Introduction
Capital Age Players and Diaper Lovers (“CAPDL”) works to create a welcoming and affirming atmosphere for common interests within the ageplay and kink communities. We celebrate the diversity of the ageplay community inclusive of race, religion, gender identity, sexual orientation, kink lifestyle, or kink roles.
Your acceptance and agreement to the documents shown on the following pages is required for your participation in CAPDL’s 2025 Hotel Invasion:

By signing these documents and attending CAPDL’s 2025 Hotel Invasion, you agree to these terms and conditions, and you agree that any violation of these agreements may result in expulsion from CAPDL’s 2025 Hotel Invasion without refund or compensation at CAPDL staff’s complete discretion.
CAPDL 2025 HOTEL INVASION BADGE & RULE AGREEMENT
Capital Age Players and Diaper Lovers (“CAPDL”) is hosting the 2025 Hotel Invasion (“Invasion”) from August 8-10, 2025. This Badge and Rule Agreement (“Agreement”) enables CAPDL to host safe and enjoyable events. Your agreement with these rules is required for your attendance at this event.
If you have any questions or concerns about attendee conduct during the Invasion, please locate and inform a CAPDL staff member immediately. CAPDL staff can be identified through their staff badges.
By signing this Agreement and attending the Invasion, you agree to these terms and conditions, and you agree that any violation of the terms and rules below may result in expulsion from the Invasion without refund or compensation at CAPDL staff’s complete discretion. Your attendance is conditioned upon your acceptance of and compliance with this Agreement.
You must follow instructions from Invasion staff, Invasion volunteers, security staff, and host hotel staff (collectively, “CAPDL staff” or “staff”). If you have an issue with a decision or instruction given to you, please first follow the instructions provided, and then find a staff member to escalate your concern.
You agree to the following:
GENERAL RULES
Individuals must be 18 years of age or older to purchase a badge to attend the Invasion. Your birthdate must be August 8, 2007 or earlier. Absolutely no admittance for individuals under 18 years of age.
During the process of online registration for the Invasion, you understand that you are required to electronically accept the entirety of this Agreement. Upon the successful approval of your badge registration, you understand and agree that your transaction, badge, and registration cannot be transferred and are subject to the refund policy outlined in this document.
You understand and agree that you have read this Agreement and the rules and terms herein and agree to it in its entirety. You understand that your participation in the Invasion is conditional upon your acceptance of and compliance with the terms of this Agreement.
You agree to continue to abide by this Agreement after the Invasion and understand that your failure to do so may result in you being unable to participate in future events. You also agree that your failure to follow and abide by this Agreement will result in action at staff’s discretion including but not limited to: revocation of your ticket without refund, expulsion from the Invasion without refund, a ban from future events, and communication of your failure to abide by these rules to other event organizers.
You understand that the rooms in the hotel block are managed by CAPDL. You understand that the only approved process for reserving rooms in the hotel will be through the designated link provided by CAPDL and that attempts to reserve rooms in other ways will result in cancellations. Any attempt to alter CAPDL’s ticketing system or system clock will result in your badge and/or host hotel room being cancelled and possibly being banned from future Invasions.
You understand and agree that CAPDL reserves the right to cancel host hotel reservations under unexpected or exceptional circumstances and that CAPDL will make reasonable efforts to refund your reservation under those conditions, but refunds are not guaranteed.
You agree to provide valid government-issued photo identification that includes your legal name and date of birth for verification during the badge registration process. You agree that you must provide this information before you complete hotel check-in or enter the Invasion space. You agree that you will provide the above identification upon request by CAPDL staff during the Invasion at any time to confirm identity and valid admission.
The Invasion space is defined as areas within the hotel that are restricted for the private use of Invasion attendees. This does not include hotel guest rooms, or common areas of the hotel open to the general public.
All COVID and public safety policies are subject to local, state, and federal mandates, and are subject to change as needed in response to evolving conditions. You understand and agree that the Invasion is a mask-optional event and will be respectful of an individual’s decision to wear a mask.
