1. About This Privacy Policy

DEMROS WEST LLC ("we," "our," or "us") operates the DriveUSA mobile application (the "App"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information. By using DriveUSA, you agree to the collection and use of information in accordance with this policy.

2. Information We Collect

2.1 Personal Information

• Account Information: Name, email address, and encrypted password.

• Profile Preferences: Selected state for DMV content, language preference.

• Subscription Data: We collect your subscription status and purchase history. Note: We do not collect or store your full credit card numbers or bank details; these are handled exclusively by Apple or Google.

2.2 Usage & Technical Data

• Learning Progress: Quiz scores, practice results, and saved questions.

• Analytics: Firebase Installation IDs, screen views, and session duration.

• Crash Diagnostics: If the App crashes or hits an unexpected error, we collect a

diagnostic report through Firebase Crashlytics. It contains the error and the

sequence of code that produced it, your device model and operating system

version, the App version, and whether the device was jailbroken or rooted. The

report also carries your account identifier, your selected state, your

language, and whether your subscription or trial was active at the time, so

that we can reproduce the fault and, if you contact support, find the report

for your account. These reports are used only to find and fix faults. They do

not include your name, your email address, your quiz answers, your progress,

your payment details, or the contents of any screen.

• Device & Technical Data: IP address, device model, operating system version,

and app version.

Trial Device Identifier (hashed): To make sure the free trial can only be

claimed once per device, we store a one-way hash of an identifier generated by

the App on your device. It is not your device's serial number and not an

advertising identifier, it cannot be reversed to identify your device, and it

is used for nothing except preventing repeated trials.

2.3 Information We Do NOT Collect

• We do not access your GPS or location, camera, photos, microphone, contacts,

phone numbers, SMS or call logs, or health and biometric data.

• We do not collect payment card numbers, bank details or billing addresses —

Apple and Google process all payments and act as the merchant of record.

• We do not collect advertising identifiers (IDFA or AAID), and we do not track

you across other apps or websites.

3. How We Use Your Information

We use your data to:

• Provide personalized DMV theory and track progress.

• Manage subscriptions and prevent fraudulent access.

• Improve App performance via Firebase Analytics.

• Legal Compliance: To comply with law enforcement and protect our legal rights.

4. Third-Party Sharing & Services

We share data with the following service providers to operate the App:

• Google Firebase: For authentication, database hosting, and crash reporting. Data may be processed in the U.S. or other countries where Google maintains facilities.

• Payment Processors: Apple App Store and Google Play Store.

• Legal Requirements: We may disclose data if required by law or to enforce our Terms of Service.

We do NOT sell your personal data to third parties or data brokers.

5. Data Security, Retention, and Storage

• Security: We use HTTPS/TLS encryption and Firebase secure authentication.

• Retention: Account data is kept while active. Analytics are kept for up to 2 years. If you delete your account, data is purged within 30 days.

• International Transfer: If you access the App from outside the U.S., your data will be transferred to and processed in the United States.

  1. • 5.1 How to Delete Your Account and Your Data

     • You can delete your account yourself, at any time, from inside the App:

     • Profile → Edit profile → Delete Account → confirm

     • For your security you may be asked to sign in again first. Deletion is immediate and cannot be undone.

     • If you cannot open the App, email driveusaservice@driveusallc.com from the address on your account and we will delete it for you within 30 days.

     • What is deleted: your sign-in credentials, your profile, your selected state and language, your saved questions, your exam and practice progress and history, your sign-in sessions, and any problem reports you sent us.

     • What is kept, and why: records of subscription purchases and billing events are retained for tax and accounting purposes as the law requires, with your user ID, email address and device identifier stripped out so that the record can no longer be connected to you. The one-way trial device hash described in section 2.2 is also kept, de-linked from your account, so that deleting an account cannot be used to claim the free trial again. It cannot be reversed to identify you or your device.

     • Important: deleting your account does NOT cancel an active App Store or Google Play subscription. Only Apple or Google can cancel it. Cancel it in your device's subscription settings, or you will continue to be charged.

6. U.S. State Privacy Rights (CCPA/CPRA, VCDPA, etc.)

Residents of California, Virginia, Colorado, Connecticut, and other states with active privacy laws have specific rights:

• Right to Know/Access: Request a report of what data we have collected.

• Right to Delete: Request permanent removal of your data.

• Right to Correct: Update inaccurate personal information.

• Right to Opt-Out: We do not "sell" or "share" data for cross-contextual behavioral advertising as defined by the CCPA.

• Notice at Collection: We collect Identifiers and Usage Data primarily for account functionality and app improvement.

7. Subscription Transparency & Refunds

• Billing: Subscriptions automatically renew unless canceled through your Apple ID or Google Play settings.

• Refunds: All financial transactions are managed by Apple/Google. We cannot directly issue refunds for App Store or Play Store purchases.

8. Dispute Resolution & Governing Law

To the extent permitted by law, any dispute arising from this Privacy Policy shall be governed by the laws of the State of Illinois. * Arbitration: You agree that any dispute will be resolved through individual binding arbitration, rather than in court.

• Class Action Waiver: You waive the right to participate in a class-action lawsuit or class-wide arbitration against DEMROS WEST LLC.

9. Children’s Privacy (COPPA)

DriveUSA is intended for users seeking a driver’s license (typically ages 15+). We do not knowingly collect data from children under 13. If we discover such data, it will be deleted immediately.

10. "Do Not Track" (DNT) Signals

Our App does not currently respond to "Do Not Track" (DNT) signals as there is no uniform industry standard.

11. Changes to This Policy

Significant changes will be notified via in-app alert or email. Your continued use of the App after an update constitutes acceptance of the new terms.
