1. Agreement to Terms

These Terms of Use ("Terms") govern your use of the mobile application Cube IQ: Brain Quiz & Trivia ("the App"), provided by The Cube Stack ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

The App is distributed through the Apple App Store, and your use of the App is also subject to Apple's Licensed Application End User License Agreement ("Apple's Standard EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. If there is any conflict between these Terms and Apple's Standard EULA regarding your use of the App obtained through the App Store, Apple's Standard EULA will govern to the extent of that conflict.

2. About the App

Cube IQ: Brain Quiz & Trivia is a mobile application that provides flashcard-based study, quizzes, and trivia across a range of educational topics, using a spaced-repetition study method. The App is available to download for free and offers an optional auto-renewing subscription ("Cube IQ Premium") that unlocks additional features. The App is intended for general educational and entertainment purposes only and does not constitute professional, academic, medical, legal, or other professional advice.

3. Eligibility

The App is intended for a general audience and is not directed at children under the age of 13 (or the equivalent minimum age in your jurisdiction). By using the App, you represent that you are old enough to form a binding agreement, or that you are using the App under the supervision and consent of a parent or legal guardian.

4. License to Use the App

Subject to these Terms and Apple's Standard EULA, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, solely for your personal, non-commercial use.

5. Subscriptions (Cube IQ Premium)

5.1 Subscription and auto-renewal

The App offers an optional auto-renewing subscription, Cube IQ Premium, which provides access to additional features. The available subscription options and their renewal periods (for example, weekly or monthly) and prices are shown within the App at the point of purchase. Your subscription renews automatically at the end of each billing period at the price and interval you selected, unless you cancel it before the renewal date.

5.2 Free trial (if offered)

If a free trial is offered, the trial period and its length are shown at the point of purchase. Unless you cancel at least 24 hours before the end of the free trial, your subscription will automatically convert to a paid subscription and your payment method will be charged according to the plan you selected. Any unused portion of a free trial is forfeited when you purchase a subscription.

5.3 Billing through Apple

All payments, billing, and renewals are processed by Apple through your Apple ID and the App Store. We do not collect or process your payment information. Payment will be charged to your Apple ID account at confirmation of purchase and upon each renewal.

5.4 Managing and cancelling your subscription

You can manage or cancel your subscription at any time through your Apple ID subscription settings (on your device: Settings → [your name] → Subscriptions). To avoid being charged for the next period, you must cancel at least 24 hours before the current period ends. Deleting the App does not cancel your subscription.

5.5 Refunds

Because purchases are processed by Apple, refunds are handled by Apple in accordance with Apple's policies, not by us. To request a refund, please use Apple's process (for example, at https://reportaproblem.apple.com). We are not able to issue refunds directly for App Store purchases.

6. User-Generated Content (Custom Decks)

The App allows you to create your own custom flashcards and decks ("User Content"). User Content is stored locally on your device and, in the current version of the App, is not uploaded to us or shared with other users.

You are solely responsible for your User Content. You agree that you will not create User Content that:

• is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable;

• infringes any third party's intellectual property, privacy, or other rights;

• contains malware or harmful code; or

• is used to advertise or solicit the sale of goods or services.

You retain ownership of your User Content. To the extent any User Content is ever transmitted to us in the future, you grant us a non-exclusive, worldwide, royalty-free license to host and display it solely to operate the App; we will update these Terms before enabling any such feature.

7. Prohibited Activities

You agree not to:

• use the App for any unlawful purpose or in violation of these Terms;

• copy, modify, distribute, sell, or lease any part of the App;

• reverse engineer, decompile, or attempt to extract the source code of the App, except where permitted by law;

• attempt to circumvent, disable, or interfere with usage limits, subscription gating, security, or other features of the App;

• use the App to advertise or offer to sell goods or services; or

• use the App in any way that could damage, disable, or impair the App or interfere with any other party's use of it.

8. Intellectual Property

The App, including its design, text, graphics, software, and content we provide (excluding your User Content), is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding without our prior written permission.

9. Copyright Infringement Notices

We respect intellectual property rights. If you believe that content in the App infringes a copyright you own or control, please contact us at thecubestack@gmail.com with: (a) a description of the copyrighted work; (b) a description of the material you claim is infringing and where it is located in the App; (c) your contact information; and (d) a statement that you have a good-faith belief that the use is not authorized. We will review and respond to valid notices.

10. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that the content is accurate, complete, or reliable. The educational and trivia content is provided for general informational purposes and may contain errors.

11. Limitation of Liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the App.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the App or these Terms will not exceed the amount you actually paid to access the App through the App Store during the six (6) months preceding the event giving rise to the claim, or, if you have paid nothing, will be limited to the maximum extent permitted by applicable law.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless The Cube Stack from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your misuse of the App, your User Content, or your violation of these Terms.

13. Third-Party Services and Links

The App relies on services provided by Apple and may contain links to third-party websites or resources (including this document and our Privacy Policy). We are not responsible for the availability, content, or practices of any third-party services or websites, and your use of them is at your own risk and subject to their terms.

14. Termination

We may suspend or terminate your access to the App at any time, without notice, if you violate these Terms. You may stop using the App at any time by deleting it from your device. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and dispute resolution) will survive.

15. Dispute Resolution

15.1 Informal resolution

Before initiating any formal proceeding, you agree to first try to resolve any dispute informally by contacting us at thecubestack@gmail.com. We will try in good faith to resolve the dispute. If the dispute is not resolved within thirty (30) days of your written notice, either party may proceed to arbitration as described below.

15.2 Arbitration

Any dispute that is not resolved informally will be finally resolved by binding arbitration. The arbitration will take place in Lahore, Pakistan, be conducted in the English language, and be decided by one (1) arbitrator. The arbitrator's decision will be final and binding.

15.3 Governing law

These Terms are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to its conflict-of-law provisions. This does not deprive you of any mandatory consumer protections to which you are entitled under the laws of your country of residence.

16. Changes to These Terms

We may update these Terms from time to time, for example if we add new features (such as advertising). When we do, we will revise the "Last updated" date above. If we make material changes, we will make the updated Terms available before or at the time they take effect. Your continued use of the App after an update means you accept the revised Terms.
