Terms and Conditions

1. Introduction and Agreement

Acceptance of Terms

By downloading, installing, or using any application, game, or watch face developed by Amber Design Studio (hereinafter referred to as the "Applications" or "Services"), the user ("you") agrees to be bound by these Terms and Conditions (T&C). If you do not agree, you must not install or use the Applications and should immediately uninstall them.

Modifications

We reserve the right to modify these T&C at any time. We will notify users of any significant changes by posting the updated terms on this page. Continued use of the Applications after any changes constitutes acceptance of the new terms.

2. Intellectual Property and Limited License

Ownership

The developer (Amber Design Studio) retains all rights, title, and interest in and to the Applications, including all designs, graphics, game mechanics, audio, code, and intellectual property except for any attributions specified below.

Limited License

You are granted a non-exclusive, non-transferable, revocable license to install and use the Applications solely for your personal, non-commercial use on compatible devices (such as smartphones or Wear OS wearable devices) owned or controlled by you.

3. Prohibited Use

Users are expressly prohibited from:

Reverse engineering, decompiling, disassembling, or attempting to extract the source code of the Applications.
Copying, reproducing, distributing, modifying, or creating derivative works of the Applications, assets, or their components.
Using the Applications for any illegal, unauthorized, or commercial purpose without express written consent from Amber Design Studio.
Cheating, exploiting, or using unauthorized third-party software to modify gameplay or in-game values in any of our games.

4. In-App Purchases, Subscriptions, and Virtual Goods

Virtual Items

Our games or applications may allow you to purchase virtual currency, items, or premium feature unlocks (such as ad-removal or extra content) using real-world money through the Google Play Store ("In-App Purchases"). Virtual goods are licensed to you on a limited, personal, revocable basis and have no cash or monetary value. They cannot be redeemed, sold, or transferred.

Billing and Refunds

All transactions are handled and processed securely by the Google Play Store Billing system. Payment terms, billing disputes, and refunds are subject to Google Play’s official terms of service. Except as required by local consumer protection laws or Google Play policies, all In-App Purchases are final and non-refundable.

5. Advertisements and Third-Party Content

Some of our Applications are supported by advertisements (e.g., banner ads, interstitial ads, or rewarded videos). We do not control or endorse the content, products, or services advertised by third-party ad networks. Amber Design Studio is not responsible or liable for any interaction, transaction, or dispute you may have with an advertiser.

6. Disclaimer of Data, API, and Game Accuracy

General Disclaimer

The data displayed across our Applications—including but not limited to step counts, heart rate, battery levels, compass headings, game progress, and external data feeds (such as weather and air quality index)—is provided for convenience, information, and entertainment purposes only.

Third-Party APIs and Data Feeds

Certain data displayed in the Applications is retrieved via third-party Application Programming Interfaces (APIs) and SDKs. We do not control, guarantee, or monitor the availability, accuracy, completeness, or timeliness of the information provided by these third-party services.

No Guarantee of Accuracy

We cannot guarantee 100% accuracy or reliability of any data. Readings may be subject to synchronization delays, connection dropouts between your devices, third-party API outages, or hardware sensor limitations.

No Medical or Professional Advice

Any health, fitness, or environmental data shown should not be used for medical diagnosis, health treatment, or safety planning. Users should always consult official health applications or professional services for critical health and safety metrics.

Assumption of Risk

By using our Applications, you acknowledge and agree that you use the displayed data at your own discretion and risk. The developer is not responsible for any inaccuracies, errors, or reliance placed on the data provided.

Terms for South Korean Consumers

Right of Withdrawal: In accordance with the Act on the Consumer Protection in Electronic Commerce in South Korea, the right to withdraw a purchase within 7 days may be limited for digital content once the performance has begun (i.e., once the application or virtual good has been downloaded and installed onto your device), unless the content is defective.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Amber Design Studio and its developers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any losses whatsoever (including, without limitation, loss of profits, data, use, goodwill, or other intangible losses), resulting from:

Your access to, use of, or inability to access or use the Applications or Games.
Any hardware malfunctions, battery drain, screen burn-in, or physical damage to your phone or wearable device alleged to be caused by the software.
Any errors, inaccuracies, temporary service disruptions, or permanent cessation of data delivered by third-party APIs or SDKs.
Any billing issues or transaction failures originating from the third-party payment infrastructure (Google Play Billing).

The applications are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties, express or implied.

8. Governing Law and Termination

Governing Law

This Agreement shall be governed and construed in accordance with the laws of Greece, without regard to its conflict of law provisions. Any legal disputes shall be subject to the exclusive jurisdiction of the competent courts in Greece.

Termination

We may terminate or suspend your access to our software immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these T&C.
