Any citizen who violates the law must appear before a judge in court to receive a sentence for their crime.
After being arrested, you will be thoroughly searched for any items that are prohibited such as weapons, phones, hacking devices, illegal substances, and any other items that may be considered illegal. If any such items are found, they will be confiscated and placed into an evidence bag. These items will be held as evidence until you are released or have posted bail and will be returned to you at that time. However, if you are found to be carrying any weapons or illegal substances without a proper permit, they will not be returned to you and can be used as evidence in court. It is important to note that the possession of illegal items is against the law and can result in serious consequences. You will likely appear before a judge within 24 hours (this may vary depending on if a judge is available) for your "first appearance." During this hearing, the judge will inquire if you can afford an attorney or if you would like a public defender. If you have not been able to retain an attorney by phone, it is important to inform the judge of this during your first appearance.
Bail guarantees that a defendant will appear at their court hearings. To post bail, a defendant is required to pay a set amount of money to the court. The court holds this money until the hearing. If the defendant fails to attend the court hearing, they will lose the money and may be sent back to jail. Also understand, if a defendant fails to appear in response to a summons, the court has the authority to issue a warrant. If requested by an attorney for the government, the court must issue the warrant or the summons to an officer or person authorized to execute or serve it.
If a citizen is found guilty of committing a crime in DaRealCityRp, they will be sentenced to prison. The sentencing system is based on realistic principles. If a player is found guilty of all charges against them, then the judge will sentence them to a specific number of years in prison. For instance, if a player is sentenced to 30 years in prison, they will spend 30 real-life days in prison. In DaRealCityRp, each year is equivalent to one real-life day. Therefore, if a player is sentenced to 20 years in prison, they will serve 20 real-life days in prison.
Pre-Arrest Investigations – Probable Cause
It's important to understand, that an officer must establish probable cause that a suspect has committed a crime to make an arrest. They can gather evidence against you without an arrest, hoping to enlist you as a witness against yourself and get a “voluntary statement.”
It is imperative that any type of investigation, be it for murder or narcotics, be conducted by a qualified Detective. If a suspect is apprehended, they will be brought before a judge to face trial, where they will receive a sentence if found guilty. The same protocol explained above will be followed for all cases to ensure fairness and justice.
