COOKD Terms of Service

These Terms of Service govern your use of COOKD.
COOKD is operated by Patricio Alvarez Morphy, Mexico.
By creating an account or using COOKD, you agree to these Terms.

You must be at least 18 years old to use COOKD.
By creating an account, you represent that you are at least 18 and have the legal capacity to agree to these Terms.
COOKD is an AI-assisted communication tool designed to help users generate suggested replies, analyze conversation context, and manage conversation-related information.
COOKD may generate suggestions based on screenshots, text, conversation history, profile information, communication preferences, and other context you choose to provide.
COOKD does not send messages to another person on your behalf unless a feature explicitly states otherwise. You are responsible for deciding whether to use, modify, copy, or send any generated content.
COOKD uses artificial intelligence to generate content.
AI-generated suggestions may be inaccurate, incomplete, inappropriate, misleading, or unsuitable for your circumstances.
You are responsible for reviewing all generated content before using or sending it.
COOKD does not guarantee:
that a suggestion will produce a particular result;
that another person will respond favorably;
that generated content is factually correct;
that AI-generated content is appropriate for every situation.
COOKD is not professional, legal, medical, mental-health, or relationship counseling.
You are responsible for maintaining the security of your account and for activity performed through it.
You must provide accurate information and must not access another person's account without authorization.
You may sign out or delete your account through the application.
You retain your rights in information and content you submit to COOKD.
You grant COOKD a limited license to process, transmit, reproduce, analyze, and transform that content only as reasonably necessary to:
operate COOKD;
generate requested AI outputs;
maintain your saved conversations and account features;
personalize the service;
provide security and technical support.
This license ends when the relevant information is deleted, except where retention is legally required or technically necessary for limited backup, security, fraud-prevention, or transaction purposes.
COOKD may allow you to upload conversations or screenshots containing messages written by other people.
You are responsible for ensuring you have the lawful right to submit and process that information.
You must not use COOKD to unlawfully obtain, disclose, impersonate, harass, threaten, exploit, or violate the privacy or rights of another person.
You may not use COOKD:
for unlawful activity;
to harass, threaten, stalk, exploit, or abuse another person;
to impersonate others deceptively;
to violate intellectual property, privacy, or other rights;
to interfere with the operation or security of COOKD;
to reverse engineer or abuse the service except as permitted by law;
to bypass subscription limits, usage restrictions, or security controls;
to use automated systems to overload or misuse COOKD.
We may restrict or terminate access where reasonably necessary to protect users, COOKD, service providers, or third parties.
COOKD may provide a limited number of free AI generations.
The current product provides 7 successful free Cooks before requiring COOKD Pro for additional paid usage.
We may modify free usage limits prospectively as the service evolves.
COOKD may offer paid access through COOKD Pro.
COOKD Pro may be available through monthly and annual auto-renewable subscriptions purchased through Apple's App Store.
Pricing and billing terms shown in the App Store purchase interface control the transaction.
Subscriptions purchased through Apple are processed and managed by Apple.
Your subscription may automatically renew unless canceled through your Apple account before the applicable renewal deadline.
You can manage or cancel your subscription through your Apple App Store subscription settings.
Deleting your COOKD account does not automatically cancel your Apple subscription.
Payments made through Apple's App Store are subject to Apple's payment and refund policies.
COOKD does not independently process App Store refunds unless required by applicable law.
You may initiate deletion from:
Settings → Account → Delete Account
Deletion is intended to permanently remove your COOKD account and associated application data, subject to limited retention required by law, security, fraud prevention, dispute resolution, or transaction-record obligations.
Account deletion cannot be undone.
Deleting your COOKD account does not automatically cancel an active App Store subscription.
Your use of COOKD is also governed by the COOKD Privacy Policy.
The Privacy Policy explains what information COOKD collects, how it is used, how AI processing works, and how account deletion operates.
COOKD, including its software, interfaces, branding, graphics, designs, and other proprietary materials, is owned by or licensed to the operator of COOKD and is protected by applicable intellectual property laws.
Except for rights expressly granted under these Terms, no rights in COOKD are transferred to you.
As between you and COOKD, and subject to applicable law and third-party rights, you may use the AI-generated text COOKD provides to you for personal purposes.
COOKD does not guarantee that generated output is unique. Similar or identical output may be generated for other users.
COOKD relies on third-party services including Apple, Google/Firebase, OpenAI, and RevenueCat.
Their availability, policies, and technical operation may affect COOKD.
COOKD is not responsible for outages or failures caused entirely by third-party platforms outside our reasonable control.
We may modify, suspend, discontinue, add, or remove features from COOKD.
We do not guarantee uninterrupted or error-free operation.
We may perform maintenance, make technical changes, or impose reasonable limits to protect the service.
We may suspend or terminate access if you materially violate these Terms, misuse COOKD, threaten the security of the service, or engage in unlawful or abusive behavior.
You may stop using COOKD at any time and may delete your account through the app.
To the maximum extent permitted by applicable law, COOKD is provided on an "as is" and "as available" basis.
We disclaim warranties not expressly required by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms limits rights that cannot lawfully be waived.
To the maximum extent permitted by applicable law, COOKD and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use COOKD.
Nothing in these Terms excludes liability that cannot legally be excluded.
To the extent permitted by law, you agree to be responsible for claims arising from your unlawful use of COOKD, your violation of these Terms, or your violation of another person's rights.
These Terms are governed by the applicable laws of Mexico, without regard to conflict-of-law principles.
Any dispute will be handled by courts of competent jurisdiction in Mexico, except where applicable consumer law requires otherwise.
We may update these Terms from time to time.
Material changes may be communicated through COOKD or by other appropriate means.
Continued use after an updated version becomes effective may constitute acceptance where permitted by law.
