Terms of Use for DriveUSA

Welcome to DriveUSA. These Terms of Use ("Terms") constitute a legally binding agreement between you and DEMROS WEST LLC ("Company," "we," "us," or "our") concerning your access to and use of the DriveUSA mobile application (the "App").

PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN A MANDATORY ARBITRATION PROVISION AND A CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS.

1. Acceptance of Terms

By downloading, installing, or using DriveUSA, you agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease use of the App and uninstall it from your device.

2. Educational Purpose & Disclaimer

• Not an Official Authority: DriveUSA is an educational and practice tool. We are not affiliated with, endorsed by, or partnered with any Department of Motor Vehicles (DMV), Department of Public Safety (DPS), or any other government agency.

• No Guarantee of Results: While our goal is to help you pass, we do not guarantee that you will pass your DMV knowledge test or any other examination. The App is provided "as-is" and "as-available."

• Content Accuracy: DMV laws vary by state and change frequently. While we strive for accuracy, we do not warrant that the information in the App is always current, complete, or error-free.

3. Accounts and Eligibility

You must be at least 13 years of age to use this App. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating an account.

4. Subscriptions, Billing, and Refunds

• Free Trial: DriveUSA may offer a 3-day free trial. If you do not cancel at least 24 hours before the trial ends, you will be automatically charged the monthly subscription fee.

• Subscription Fee: The current subscription is $9.99/month (subject to change with notice).

• Auto-Renewal: Subscriptions automatically renew unless canceled through your Apple App Store or Google Play Store account settings.

• No Refunds: Payments are non-refundable. If you cancel, you will retain access to premium features until the end of your current billing cycle. Note: All financial transactions are managed by Apple or Google; we cannot process refunds directly.

5. Intellectual Property Rights

The App, including all practice questions, theory modules, design, text, and logos, is the exclusive property of DEMROS WEST LLC. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial educational purposes only. You may not scrape, copy, modify, or redistribute our content.

6. Indemnification (Your Protection)

You agree to defend, indemnify, and hold harmless DEMROS WEST LLC, its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

1. Your use of and access to the App;

2. Your violation of any term of these Terms;

3. Your violation of any third-party right, including without limitation any copyright, property, or privacy right.

7. Limitation of Liability

To the maximum extent permitted by applicable law, DEMROS WEST LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; or (ii) any exam failure or legal consequences resulting from your reliance on App content.

8. Governing Law & Dispute Resolution

• Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.

• Binding Arbitration: Any dispute arising out of or relating to these Terms shall be settled by binding arbitration in Cook County, Illinois.

• Class Action Waiver: YOU AND DEMROS WEST LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. You agree that, by entering into these terms, you and the Company are each waiving the right to a trial by jury or to participate in a class action.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of changes by updating the "Last Updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the new Terms.
