These Terms of Use govern the use of the app “DailyProgress”.

1. Purpose of the App

DailyProgress is a productivity app that helps users plan daily goals, complete them within defined time windows, and track their progress.

The app is intended for personal organization and productivity. DailyProgress does not guarantee that users will achieve specific goals, become more productive, or obtain any particular result.

2. Use of the App

Users may use DailyProgress only lawfully and in accordance with these Terms of Use.

Users must not misuse the app, attempt to bypass technical restrictions, manipulate the app, interfere with its functionality, or violate third-party rights.

3. Free Features

DailyProgress may include free basic features. The scope and availability of free features may change over time.

4. Pro Features

DailyProgress may offer paid Pro features. These may include, for example:

• extended progress features

• repeating goals

• carrying over unfinished goals

• Home Screen widgets

• additional premium features

The exact scope of Pro features may be developed, changed, expanded, or limited over time.

5. Subscriptions

DailyProgress may offer auto-renewable subscriptions, such as a monthly or yearly subscription.

Payment is charged to the user’s Apple ID and processed by Apple. Subscriptions automatically renew unless cancelled before the end of the current billing period according to Apple’s rules.

Users can manage or cancel subscriptions through their Apple ID or App Store account settings.

6. Lifetime Purchase

DailyProgress may offer a one-time lifetime purchase.

A lifetime purchase unlocks Pro features for the Apple ID used for the purchase, as long as the app and the relevant features remain available.

“Lifetime” refers to the lifetime and availability of the app or service, not the lifetime of the user.

7. Prices and Changes

Current prices are displayed inside the app and in the App Store.

Prices may change. For existing subscriptions, Apple’s procedures and rules for price changes apply. Users will be informed of relevant price changes according to Apple’s requirements.

8. Free Trials and Offers

If free trials, introductory offers, or discounts are provided, the conditions shown inside the app or in the App Store apply.

After a free trial ends, a paid subscription may begin unless it is cancelled in time according to Apple’s rules.

9. Refunds

Purchases and subscriptions are processed by Apple.

Refund requests must be handled through Apple. DailyProgress cannot directly issue refunds for purchases made through the App Store.

10. Availability

DailyProgress aims to provide a reliable app experience. However, uninterrupted, permanent, or error-free availability is not guaranteed.

Features may be changed, expanded, limited, suspended, or discontinued if this becomes necessary for technical, legal, business, or operational reasons.

11. Data Storage

DailyProgress generally stores goals, progress, and settings locally on the user’s device unless stated otherwise.

Users are responsible for backing up important information where necessary.

12. No Professional Advice

DailyProgress is intended only for personal organization and productivity.

The app does not provide medical, psychological, therapeutic, legal, tax, financial, or other professional advice.

13. Liability

The provider is liable without limitation for intent and gross negligence.

In cases of simple negligence, the provider is liable only for breaches of essential contractual obligations. In such cases, liability is limited to foreseeable and typical damages.

Liability for injury to life, body, or health remains unaffected.

14. Rights to the App

All rights to the app, design, text, logos, trademarks, software, and other content remain with the provider or the respective rights holders.

Users receive only a limited, non-exclusive, non-transferable right to use the app in accordance with these Terms of Use and the applicable App Store terms.

15. Apple App Store

The download, purchase, and use of DailyProgress are also subject to the terms and conditions of the Apple App Store.

Where applicable, Apple’s Media Services Terms and Conditions and Apple’s Standard End User License Agreement may apply in addition to these Terms of Use.

16. Changes to these Terms

These Terms of Use may be updated if new features are added, legal requirements change, or technical or business circumstances require an update.

18. Governing Law

These Terms of Use are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection laws provide otherwise.

19. Severability

If any provision of these Terms of Use is or becomes invalid, the remaining provisions remain unaffected.
