Darkonas Games Terms of Service

These Terms of Service (“Terms”) govern the download, installation, purchase, and use of mobile games published by MB Darkonas (“Darkonas,” “we,” “us,” or “our”) that link to these Terms.

Please read these Terms carefully.

1. Who may use our games

Our games are designed for children and families. Children may only use a Darkonas game with the knowledge and permission of a parent or legal guardian.

If you are not legally old enough to enter into a binding agreement, your parent or guardian must review and accept these Terms for you.

By downloading a game, making a purchase, or permitting a child to use a game, the responsible adult agrees to these Terms.

If you do not agree to these Terms, do not download, purchase, or use the game.

2. Licence to use the game

Subject to these Terms, Darkonas grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable licence to install and use the game for private, non-commercial entertainment.

You do not acquire ownership of the game, its source code, artwork, characters, music, levels, designs, or other content.

The licence is limited to devices and platform accounts that are permitted by the app store through which the game was obtained.

3. Acceptable use

You may use the game only for lawful personal entertainment.

You must not:

• Copy, sell, rent, sublicense, redistribute, or commercially exploit the game.

• Modify, reverse-engineer, decompile, or attempt to extract the game’s source code, except where applicable law expressly permits it.

• Circumvent purchase controls, security features, licence checks, or technical restrictions.

• Use cheats, automation, exploits, modified clients, or unauthorized tools that interfere with the intended operation of the game.

• Introduce malicious code or interfere with the game, app store, device, or related services.

• Use Darkonas intellectual property in a way that falsely suggests endorsement, affiliation, or ownership.

• Use the game for unlawful, harmful, fraudulent, or abusive purposes.

4. Parent and guardian responsibilities

Parents and guardians are responsible for supervising their child’s use of the game and deciding whether its content is suitable.

Parents should configure the device and app-store purchase authentication settings appropriate for their family. Darkonas is not responsible for purchases authorized through a parent’s or guardian’s platform account, except where applicable law provides otherwise.

5. Purchases

Some Darkonas games are paid applications. Other games may offer optional in-app purchases, including virtual currency, additional content, upgrades, or permanent feature unlocks.

Purchases are processed by the app store through which the game was installed, such as Google Play. The price and applicable taxes are displayed by the platform before the purchase is confirmed.

Darkonas does not directly process or store complete payment-card or bank-account details.

A parent or guardian should authorize purchases made by or for a child.

Virtual items and currency

Virtual currency and virtual items:

• May be used only within the game for which they were obtained.

• Have no monetary value outside the game.

• Cannot be exchanged for cash, transferred between users, or used as a real-world payment method.

• Are licensed for use rather than sold as personal property, subject to applicable consumer law.

Consumable items, such as spent virtual coins, may not be restorable after they have been used. Local balances or progress may also be lost if game data is cleared or the game is uninstalled.

Permanent, non-consumable purchases may be restorable using the same supported app-store account, subject to platform functionality and the game’s technical capabilities.

6. Refunds and consumer rights

Refund requests are handled according to:

• The rules of the app store that processed the purchase.

• Darkonas refund obligations.

• Applicable consumer-protection law.

Nothing in these Terms limits any mandatory rights or remedies available to consumers. Depending on applicable law, these may include rights relating to defective, unavailable, or incorrectly described digital content.

For purchase problems, contact us at mb.darkonas@gmail.com and include the game name, platform, approximate purchase date, and relevant order information. Do not send complete payment-card details.

Google Play users may also request assistance through Google Play’s purchase and refund tools.

7. Game progress

Game progress, preferences, virtual currency, and unlocked content may be stored locally on the device.

Clearing app data, replacing or resetting the device, or uninstalling the game may permanently erase locally stored progress. Darkonas cannot guarantee that locally stored progress or consumed virtual items can be recovered.

Unless a game expressly provides cloud saving, users should assume that progress is stored only on the device.

8. Updates and compatibility

Darkonas may provide updates to:

• Correct errors.

• Improve compatibility, security, or performance.

• Add, modify, or remove features and content.

• Meet app-store, operating-system, or legal requirements.

A compatible device, supported operating system, sufficient storage, and an internet connection may be required to download, update, restore purchases, or access platform services.

Older devices or operating-system versions may stop receiving updates where continued support is no longer technically or commercially reasonable. This does not limit mandatory consumer rights concerning previously supplied digital content.

9. Availability

We work to keep our games functional and accessible, but uninterrupted operation cannot be guaranteed.

A game or feature may occasionally be unavailable because of maintenance, technical faults, platform outages, device incompatibility, security concerns, legal requirements, or circumstances outside our reasonable control.

We may discontinue a game or platform version when reasonably necessary. Where required by law, we will provide appropriate notice or remedies.

10. Intellectual property

The games and their content—including software, artwork, graphics, animations, characters, vehicles, music, sound effects, level designs, interfaces, and trademarks—are owned by or licensed to MB Darkonas and are protected by intellectual-property laws.

These Terms grant permission to use the game but do not transfer intellectual-property ownership.

Screenshots and gameplay recordings may be created and shared for personal, editorial, review, or commentary purposes, provided they are not misleading, unlawful, or presented as an official Darkonas product.

11. Third-party platforms and services

Our games may interact with services operated by third parties, such as Google Play, device operating systems, payment processors, or app-distribution platforms.

Use of those services is also governed by the third party’s own terms and privacy policy. Darkonas does not control and is not responsible for independently operated third-party services.

12. Privacy

The handling of information associated with Darkonas games is explained in the Darkonas Games Privacy Policy, available on this website.

The Privacy Policy forms part of these Terms. Parents and guardians should review it before allowing a child to use a game.

13. Disclaimer

We provide our games with reasonable care and skill.

To the maximum extent permitted by law, games are otherwise provided on an “as available” basis. We do not guarantee that every game will operate without interruption or error on every device or operating-system version.

Nothing in this section excludes warranties, guarantees, or remedies that cannot legally be excluded.

14. Limitation of liability

To the maximum extent permitted by applicable law, Darkonas will not be liable for indirect, incidental, or consequential loss resulting from use of or inability to use a game.

Darkonas does not exclude or limit liability where doing so would be unlawful, including liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or mandatory consumer rights.

Any limitation in these Terms applies only to the extent permitted by the laws applicable to the user.

15. Ending use of the game

You may stop using the game at any time by uninstalling it.

If these Terms are materially violated, the licence granted under these Terms may end, subject to applicable law. When the licence ends, you must stop using and remove unauthorized copies of the game.

Ending use does not automatically cancel or reverse completed purchases. Refund rights remain governed by the app store’s rules and applicable law.

16. Changes to these Terms

We may update these Terms to reflect changes to our games, platform requirements, legal obligations, or business practices.

The revised Terms will be published on this page with an updated effective date. Where required by law, material changes will be communicated through an appropriate additional notice.

Changes will not retroactively reduce mandatory rights relating to purchases already made.

17. Governing law and disputes

These Terms are governed by the laws of the Republic of Lithuania, without excluding mandatory consumer protections that apply in the user’s country of residence.

Consumers may bring disputes before courts or consumer-protection bodies that have jurisdiction under applicable law. Nothing in these Terms requires a consumer to give up a legally protected right to seek a remedy in their home country.
