Terms of Service for Deshi Classified Mobile App

Welcome to Deshi Classified Mobile App ("we," "us," or "our"). These Terms of Service ("Terms") govern

your access to and use of our mobile application (the "App") and any related services provided by us. By

downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to

these Terms, please do not use the App.

1. Acceptance of Terms

By accessing or using the App, you agree to comply with and be bound by these Terms, our Privacy

Policy, and any other policies or guidelines we may establish. If you do not agree to these Terms, you

must immediately discontinue use of the App.

2. Eligibility

To use the App, you must be at least 18 years old or the age of majority in your jurisdiction, whichever is

greater. By using the App, you represent and warrant that you meet this eligibility requirement. If you

are under 18 or the age of majority in your jurisdiction, you may only use the App under the supervision

of a parent or legal guardian who agrees to be bound by these Terms.

3. Account Registration

3.1 Creating an Account

To access certain features of the App, you may be required to create an account. You agree to:

- Provide accurate, current, and complete information during the registration process.

- Maintain and promptly update your account information to keep it accurate, current, and complete.

- Keep your account credentials confidential and secure.

- Be responsible for all activities that occur under your account.

3.2 Account Security

You are responsible for safeguarding your password and any other credentials used to access your

account. You agree not to disclose your password to any third party and to notify us immediately if you

suspect any unauthorized use of your account. We are not liable for any loss or damage arising from

your failure to maintain the security of your account.

4. Use of the App

4.1 License

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use

the App for your personal, non-commercial use, subject to these Terms. All rights not expressly granted

to you are reserved by us.

4.2 Prohibited Activities

When using the App, you agree not to:

**Use the App for any illegal or unauthorized purpose.

**Post, share, or distribute content that is unlawful, offensive, defamatory, or infringes on intellectual

property rights.

- **Violate Any Laws:** Use the App in a manner that violates any applicable laws, regulations, or third-

party rights.

- **Engage in data mining, scraping, or other similar practices.

- **Infringe Intellectual Property:** Post, upload, or share content that infringes the intellectual

property rights of others.

- **Engage in Fraud:** Use the App to engage in any fraudulent, deceptive, or misleading activities.

- **Distribute Harmful Content:** Upload, transmit, or distribute viruses, malware, or other harmful

software.

- **Harass or Harm Others:** Engage in any behavior that is abusive, threatening, defamatory, or

harmful to others.

- **Misrepresent Yourself:** Impersonate any person or entity or misrepresent your affiliation with any

person or entity.

- **Interfere with the App:** Attempt to interfere with the operation of the App, including by disrupting

the network, overloading the servers, or accessing the App through unauthorized means.

- **Collect Personal Data:** Collect or harvest any personal information of other users without their

consent.

4.3 User-Generated Content

You may have the opportunity to post, upload, or otherwise make available content through the App

("User-Generated Content"). By submitting User-Generated Content, you grant us a non-exclusive,

worldwide, royalty-free, sub-licensable, and transferable license to use, reproduce, distribute, prepare

derivative works of, display, and perform your User-Generated Content in connection with the App and

our business, including for promoting and redistributing part or all of the App.

You represent and warrant that:

- You own or have the necessary licenses, rights, consents, and permissions to submit your User-

Generated Content.

- Your User-Generated Content does not violate any laws, infringe the rights of any third party, or

contain any material that is harmful, defamatory, obscene, or otherwise objectionable.

You represent that you own or have the necessary rights to share the content and that it does not

violate any laws or third-party rights.

We reserve the right, but are not obligated, to monitor, review, or remove any User-Generated Content

at our sole discretion.

5. Transactions and Payments

5.1 Transactions

The App may allow you to engage in transactions with other users, including the buying and selling of

goods or services. You acknowledge and agree that:

- **Responsibility:** You are solely responsible for all aspects of any transaction you enter into with

another user, including payment, delivery, and disputes.

- **No Guarantees:** We do not guarantee the quality, safety, legality, or accuracy of any goods or

services offered by users, nor do we guarantee the completion of any transaction.

- **Disputes:** You agree to resolve any disputes arising from a transaction directly with the other user.

We are not responsible for mediating or resolving disputes.

5.2 Fees

We may charge fees for certain features or services within the App. Any applicable fees will be disclosed

to you before you complete a transaction. By proceeding with the transaction, you agree to pay the fees

as described. All fees are non-refundable unless otherwise stated.

We reserve the right to modify fee and prices at any time. Price changes will be communicated to you

and will not affect past purchases.

