Terms of Service for Dash QR

These Terms of Service ("Terms") govern your access to and use of the Dash QR mobile application (the "App") provided by Dash QR ("Dash QR", "we", "us", or "our").

By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility and Acceptance

You may use the App only if you can form a binding agreement under applicable law and are not prohibited from using the App under applicable law.

If you use the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of the App

Dash QR provides tools to:

• scan QR codes and barcodes;

• create QR codes from user-provided content;

• save and manage local history and favorites;

• save generated QR images to your device;

• share generated content and exported history;

• open third-party links or destinations at your request.

Features may change, be limited, or be discontinued at any time.

3. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App for personal or internal lawful purposes on devices you own or control.

You may not:

• copy, modify, distribute, sell, lease, or sublicense the App except as permitted by law;

• reverse engineer, decompile, disassemble, or attempt to extract source code, except where applicable law permits it;

• interfere with or disrupt the App or related systems;

• use the App for unlawful, fraudulent, harmful, abusive, or infringing purposes;

• use the App to create, store, share, or distribute content that violates applicable law or third-party rights.

4. User Content and Responsibility

You are solely responsible for the information, text, URLs, contacts, payment details, Wi-Fi credentials, event details, and other content that you scan, create, save, share, export, or open using the App ("User Content").

You represent and warrant that:

• you have all rights and permissions necessary to use that User Content;

• your use of the App and User Content does not violate law, contract, privacy rights, publicity rights, intellectual property rights, or any other third-party rights;

• you will not use the App to create misleading, malicious, or deceptive QR codes.

We do not verify User Content and are not responsible for it.

5. Third-Party Links, Codes, and Services

The App may allow you to open websites, app links, payment pages, review pages, social profiles, or other third-party destinations encoded in QR codes or manually entered by you.

We do not control and are not responsible for:

• third-party websites, apps, or services;

• their availability, content, security, legality, or accuracy;

• transactions or interactions you choose to conduct with third parties.

Your use of third-party services is governed by their own terms and policies.

6. Privacy

Your use of the App is also subject to our Privacy Policy. Please review it carefully.

7. Permissions and Device Features

Certain features of the App require device permissions, such as camera or photo library access. If you deny required permissions, some App functions may not work properly.

You are responsible for your device, settings, backups, and any data stored locally on the device.

8. Advertising

The App may display advertisements and may use third-party advertising services. We are not responsible for the content, offers, claims, or availability of third-party advertisements.

Interactions with advertisers are solely between you and the advertiser unless otherwise stated.

9. Intellectual Property

The App, including its software, design, branding, text, graphics, logos, layout, and other materials provided by us, is owned by Dash QR or its licensors and is protected by applicable intellectual property laws.

Except for the limited license granted in these Terms, no rights are transferred to you.

10. App Stores

If you downloaded the App from the Apple App Store, Google Play, or another app marketplace, you acknowledge that:

• these Terms are between you and Dash QR, not with the app store provider;

• the app store provider is not responsible for the App or its content;

• your use of the App must comply with the applicable app store terms;

• the app store provider and its subsidiaries may be third-party beneficiaries of these Terms to the extent applicable.

11. Disclaimer of Warranties

To the maximum extent permitted by law, the App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise.

We disclaim, to the maximum extent permitted by law, all warranties including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and quiet enjoyment.

We do not guarantee that:

• the App will be uninterrupted, secure, or error-free;

• the App will always detect, decode, or generate every code correctly;

• scanned content or third-party destinations will be safe, accurate, or functional;

• defects will always be corrected.

12. Limitation of Liability

To the maximum extent permitted by law, Dash QR and its affiliates, licensors, service providers, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, profits, goodwill, revenue, or business opportunities, arising out of or related to your use of or inability to use the App.

To the maximum extent permitted by law, our total liability for all claims arising out of or related to the App or these Terms will not exceed the greater of:

• the amount you paid, if any, for the App in the twelve months before the claim arose; or

• USD $10.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless Dash QR and its affiliates, officers, directors, employees, contractors, and licensors from and against claims, liabilities, damages, losses, and expenses arising out of or related to:

• your use or misuse of the App;

• your User Content;

• your violation of these Terms;

• your violation of any law or third-party right.

14. Suspension and Termination

We may suspend or terminate your access to the App or some features at any time, with or without notice, if we believe you violated these Terms, created risk or liability, or if operation of the App is no longer commercially or technically feasible.

You may stop using the App at any time by uninstalling it.

Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, indemnity, and governing provisions.

15. Updates and Changes

We may modify the App or these Terms at any time. If we make material changes, we may update the effective date or provide additional notice where required by law.

Your continued use of the App after changes become effective means you accept the revised Terms.

16. Governing Law

These Terms are governed by the laws applicable in the jurisdiction where Dash QR operates, without regard to conflict of law rules, unless otherwise required by applicable consumer protection law.

If you are a consumer, you may also have rights under the mandatory laws of your country or state of residence.

17. Severability and Waiver

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms is not a waiver of that provision.

18. Entire Agreement

These Terms, together with the Privacy Policy, form the entire agreement between you and Dash QR regarding the App and supersede prior or contemporaneous understandings relating to the App.
