These terms are an agreement between you and Olga Afanaseva ("we", "us"), about your use of the Cube iOS app. By downloading or using Cube you agree to them. If you do not agree, do not use the app.
Read this section even if you skip the rest.
Cube is a habit-tracking app. It is not a medical device, and it does not diagnose, treat, cure or prevent any condition.
Nothing in Cube is medical, nutritional or dietary advice.
The Sugar Score is a self-assessment calculated only from the answers you type in. It is not a test, not a measurement, and not a clinical finding.
Cube cannot measure anything happening inside your body. It counts what you tell it you ate.
The daily guidelines shown in the app are general public-health figures published by the World Health Organization and the American Heart Association. They are population-level guidance, not a target set for you personally.
Information in the app about what added sugar is associated with is general information drawn from published guidance. It is not a statement about your health.
Talk to a doctor before changing how you eat, particularly if you are pregnant or breastfeeding, are under 18, have diabetes or any blood-sugar condition, have or have had an eating disorder, take medication affecting blood sugar or appetite, or have any other medical condition. If you feel unwell, seek medical help. Do not delay or disregard medical advice because of something you read in this app.
If you are struggling with disordered eating, please reach out to a qualified professional or a support line in your country.
You must be at least 13 years old, and old enough to enter a binding contract where you live. If you are under 18, you may use Cube only with the involvement of a parent or guardian.
We give you a personal, non-exclusive, non-transferable, revocable licence to use Cube on Apple devices you own or control, for your own personal, non-commercial use, under the App Store Terms of Service.
You agree not to: copy, modify or create derivative works of the app; reverse engineer or attempt to extract its source code except where the law expressly allows it; sell, rent, sublicense or redistribute it; use it to break the law; or interfere with its operation or security.
Cube requires a paid subscription to use.
Plans and prices are shown in the app before you buy, in your local currency. Current plans are a weekly subscription and an annual subscription.
Payment is charged to your Apple ID account at confirmation of purchase.
Auto-renewal: subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the current period ends. Your account is charged for renewal within 24 hours prior to the end of the period, at the price of the plan you chose.
Cancelling: manage or cancel in iOS Settings → your name → Subscriptions. Deleting the app does not cancel your subscription.
Free trial, if one is offered: any unused portion of a free trial is forfeited when you buy a subscription.
Refunds are handled by Apple, under Apple's policies, not by us. Requests go to https://reportaproblem.apple.com
Price changes: if we change the price, Apple will notify you and ask for your consent before the new price takes effect, as required by the App Store rules.
Restoring: "Restore" on the paywall restores a subscription bought with the same Apple ID.
Cube is built to work without an account, and your entries stay on your device. What Cube does with information is described in our Privacy Policy at https://sites.google.com/view/cube-quit-sugar-addiction/privacy-policy?authuser=2, which forms part of these terms.
Because your data is stored on your device and we hold no copy, you are responsible for your own backups. If you delete the app, lose your device, or reset your progress, we cannot recover your history.
Notes, custom food entries and check-ins you write stay yours. We claim no ownership of them. Since they are stored on your device, we do not have access to them.
The Cube name, the cube character and all its poses, the app's design, text, food and swap data compiled by us, and the software itself are owned by us or our licensors and protected by copyright and trade mark law. Product data returned by Open Food Facts belongs to that project and is used under its own licence.
We may update, change or discontinue features. We try not to break things, but we do not promise that Cube will always be available, uninterrupted or error-free. Barcode lookup depends on a third-party database and an internet connection, and may be unavailable or return incorrect product information.
We may update these terms. If a change is material, we will make it visible in the app or on this page before it takes effect. Continuing to use Cube after that means you accept the updated terms.
You may stop using Cube at any time by deleting it, and cancel your subscription through Apple. We may suspend or end your access if you materially breach these terms — for example by trying to circumvent payment or attack the service.
To the fullest extent the law allows, Cube is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that the cube values, the food database, the barcode results, the Sugar Score or the projections are accurate or suitable for you. They are estimates built from simple, published averages and from what you type in.
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of Cube.
Our total liability for any claim relating to Cube is limited to the greater of the amount you paid us in the 12 months before the claim, or USD 50.
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
These terms are between you and us, not with Apple. Apple is not responsible for Cube or its content and has no obligation to provide support for it. Apple is a third-party beneficiary of these terms and may enforce them against you. If Cube fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to Cube.
These terms are governed by the laws of Tajikistan, without regard to its conflict of law rules. Courts of Tajikistan have exclusive jurisdiction, except that if you are a consumer you keep the protections and the right to bring proceedings in the country where you live.
If any part of these terms is found unenforceable, the rest stays in force. Our not enforcing a term is not a waiver of it. These terms, plus the Privacy Policy, are the entire agreement between us about Cube.