You agree to wear in a visible manner the Invasion badge, and any other designated items required by staff at all times while in the Invasion space and hotel floor block. You agree to immediately inform a staff member upon discovering the loss or misplacement of your badge and other designated items.
If you volunteer to help with the Invasion, you agree to show up for your designated shift and area. Failure to show up for your volunteer assignment may result in forfeiting some or all of your volunteer benefits and other adverse consequences at staff’s discretion.
PERSONAL CONDUCT
The Invasion is a harassment-free event, intended to be enjoyed without regard to age, race, gender, gender identity or expression, sexual orientation, disability, physical appearance, or religious beliefs. We do not tolerate harassment of any kind of Invasion attendees, volunteers, staff, or guests; harassment is considered a serious breach of this code of conduct. This policy applies equally to attendees, staff and volunteers, contractors, and agents of CAPDL. If someone requests to be left alone, respect their wishes. Additionally, you agree to leave other attendee(s) alone throughout the Invasion if instructed to do so by CAPDL staff. Individuals experiencing harassment should contact a member of CAPDL staff or CAPDL security team as soon as possible. CAPDL staff can always be reached by email at dcabdl621@gmail.com.
Wearing or displaying garments, costumes, or signage that are deemed by CAPDL to communicate hostile messaging or sentiment is not permitted at the Invasion. Individuals in violation of this policy will be required to remove such items and may be subject to removal from the event at CAPDL staff’s discretion.
You agree to dress casually (street clothes, vanilla clothes) whenever you are in public in the common areas of the hotel and outside. You agree to be mindful of other attendees' desire for anonymity both within and beyond the hotel, and to be thoughtful about issues of consent and disclosure about attendance in general.
You agree to conceal your badge and lanyard in public, in the common areas, and outside of the hotel. You agree not to display your badge in any photos that are posted to social media before or during the Invasion. It is acceptable after the Invasion ends for the photo to display your badge.
You agree to be mindful and respectful of discussions you engage in both within and beyond the hotel.
EXAMPLE: You should avoid discussing the Invasion at local establishments where you may be overheard, including and especially the nearby liquor stores, restaurants, bars, pharmacies, convenience stores, and anywhere else in public. You cannot wear onesies or other ABDL apparel in public in proximity to the hotel.
If you are going out, we ask that you please be thoughtful about your attire and the attention you may draw to yourself and others. If you have questions about appropriate attire, please ask a staff member.
EXAMPLE: You and a group of your friends wish to take a group photo inside your host hotel room during the convection in various attire to post on social media. The group photo is allowed from inside your personal host hotel room but must not have any individual displaying their CAPDL Hotel Invasion badge in the group photo for posting on social media during the Invasion.
You agree to either change in the designated changing areas or in a personal hotel room. A changing area is available within the Invasion space for any changing needs. You agree to not expose any nudity and/or genitalia inside of any Invasion space or common hotel area.
You agree to cover your nipples in all common hotel and Invasion space.
You agree to wear foot coverings of some sort (shoes, sandals, flip-flops, slippers, etc.) in any Invasion space or common hotel area.
You agree not to engage in sexual activities in any Invasion space or common hotel area.
You agree to be respectful of all CAPDL attendees and staff at all times.

You understand and agree that personal hotel rooms are NOT considered part of the Invasion space, and therefore the activities in those spaces are not provided by, under the direction of, or endorsed by CAPDL staff or volunteers acting in their capacities as CAPDL staff or volunteers. This includes after-parties or social gatherings of any kind. You agree to assume full responsibility and liability for your actions taken in personal hotel rooms.
You further understand and agree that your conduct in personal hotel rooms is subject to general expectations as outlined in this Agreement and that you may be subject to consequences for behavior deemed inappropriate for the Invasion by CAPDL staff.
You understand and agree that anytime you enter common areas from personal hotel rooms (i.e. hallways, balconies, lobbies, etc.) you are fully subject to CAPDL rules including visible display of your badge and other designated items.
You understand that all hotel rules and federal, state, and local laws are in effect in all areas of the hotel at all times.
You agree to be mindful and respectful of all hotel staff.
