Used to send local reminders and alerts related to workouts or rest phases.

5. Accuracy of Push-Up Counting

While the App uses advanced machine learning and camera-based detection algorithms, it may not always measure movements or counts with complete accuracy.
We do not guarantee that the push-up detection, counting, or analysis will be error-free or suitable for any professional or health-related purpose.

6. Health and Safety Disclaimer

The App is intended solely for fitness tracking and motivational purposes.
It does not provide medical advice, diagnosis, or treatment.
Always consult a qualified healthcare professional before starting any new exercise or fitness routine, especially if you have a medical condition or injury.

By using this App, you acknowledge and agree that:

• You perform exercises and physical activities at your own risk.

• We are not liable for any injury, health problem, or damage resulting from your use of the App or participation in physical activities tracked by it.

7. Data Collection and Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
By using the App, you consent to our data handling practices as described in that policy.

8. Intellectual Property Rights

All intellectual property rights in the App, including design, logo, source code, and related materials, are owned by Subhajit Rajak.
You are granted a limited, non-exclusive, non-transferable, and revocable license to use the App solely for personal and non-commercial purposes.

You must not:

• Copy, modify, reverse-engineer, or redistribute any part of the App.

• Use the App’s content or algorithms for commercial or unauthorized purposes.

9. Prohibited Conduct

You agree not to:

• Use the App in any unlawful or harmful manner.

• Attempt to disrupt, hack, or gain unauthorized access to the App or its systems.

• Use the App to collect or store data about others without consent.

• Misuse or interfere with the functioning of the App or Firebase services.

10. Termination

We reserve the right to suspend or permanently terminate your access to the App at our discretion, without notice, if you:

• Violate these Terms;

• Engage in fraudulent or harmful activity; or

• Misuse the App’s features or data.

Upon termination, all rights granted to you under these Terms shall cease immediately.

11. Limitation of Liability

To the fullest extent permitted by law:

• We are not responsible for any direct, indirect, incidental, or consequential damages resulting from your use or inability to use the App.

• We do not warrant uninterrupted or error-free operation, nor the accuracy or reliability of any data or output generated by the App.

You use the App at your own risk.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of India.
Any disputes shall be subject to the exclusive jurisdiction of the courts located in Kolkata, West Bengal, India.

Users outside India are responsible for ensuring compliance with their local laws.

13. Modifications to the Terms

We may update or revise these Terms at any time without prior notice.
Any changes will take effect immediately upon publication within the App or on our official website.
By continuing to use the App, you agree to be bound by the updated Terms.
