Dilraah Terms of Use

Welcome to Dilraah ("the App"), your soulful guide to personal growth and self-discovery. These Terms of Use ("Terms") govern your use of the App, provided by Soulful Growth Solutions ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the App.

Acceptance of Terms

By accessing or using the App, you confirm that you are at least 13 years of age (or the minimum age required in your jurisdiction) and have the legal capacity to enter into these Terms. If using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Description of the App

Dilraah is a wellness tool designed to provide personalized emotional support, drawing inspiration from South Asian wisdom and principles of positive well-being. The App offers features such as a personal mood journal, and custom self-help guides on topics like mindfulness, confidence-building, and relationships, with culturally sensitive support.

Crucially, the App is not a substitute for professional medical or psychological advice, diagnosis, or treatment. You are solely responsible for consulting qualified professionals for any medical or mental health concerns.

License to Use the App

We grant you a non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms. You may not:

• Modify, reverse-engineer, decompile, or disassemble the App.

• Distribute, sell, sublicense, or otherwise transfer the App to third parties.

• Use the App for any unlawful purpose or in violation of these Terms.

In-App Subscriptions

Dilraah offers optional in-app subscriptions for access to premium features, such as advanced self-help guides, personalized affirmations, and enhanced mood journal features. Subscriptions are managed and processed through the App Store (Apple or Google Play) and are subject to their respective terms and conditions, including payment and refund policies. We do not have access to your payment information or control over subscription billing.

• Subscription Terms: Subscriptions are offered on a recurring basis, including monthly and yearly options.

• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless canceled.

• Cancellation: You may cancel your subscription at any time via your App Store account settings.

• Price Changes: We reserve the right to modify subscription fees, with notice provided via the App Store.

• Free Trials: Free trials automatically convert to a paid subscription unless canceled before the trial period ends.

User Conduct

You agree to use the App in compliance with all applicable laws and regulations. You may not:

• Use the App to transmit or process illegal, harmful, or infringing content.

• Attempt to gain unauthorized access to the App or its systems.

• Interfere with or disrupt the App’s functionality.

Intellectual Property

All content, features, and functionality of the App, including text, algorithms, affirmations, and guide designs, are owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that:

• The App will be error-free, secure, or uninterrupted.

• The information, guides, or recommendations provided by the App are accurate, complete, or suitable for your specific needs. You use the App at your own risk and are responsible for consulting professionals for medical or psychological advice.

Limitation of Liability

To the maximum extent permitted by law, we and our affiliates, officers, directors, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including loss of data, emotional distress, or financial losses. Our total liability for any claim related to the App will not exceed the amount you paid (if any) for your subscription in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold us harmless from any claims, losses, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the App, violation of these Terms, or infringement of third-party rights.

Termination

We may terminate or suspend your access to the App at any time, with or without notice, for any reason, including violation of these Terms.

Changes to These Terms

We may update these Terms to reflect changes in the App’s features, legal requirements, or business practices. Updates will be posted within the App or on our App Store listing with an updated "Effective Date." Your continued use of the App after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes will be subject to the exclusive jurisdiction of state and federal courts in San Francisco, California.

Miscellaneous

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the App.

• Severability: If any provision of these Terms is invalid or unenforceable, the remaining provisions remain in effect.

• No Waiver: Our failure to enforce any right or provision does not constitute a waiver of such right or provision.