You understand and agree that all information regarding events, scenes, participants, and conversations (whether overheard or directly participated in) while attending this PRIVATE event must be held in strictest confidence. You agree that breaching this confidentiality will result in consequences at the discretion of CAPDL staff including but not limited to: expulsion from the event, restriction from attending future events, and civil or criminal liability.
You agree that you are not attending this event for the purposes of: information collection about any attendees, volunteers, staff, or organizers; information collection about the event itself; publication of information about any of the above. You further agree and understand that you are prohibited from disclosing any non-public details about the event. Breach of this provision will be pursued by CAPDL to the fullest extent of the law and may result in civil or criminal liability.
You agree that certain rooms within the hotel and/or Invasion space may have a set of rules specific to those spaces and that those rules may be more or less restrictive than the overall Invasion rules. You agree to read and abide by the rules provided by each Invasion room's leadership and agree to ask CAPDL staff or volunteers any questions if you’re unsure of what the expected rules of conduct are within the space.
You agree to be liable for monetary damages to CAPDL for any expenses incurred by CAPDL in relation to your conduct, including but not limited to damage to hotel rooms, waste or biological matter left in hotel rooms, cleaning expenses, unpaid bills, and any other fees or expenses billed to CAPDL and reasonably related to your activity at the Invasion. You further agree that you may face civil liability and other consequences including but not limited to a permanent ban from future events if you cause the Invasion to incur expenses or if the hotel or CAPDL deems you to have engaged in conduct that is damaging or improper with relation to your time spent in the hotel or at the Invasion. You agree to pay any requests for compensation in relation to expenses incurred by the Invasion in relation to your room and fees you cause to be accrued and that CAPDL may engage in legal or other civil remedies to obtain compensation from you if you refuse to pay these fees.
CONSENT GUIDELINES
“Consent” means a person’s willingness and ability to engage in a specific act. Consent is the creation of an agreement with all individuals saying “YES!” not just the absence of “No.”
Do not touch anyone without their permission, and do not base your consent on what you have seen someone do with other people.
All activities must receive prior explicit verbal or written consent rather than through gestures, body language, or past behavior.
Informed consent requires discussing the risks involved in the activity and steps needed to reduce those risks, including study, training, technique, and safety measures.
Do not renegotiate in the middle of your scene unless it is to reject activities that were previously agreed to. A person who is in an altered state of mind of any kind, including play-induced headspace, may not be able to give informed consent.
The universal safe words are “RED” and “SAFEWORD.” Everyone is free to withdraw consent at any time during the activity. At the use of either of those words, the activity must end immediately.
Do not attempt to participate in an ongoing scene unless invited explicitly by all current participants.
If you plan to engage in play that may have the appearance of being non-consensual, inform the others before the beginning of the scene.
Each person should understand everyone’s limitations or barriers to their ability to consent to the planned activities, such as age, mental capacity, or use of drugs or alcohol. If any participant in a scene appears intoxicated or impaired, the staff may stop the scene.
Do not pressure, force, coerce, or manipulate someone into consenting to anything.
Do not do anything likely to result in serious bodily injury or go beyond a participant’s expectations, even where the participant gave consent.

SECURITY & PRIVACY
You understand and agree that to ensure security and privacy at the event, it is reasonable and sufficient that the Invasion has the following guidelines:
Anyone not displaying their Invasion badge and/or other designated items will not be allowed to enter the Invasion space. Failure to display your badge puts you in violation of this Agreement. Anyone found inside the Invasion space without proper identification, will be asked to leave immediately.
You understand that local law enforcement will be called and given access to the hotel and all Invasion spaces to remove anyone who does not immediately comply with a request to leave the hotel.
You understand that it is forbidden to wear or provide identification belonging to another attendee, and doing so puts you in violation of this Agreement. Badges contain a scannable code that is unique to the attendee. CAPDL reserves the right to scan the code on the attendee’s badge at any time during the Invasion.
You understand that security staff will be posted at all unlocked entrances to the Invasion space. Only attendees with valid badges and/or other designated items will be admitted.