Payments made through the App may be processed by third-party payment processors. You agree to

provide accurate and complete payment information and authorize us to charge your payment method

for any transactions you initiate within the App. We are not responsible for any errors or issues related

to payment processing by third-party providers.

6. Intellectual Property

6.1 Ownership

The App, including all content, features, and functionality, is the property of Deshi Classified Mobile App

and is protected by copyright, trademark, patent, trade secret, and other intellectual property or

proprietary rights laws. You agree not to copy, modify, distribute, create derivative works of, publicly

display, publicly perform, republish, download, store, or transmit any of the material on our App, except

as expressly permitted by these Terms.

6.2 Trademarks

All trademarks, logos, service marks, and trade names displayed on the App are our property or the

property of third parties. You may not use these marks without our prior written permission or the

permission of the third party that owns the marks.

7. Termination

7.1 Termination by You

You may terminate your account at any time by contacting us or through the account settings in the

App. Upon termination, you must cease all use of the App and delete any copies of the App from your

devices.

7.2 Termination by Us

We reserve the right to suspend or terminate your account or access to the App at our sole discretion,

without notice, if we believe you have violated these Terms, engaged in fraudulent or illegal activities, or

if we cease to offer the App. Upon termination, your right to use the App will immediately cease.

7.3 Effect of Termination

Upon termination of your account, your access to User-Generated Content and any data associated with

your account may be permanently deleted. We are not liable for any loss of data resulting from account

termination.

8. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis, without warranties of any kind, either express

or implied, including, but not limited to, the implied warranties of merchantability, fitness for a

particular purpose, title, and non-infringement. We do not warrant that:

- The App will meet your requirements or expectations.

- The App will be uninterrupted, timely, secure, or error-free.

- Any information or content obtained through the App will be accurate, complete, or reliable.

- Any defects or errors in the App will be corrected.

9. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Deshi Classified Mobile App, its

affiliates, licensors, service providers, employees, agents, officers, or directors be liable for any indirect,

incidental, special, consequential, or punitive damages, including, but not limited to, loss of profits, data,

use, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to

use the App, whether based on warranty, contract, tort (including negligence), or any other legal theory,

even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising out of or relating to these Terms or your use of the App

shall not exceed the amount you paid us, if any, for access to or use of the App during the twelve (12)

months preceding the date of the claim.

10. License and App Use

We grant you a limited, non-transferable, non-exclusive, and revocable license to use the App in

accordance with these Terms.

a. Restrictions

You may not:

 Modify, reverse-engineer, or attempt to extract the source code of the App.

 Reproduce, distribute, or create derivative works based on the App.

 Rent, lease, or sell access to the App or its services.

b. Availability

We do not guarantee the availability or uninterrupted functionality of the App. The App may experience

occasional downtime due to maintenance, updates, or technical issues.

11. Privacy and Data Collection

By using the App, you acknowledge and agree to our Privacy Policy, which explains how we collect, use,

and protect your personal and payment information.

a. Data Collection

We collect and use personal information as outlined in our Privacy Policy. This includes information you

provide when creating an account, making purchases, and using features of the App.

b. Cookies and Tracking Technologies

We may use cookies and other tracking technologies to collect information about your usage of the App

to improve its functionality and user experience.

c. Third-Party Services

The App may integrate with third-party services (e.g., payment processors, analytics providers). We are

not responsible for the privacy practices or content of these third-party services.

12. Disclaimers

The App is provided on an “as is” and “as available” basis, without warranties of any kind, either express

or implied. To the fullest extent permissible under applicable law, we disclaim all warranties, including

but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-

infringement.

a. Accuracy of Information

We do not guarantee the accuracy or completeness of any content or information provided through the

App. Use of any information or services from the App is at your own risk.

b. Third-Party Content

The App may display content from third parties. We are not responsible for the accuracy or reliability of

such content and do not endorse any third-party opinions or services.

13. Indemnification

You agree to indemnify, defend, and hold harmless Classified Mobile App and its affiliates, officers,

directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including

reasonable attorneys' fees) arising from:

 Your use of the App

 Your violation of these Terms

 Your violation of any third-party rights or applicable laws

14. Modifications to the App and Terms

We may modify or discontinue any part of the App at any time, without notice. We may also revise

these Terms from time to time, and your continued use of the App after any such changes constitutes

your acceptance of the new Terms.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of [Insert Jurisdiction],

without regard to its conflict of law principles.

a. Dispute Resolution

Any disputes arising from or relating to these Terms or the App shall be resolved through binding

Any failure by us to enforce any right or provision of these Terms shall not constitute a waiver of such

right or provision.
