Welcome to Diabetes App. These Terms of Service ("Terms") govern your access to and use of the Diabetes App mobile application ("App"), services, and related content (collectively, the "Services"). Please read these Terms carefully before using our Services.
By installing, accessing, or using the Diabetes App App and Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not install, access, or use our Services.
By creating an account or using the Services, you affirm that you are at least 13 years of age and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms. If you are under 18 years of age, you represent that your legal guardian has reviewed and agreed to these Terms.
cbmobile reserves the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
Diabetes App is a personal health tracking application designed to assist people living with diabetes. The App provides the following features:
Manual blood glucose logging and tracking
Nutrition calendar for recording meals and dietary intake
Medication calendar for tracking medication schedules and dosages
Data visualization and historical tracking of health metrics
MEDICAL DISCLAIMER: Diabetes App is a personal tracking tool only. It is NOT a medical device and does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for any health-related decisions.
3.1 Account Registration. To use the App, you must sign in using Google Sign-In ("Sign in with Google"), implemented via Firebase Authentication. You are responsible for maintaining the confidentiality of your Google account credentials and for all activities that occur under your account. You agree to immediately notify cbmobile of any unauthorized use of your account or any other breach of security.
3.2 Account Termination. cbmobile reserves the right to suspend or terminate your account at any time, with or without notice, for any reason, including if we believe you have violated these Terms.
You agree not to use the Services to:
a) Violate any applicable laws or regulations
b) Infringe upon or violate the intellectual property rights of others or cbmobile
c) Impersonate any person or entity or falsely state your affiliation with a person or entity
d) Interfere with or disrupt the Services or servers or networks connected to the Services
e) Attempt to gain unauthorized access to any portion of the Services or any other systems or networks
f) Reverse engineer, decompile, or disassemble the App or any part of the Services
g) Use any robot, spider, scraper, or other automated means to access the Services
h) Upload or transmit viruses or any other type of malicious code
i) Collect or harvest any personally identifiable information from the Services
j) Use the Services for any commercial purpose without our express written consent
k) Attempt to circumvent any subscription or payment mechanism
5.1 cbmobile Content. All content, features, and functionality of the Services — including but not limited to text, graphics, logos, images, data compilations, and software — are the exclusive property of cbmobile or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
5.2 Limited License. Subject to your compliance with these Terms, cbmobile grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal, non-commercial use.
5.3 User Content. You retain ownership of any health data and content you enter into the App ("User Content"). By submitting User Content, you grant cbmobile a limited license to store and process your User Content solely for the purpose of providing the Services to you.
The App is free to download. Access to premium features requires an active paid subscription. The following subscription plans are available:
Monthly Subscription — billed monthly, with a 3-day free trial for new subscribers
Annual Subscription — billed annually, with a 3-day free trial for new subscribers
Free Trial: Both plans include a 3-day free trial for new subscribers. You will not be charged during the trial period. If you do not cancel before the trial ends, your paid subscription will begin automatically.
Billing: All payments are processed by the Apple App Store or Google Play Store. We do not collect or store payment card details. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
Refunds: Refund requests are handled in accordance with the Apple App Store or Google Play Store refund policies. Please contact the respective platform's support for refund inquiries.
The Services use third-party services including Google Sign-In, Firebase, and the Apple App Store / Google Play Store for distribution and payments. cbmobile has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that cbmobile shall not be responsible or liable for any damage or loss caused by your use of any third-party content, goods, or services.
Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection and use of your information.
9.1 EEA Users (GDPR). If you are located in the European Economic Area, you have the right to access, correct, delete, and port your personal data, as well as the right to object to processing. To exercise these rights, please contact us via email. We will respond within 30 days.
9.2 California Users (CCPA). If you are a California resident, you have the right to know what personal information we collect, to delete it, and to opt-out of its sale. We do not sell personal information. To exercise your CCPA rights, please contact us via email. We will respond within 45 days.
10.1 "As Is" Basis. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
10.2 No Medical Warranty. CBMOBILE DOES NOT WARRANT THAT ANY HEALTH DATA, INSIGHTS, OR SUMMARIES PROVIDED THROUGH THE APP ARE ACCURATE, COMPLETE, OR SUITABLE FOR MEDICAL DECISION-MAKING. THE APP IS A TRACKING TOOL ONLY AND IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CBMOBILE, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
a) Your access to or use of or inability to access or use the Services
b) Any conduct or content of any third party on the Services
c) Unauthorized access, use, or alteration of your transmissions or content
d) Any health decisions made based on data or insights provided by the App
You agree to defend, indemnify, and hold harmless cbmobile, its affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
a) Your use of the Services
b) Your violation of these Terms
c) Your violation of any third-party right, including any intellectual property right or privacy right
d) Any User Content you submit, post, or transmit through the Services
13.1 Informal Resolution. If you have any dispute with cbmobile, you agree to first contact us and attempt to resolve the dispute informally via email.
13.2 Binding Arbitration. If we cannot resolve the dispute informally, any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules applicable in your jurisdiction. The arbitration will be conducted in the English language.
13.3 Class Action Waiver. You agree that any arbitration or proceeding shall be limited to the dispute between you and cbmobile individually. You agree to waive any right to have any dispute resolved as a class action or representative action.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which cbmobile operates, without regard to its conflict of law provisions.
For users in the EEA: Nothing in these Terms affects your rights as a consumer under applicable EU law, including your right to bring claims before a court in your country of residence.
15.1 Termination by You. You may terminate your account at any time by discontinuing use of the Services and deleting your account through the App settings.
15.2 Termination by cbmobile. cbmobile may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.
15.3 Effect of Termination. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent permitted by law.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and cbmobile regarding the use of the Services and supersede any prior agreements between you and cbmobile relating to your use of the Services.