You understand that security staff will patrol the Invasion space, inside and outside, to ensure that everyone is a CAPDL attendee or hotel staff member.
You understand that CAPDL will take reasonable measures to protect the personal information you provide them. You agree that CAPDL may use your information according to its privacy policy and in the following ways:
- Email communications may be sent through third party email clients.
- Direct messages to attendees may be sent through third party social networking sites.
- Personal information you disclose to CAPDL or collected about you by CAPDL, and photos taken by designated Invasion photographers in designated photography areas, may be stored in or transmitted to third party service providers.
- Upon registration, attendees’ email address and name data may be used to subscribe attendees to CAPDL’s email marketing application, scheduling application, and applications that conduct the Invasion’s raffle, silent auction, or other charitable endeavors. Attendees may opt out of these services by unsubscribing through the methods provided by each service.
You understand and agree that the credit/debit card authorization for your badge and hotel purchase will have a note of “CAPDL” on your statement.
DIGITAL MEDIA CONTENT – PHOTOS, VIDEO, AUDIO & OTHER
You agree that photography, videography, audio, or any other form of digital media content recording of the Invasion or its attendees is strictly forbidden, unless explicitly authorized in writing by CAPDL staff, including but not limited to recordings by smart phones, iPads, smart watches, smart glasses, etc. At the discretion of CAPDL staff, select activities (Podcasts, etc.) may be recorded for future and/or external broadcast. Signs will be posted when live broadcasting or recording is in progress. Permission to record and/or variance of this policy may be made at the sole discretion of CAPDL staff.
You agree that you will not: (1) take photos, (2) record video, (3) record audio, and (4) record any media (analog/digital) content of any kind in the Invasion space.
You agree to declare any device with the capabilities mentioned above during registration, including but not limited to: phones, tablets, watches, glasses, and any other digital media content recording device.
You agree to have CAPDL staff apply or observe you apply at registration the required security seals over any devices which you have declared.
You understand and agree that all phone cases must be removed for application of the seal(s) to the phone camera(s). Any other device which contains a camera must also have a seal applied over the camera at check-in.
You agree to immediately apply a new seal to the camera if a seal is removed or broken. If you do not have extra seals, you agree to immediately notify CAPDL staff in the event of any device seal being voided or broken, without any use of the device in Invasion spaces until the seal is replaced.
You understand and agree that CAPDL staff have the right to review the media in your device and demand and confirm deletion of media or recordings that violate this Agreement.
You understand and agree that smart glasses, and similar devices, are not permitted in any Invasion spaces, hotel hallways, or other public areas. You further understand that exceptions will not be made for prescription lenses under any circumstances.
You understand that if you record or post any unauthorized media content, such content must be deleted from all devices and removed from any internet or cloud services immediately. You may be subject to review with possible expulsion and banning from the Invasion.
You understand that badge registration may use cameras or other optical scanning devices to properly register and electronically identify attendees by unique, scannable badge codes during the Invasion.
You understand that if you are interested in receiving photos of yourself from the Invasion, you must be wearing your badge and have a photo taken (for each costume, facial paint, etc.) with your badge number clearly showing at the beginning of each photo shoot. You understand that these photos in Invasion spaces may only be taken by designated photographers authorized by CAPDL and may not be taken without the permission and consent of CAPDL. These photos which display your badge must not be posted to social media during the Invasion.
You understand that there may be clearly designated areas of the Invasion space where photos of attendees will be allowed to be taken by designated Invasion photographers or photo booth operators. You further understand that by entering these areas, you agree that your photo may be taken.
SANITARY CONDUCT
You understand that defecation will NOT be tolerated in any Invasion space, during any official Invasion event, or in any public space in and around the hotel. You understand that exceptions are made for those with disabilities, and you will take care to be as discreet and
hygienic as possible. A $1,000 biohazard room fee will be assessed to any attendee’s account that leaves feces or other biological material in their host hotel room upon check-out.
You understand and agree that regardless of any exception you have to the above defecation rule, absolutely no defecated-in diapers are to be changed in the public changing room or to be disposed of in the public changing room using diaper / trash containers.
