1. Introduction and Agreement

• Acceptance of Terms: By downloading, installing, or using any Watch Face developed by Amber Design Studio (hereinafter "the Watch Face"), the user agrees to be bound by these Terms and Conditions (T&C). If the user does not agree, they must not install or use the Watch Face and should immediately uninstall it.

• Modifications: We reserve the right to modify these T&C at any time. We will notify users of any significant changes by posting the updated terms on this page. Continued use of the Watch Face after any changes constitutes acceptance of the new terms.

2. Intellectual Property and Limited License

• Ownership: The developer (Amber Design Studio) retains all rights, title, and interest in the Watch Face, including all designs, graphics, code, and intellectual property.

• Limited License: You are granted a non-exclusive, non-transferable, revocable license to install and use the Watch Face solely for your personal, non-commercial use on a single, compatible wearable device.

3. Prohibited Use

Users are expressly prohibited from:

• Reverse engineering, decompiling, or attempting to extract the source code of the Watch Face.

• Copying, reproducing, distributing, modifying, or creating derivative works of the Watch Face or its components.

• Using the Watch Face for any illegal, unauthorized, or commercial purpose without express written consent.

4. Disclaimer of Data and API Accuracy

• 4.1 General Disclaimer: The data displayed on this Watch Face, including but not limited to step counts, heart rate, battery levels, and external data feeds (such as weather, complications, or calendar entries), is provided for convenience and entertainment purposes only.

• 4.2 Third-Party APIs and Data Feeds: Certain data displayed on the Watch Face is retrieved via third-party Application Programming Interfaces (APIs). We do not control, guarantee, or monitor the availability, accuracy, completeness, or timeliness of the information provided by these third-party services.

• 4.3 No Guarantee of Accuracy: We cannot guarantee 100% accuracy or reliability of any data. Readings may be subject to synchronization delays, connection dropouts between the device and smartphone, third-party API outages, or hardware sensor limitations.

• 4.4 No Medical or Professional Advice: Any health, fitness, or activity data shown (e.g., heart rate, steps) should not be used for medical diagnosis, treatment, or professional tracking. Users should always consult official health applications or professional medical advice for accurate health metrics.

• 4.5 Assumption of Risk: By using this Watch Face, you acknowledge and agree that you use the displayed data at your own discretion and risk. The developer is not responsible for any inaccuracies, errors, or reliance placed on the data provided.

4.6 Terms for South Korean Consumers

• Right of Withdrawal: In accordance with the Act on the Consumer Protection in Electronic Commerce in South Korea, the right to withdraw a purchase within 7 days may be limited for digital content once the performance has begun (i.e., once the Watch Face has been downloaded and installed onto your device), unless the content is defective.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Amber Design Studio and its developers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any losses whatsoever (including, without limitation, loss of profits, data, use, goodwill, or other intangible losses), resulting from:

• Your access to, use of, or inability to access or use the Watch Face.

• Any hardware malfunctions, battery drain, screen burn-in, or physical damage to your wearable device alleged to be caused by the software.

• Any errors, inaccuracies, temporary service disruptions, or permanent cessation of data delivered by third-party APIs.

• The applications are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties, express or implied.

6. Governing Law and Termination

• Governing Law: This Agreement shall be governed and construed in accordance with the laws of Greece, without regard to its conflict of law provisions. Any legal disputes shall be subject to the exclusive jurisdiction of the competent courts in Greece.

• Termination: We may terminate or suspend your access to our software immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these T&C.