ALCOHOL & CONTROLLED SUBSTANCES
Possession or consumption of unlawful controlled substance(s) at CAPDL is strictly prohibited and will not be tolerated.
Alcoholic beverages are allowed in covered containers in designated areas. If an attendee is found with alcohol in a non-designated area, they may be expelled from the current event and banned from future ones.
You agree to follow Maryland law with regards to age limits on the consumption of alcohol and use of other controlled substances.
You agree to not possess or use controlled substances in any area of the hotel or Invasion space, except where permitted by law and Invasion rules.
You understand that smoking or vaping of any kind is not allowed anywhere within the hotel building or within 25 feet of the entrances.
HOST HOTEL & RESERVATIONS
CAPDL and the host hotel are different business entities. Policies and rules that the hotel has which are separate from those included in this Agreement are also in force.
You agree not to reveal details about the host hotel outside of what is necessary for your personal safety. Sharing of hotel information is strictly prohibited and may result in cancellation of your badge without refund.
Host hotel reservations are managed by CAPDL. You agree not to call the host hotel to inquire about room availability or reservations unless specifically directed by CAPDL staff. Hotel rewards programs will not be honored for CAPDL’s event. Hotel reservations made by other methods (e.g. third-party reservation sites such as Priceline, Trivago, Kayak, HotelsinAmerica, Perkspot, etc.) may be cancelled and not honored.
You agree to not share any room or ticket codes or links with anyone.
You understand and agree that reservations made by anyone who is not a CAPDL attendee with a confirmed badge (ticket) are subject to cancellation.
You understand and agree that you are financially responsible for your own hotel guest room and incidental charges (including damages to your hotel guest room).
FOOD & BEVERAGE
You agree that you will not bring food or beverages purchased outside of the hotel into the hotel restaurants or bar. Outside food and beverages are allowed in hotel rooms and in other public areas of the hotel.
You agree that you will not bring food purchased outside of the hotel into the Invasion space, with the exception of small snacks for personal consumption.
You agree that any beverage you consume outside of hotel guest rooms, restaurant, or bar social areas must be consumed in a covered, non-glass containers (thermos, sippy cup, etc.).
Refund Schedule
The Attendee’s badge is subject to the following refund schedule:

After May 8, 2025 No Refund or Badge Forwarding
*Attendees may forward the cost of their badge ($125) towards the purchase of a CAPDL 2026 badge (ticket) until May 8, 2025.
Example: A 2025 Hotel Invasion badge is forwarded to the 2026 Hotel Invasion. The cost of the 2025 Hotel Invasion badge ($125) is applied to the cost of a 2026 Hotel Invasion badge. If a 2026 Hotel Invasion badge cost would happen to be $150 (for example), the attendee would have to pay an additional $25 (for example) to obtain a 2026 Hotel Invasion badge.
Absolutely no refunds or badge forwarding after May 8, 2025. Refunds are issued to the credit card originally used for the purchase.
If you choose to forward your 2025 Hotel Invasion badge, you may request a full refund (less fees) only during the first 7 days of badge sales for the 2026 Hotel Invasion.
After the first 7 days of 2026 Hotel Invasion badge sales, there are absolutely no refunds for 2025 Hotel Invasion forwarded badges. Forwarded badges can only be forwarded once to the next Hotel Invasion. (Example: A 2025 Hotel Invasion forwarded badge can only be used for 2026 Hotel Invasion and not a future year of a Hotel Invasion.)
Volunteer badges offered at a reduced price cannot be forwarded to any future Hotel Invasion. Volunteers will need to re-apply at the next Hotel Invasion. Volunteers may receive a full badge refund when requested by May 8, 2025 (90 days prior to the start of the Invasion). Volunteer badges are not refundable after May 8, 2025 due to having to find a replacement to fill the assignment.
Badges are non-transferrable once purchased. CAPDL is not required to transfer any badge for any reason.
Impossibility
You agree that CAPDL shall not be liable for a failure of performance occurring due to Acts of God, war, terrorist acts, government regulation, riots, disasters, pandemics, or strikes, any one of which make performance impossible. CAPDL shall have no liability for power disruptions of any kind.
In the event that CAPDL cannot be held or is postponed due to events beyond the control of the Invasion, the Invasion shall not be liable to you for any damages, costs, or losses incurred, such as transportation costs, lodging costs, or financial losses.
In the event that the CAPDL Invasion is canceled for any reason, you will be offered to rollover (forward) your badge to the next CAPDL Hotel Invasion. For clarity, rollover is your only remedy. No refunds will be issued except according to the refund schedule above.
AGREEMENT & SIGNATURE
All decisions by CAPDL staff are final. No refunds or compensation will be given in the event that your attendance at the Hotel Invasion is terminated by either yourself, CAPDL staff, or the hotel.
You agree that you have read the rules thoroughly, understand them, and will adhere to them. You understand and agree that failure to do so may result in expulsion from the Hotel Invasion and exclusion from future events. You agree that this Agreement is a complete representation of the Agreement between yourself and CAPDL and that any oral or prior written promises or representations made to you regarding this Agreement or its terms are not binding upon CAPDL, its officers, agents, and/or employees.
YOU UNDERSTAND THAT THIS IS A LEGAL DOCUMENT. YOU HAVE READ AND UNDERSTOOD ALL ITS TERMS. YOU EXECUTE IT VOLUNTARILY AND WITH FULL KNOWLEDGE OF ITS MEANING AND SIGNIFICANCE.
The parties agree that this Agreement may be electronically signed. The parties agree that the electronic signature appearing on this agreement is the same as handwritten signatures for the purposes of validity, enforceability, and admissibility.
By purchasing a badge, you voluntarily agree to all terms and conditions within the CAPDL Badge and Rules Agreement by applying your electronic signature.
ATTENDEE WAIVER OF LIABILITY, INDEMNIFICATION, AND HOLD HARMLESS AGREEMENT (“WAIVER”)
Waiver of Liability
In consideration for receiving permission to attend the 2025 Hotel Invasion, I, on behalf of myself, my family members, my heirs, personal representatives, or assigns, do hereby agree to RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Capital Age Players and Diaper Lovers, its board members, officers, agents, volunteers, and employees (collectively, “CAPDL”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage (whether direct, indirect, incidental, consequential or otherwise), or injury, including death, that may be sustained by me, or to any property belonging to me, while attending such event, while in, on or upon the premises where the event is being held, regardless of whether such loss is caused by CAPDL’s acts or omissions with the sole exception of CAPDL’s willful misconduct. REGARDLESS OF WHETHER SUCH LOSS IS CAUSED BY CAPDL’S ACTS OR OMISSIONS WITH THE SOLE EXCEPTION OF CAPDL’S WILLFUL MISCONDUCT.
AND that, except in the event of CAPDL’s willful misconduct, I agree not to bring any claims, demands, actions and causes of action, and/or litigation, against CAPDL for any economic and noneconomic losses due to bodily injury, death, and/or property damage sustained by me in relation to the premises and operations of CAPDL.
In addition, I waive my rights under any applicable law or statute, which says, in substance: “a general release does not extend to claims which the releasing party does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the released party.”
I agree that this Waiver shall be binding upon myself, my successors in interest, and/or any person suing or otherwise bringing claims on my behalf.
Assumption of Inherent Risks
I am fully aware and understand there are inherent risks involved in community events such as the Invasion, which risks include, but are not limited to, publication of private facts, mental distress, bodily injury, physical harm and even death to attendees and staff from the Invasion which may occur in participation of such activities. I acknowledge that my attendance and the activities at the Invasion is contingent to some extent upon my actions or inactions. Further, I understand that “inherent risks involved in community events” shall mean those dangers or conditions which are an integral part of community activities, including, but not limited to:
risk of property damage, illness, bodily injury, disability, or death;
certain hazards such as surface and subsurface objects;
exposure to biological, environmental, and chemical hazards;
hazards related to activities and play spaces, repetitive movements, and exposure to outdoor weather conditions;
limited availability of emergency medical care; and
the potential of any attendee or staff to act in a negligent manner that may contribute to injury to myself or others.
I understand and agree that CAPDL does not require me to participate in this activity. I agree that all activities are VOLUNTARY and that I do not have to participate unless I choose to do so. I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by me, or any loss or damage to personal property owned by me, as a result of being engaged in such an activity WHETHER CAUSED BY THE ACTS OR OMISSIONS OF CAPDL or otherwise, to the fullest extent allowed by law.
I understand and agree that CAPDL does NOT guarantee any insurance coverage for your person or property. You acknowledge that you are responsible for your own safety and your own healthcare needs, and for the protection of your property.
Indemnification
I agree to indemnify, defend, and hold harmless Capital Age Players and Diaper Lovers, the Invasion’s hotel, and all respective board members, staff, volunteers, employees, officers, directors, and agents (collectively, “CAPDL”) against all claims, losses, and damages to persons or properties (whether direct, indirect, incidental, consequential or otherwise), liability, governmental charges or fines, and costs (including, without limitation, reasonable attorneys’ and accounting fees) resulting from any claim, demand, suit, proceeding (whether before an arbitrator, court, mediator or otherwise) or investigation made by any third party (each a “Claim”) relating to or arising out of: your breach of the CAPDL Badge and Rules Agreement (including any terms or agreements or policies incorporated into those terms or other policies we post or make available); your breach of any applicable local, state, national or other law, rule or regulation or the rights of any third party. This indemnification will not apply to the extent that the Claim arises out of the organizers’ gross negligence or willful misconduct.
CAPDL will attempt to provide notice to you of any such Claim, however, failure or delay by CAPDL in providing such notice will not limit your obligations hereunder except to the extent you are materially prejudiced by such failure.
Acknowledgements, Assertions, and Agreements
Emergency Care
I authorize and agree:
• For the administration of emergency first aid, CPR, and use an AED (defibrillator) as may be deemed necessary if you are injured or appear to require medical attention;
• For CAPDL to secure medical care or transportation (i.e., EMS) as may be deemed necessary; and
• To solely assume all costs related to such medical treatment and transportation and/or evacuation. I hereby release, forever discharge, and hold harmless CAPDL from any claim based on such treatment, medical services, and transportation.
Rules & Safety
I agree to abide by the rules and regulations established by CAPDL; and
I acknowledge that CAPDL is conducting all activities in good faith and may find it necessary to terminate my attendance if CAPDL determines that I fail to abide by the rules and regulations established by CAPDL or breach the Badge and Rule Agreement, or am deemed a safety risk to myself or others. I accept CAPDL’s right to take such actions for the safety of myself and other attendees.
Covenant not to Sue; Mediation; Venue; and Severability
I covenant not to sue CAPDL for any present or future claim arising directly or indirectly from my participation at CAPDL. This includes, but is not limited to, claims resulting from the inherent risks involved in community events and the acts or omissions of CAPDL.
This Waiver shall be construed and interpreted in accordance with the laws of the state of Maryland. Any action brought under this Waiver shall be brought within one (1) year of the act or occurrence giving rise to said claim in a court of competent jurisdiction in the state of Maryland. I further agree that prior to litigation, such incident or dispute shall first be mediated by a trained mediator knowledgeable in community disputes from a list acceptable to CAPDL. Costs of mediation shall be shared equally by the parties. In the event of litigation, the prevailing party shall be entitled to costs and fees associated with the litigation, including reasonable attorney fees and reimbursement of any mediation fees.
I also expressly agree that this Waiver is intended to be as broad and inclusive as permitted by the laws of the state of Maryland and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full force and effect.
IN SIGNING THIS WAIVER, I ACKNOWLEDGE AND REPRESENT THAT I fully understand its terms and conditions. I understand that I am giving up substantial rights, including my right to sue CAPDL for injuries resulting from the inherent risks involved in the Invasion or the acts or omissions of CAPDL. I further acknowledge that I am signing this agreement freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability, including that due to any act or omission by CAPDL (with the exception of CAPDL’s willful misconduct), to the greatest extent allowed by the laws of the state of Maryland.
