Terms of Service for Combin-ai

Agreement to Terms

By accessing or using the Combin-ai mobile application ("App", "Service", "Kombin Asistanı"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the App.

1. Description of Service

Combin-ai is an AI-powered wardrobe assistant that helps you:

• Organize and catalog your clothing items

• Receive AI-generated outfit suggestions

• Get weather-based outfit recommendations

• Manage your personal style preferences

The Service is available in both Free and Premium tiers.

2. User Accounts

2.1 Account Creation

• You must be at least 13 years old to use this App

• You must provide accurate and complete information

• You are responsible for maintaining the security of your account

• You must not share your account credentials

2.2 Account Types

We support the following authentication methods:

• Email and password

• Apple Sign In (iOS only)

2.3 Account Responsibility

• You are responsible for all activity under your account

• You must notify us immediately of any unauthorized use

• We are not liable for any loss or damage from unauthorized account access

2.4 Account Termination by User

• You may delete your account at any time via Profile → Delete Account

• Account deletion is permanent and cannot be undone

• Upon deletion, all your data will be removed (see Privacy Policy)

3. Subscription Terms

3.1 Subscription Tiers

Free Tier:

• Limited clothing items in wardrobe

• Limited AI outfit generations per month

• Basic features

Premium Tier:

• 100 AI outfit generation/Month

• Unlimited clothing items in wardrobe

• Priority support

• All premium features

3.2 Auto-Renewable Subscriptions

Monthly Subscription:

• Billed monthly

• Auto-renews every month unless canceled

Yearly Subscription:

• Billed annually

• Auto-renews every year unless canceled

3.3 Payment Terms

• Payment will be charged to your Apple ID account at confirmation of purchase

• Subscription automatically renews unless canceled at least 24 hours before the end of the current period

• Your account will be charged for renewal within 24 hours prior to the end of the current period

• The renewal cost will be clearly displayed before you confirm the purchase

3.4 Free Trials (if applicable)

• Free trials may be offered for new subscribers

• You will be charged when the trial period ends unless you cancel before the trial ends

• You must cancel at least 24 hours before the trial period ends to avoid charges

3.5 Managing Subscriptions

You can manage and cancel your subscriptions by:

1. Opening the Settings app on your iOS device

2. Tapping your name at the top

3. Tapping "Subscriptions"

4. Selecting Combin-ai

5. Choosing "Cancel Subscription"

3.6 Cancellation Policy

• You may cancel your subscription at any time

• Cancellation takes effect at the end of the current billing period

• No refunds for partial periods

• You will retain Premium access until the end of the paid period

3.7 Refunds

• Refund requests must be made through Apple App Store

• We do not process refunds directly

• Apple's refund policies apply

3.8 Price Changes

• We may change subscription prices at any time

• Price changes will not affect your current subscription period

• You will be notified of price changes before your next renewal

• You may cancel if you do not agree with the new price

4. Acceptable Use Policy

4.1 Permitted Use

You may use the App only for lawful purposes and in accordance with these Terms.

4.2 Prohibited Activities

You must NOT:

• Upload offensive, inappropriate, or illegal content

• Upload images that are not clothing items (the App is for wardrobe management)

• Upload copyrighted images without permission

• Attempt to reverse engineer or hack the App

• Use automated scripts or bots to access the Service

• Impersonate any person or entity

• Interfere with or disrupt the Service

• Attempt to gain unauthorized access to other users' accounts

• Use the Service for commercial purposes without permission

• Violate any applicable laws or regulations

4.3 Content Standards

Clothing photos you upload must:

• Be appropriate and non-offensive

• Not contain nudity or sexually explicit content

• Not contain violence or illegal activities

• Not violate intellectual property rights

• Not contain personal information of others

4.4 Consequences of Violation

If you violate these Terms, we may:

• Issue a warning

• Suspend your account

• Terminate your account

• Report illegal activity to authorities

• Take legal action

5. User Content

5.1 Your Content Ownership

• You retain all ownership rights to photos and data you upload

• You grant us a license to use your content to provide the Service

• This license is limited to operating and improving the App

5.2 License Grant

By uploading content, you grant us:

• A worldwide, non-exclusive license to use, store, and process your content

• The right to transmit your content to third-party services (e.g., OpenAI for AI analysis)

• The right to create backups and derivative works (e.g., compressed images)

This license ends when you delete your content or account.

5.3 Content Removal

• You may delete individual clothing items at any time

• You may delete your entire account and all content

• We may remove content that violates these Terms

5.4 Content Privacy

• Your content is private by default

• We do not share your content with other users

• Your photos are only shared with AI services for analysis (see Privacy Policy)

• We do not use your content for marketing without permission

6. Intellectual Property Rights

6.1 App Ownership

The App and its original content, features, and functionality are owned by Ibrahim Molla and are protected by:

• Copyright laws

• Trademark laws

• Other intellectual property rights

6.2 Trademarks

"Combin-ai" and "Kombin Asistanı" are trademarks of Ibrahim Molla. You may not use these marks without permission.

6.3 Third-Party Licenses

The App uses third-party services and libraries subject to their own licenses:

• OpenAI API

• Supabase

• RevenueCat

• Sentry

• React Native and related libraries

7. AI-Generated Content

7.1 AI Suggestions Are Not Professional Advice

• Outfit suggestions are generated by AI for creative inspiration

• AI suggestions are not professional fashion advice

• We make no guarantees about the accuracy or suitability of AI suggestions

• Always use your own judgment when selecting outfits

7.2 AI Limitations

You acknowledge that:

• AI may make mistakes or generate inappropriate suggestions

• AI suggestions are based on algorithms and may not reflect personal taste

• Weather data may be inaccurate

• Color matching is subjective

7.3 No Liability for AI Suggestions

We are not liable for:

• Outfit choices based on AI suggestions

• Dissatisfaction with AI-generated combinations

• Weather forecast inaccuracies

• Personal or professional consequences of outfit choices

8. Disclaimers and Limitations of Liability

8.1 Service "As Is"

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability

• Fitness for a particular purpose

• Non-infringement

• Accuracy or reliability

8.2 No Guarantee of Availability

We do not guarantee that:

• The App will be available at all times

• The App will be error-free

• Defects will be corrected

• The App is free from viruses or harmful components

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages

• Loss of profits, data, or goodwill

• Service interruptions

• Unauthorized access to your data

• Errors or omissions in content

• Third-party conduct

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

8.4 Third-Party Services

We are not responsible for:

• Third-party services (OpenAI, weather APIs, etc.)

• Third-party service outages

• Changes to third-party APIs

• Third-party data practices

9. Indemnification

You agree to indemnify and hold harmless Ibrahim Molla and Combin-ai from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App

• Your violation of these Terms

• Your violation of any rights of another party

• Content you upload to the App

10. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

• You can delete your account and data at any time

11. Modifications to Service

11.1 Changes to the App

We reserve the right to:

• Modify or discontinue features at any time

• Update the App with new features or improvements

• Change subscription tiers and pricing

• Impose limits on features or storage

11.2 Notice of Changes

We will make reasonable efforts to notify you of material changes:

• Via email

• Via in-app notifications

• By updating the "Last Updated" date of these Terms

11.3 Continued Use

Your continued use of the App after changes constitutes acceptance of the modified Terms.

12. Termination

12.1 Termination by You

• You may stop using the App at any time

• You may delete your account via Profile → Delete Account

• You may cancel your subscription as described in Section 3

12.2 Termination by Us

We may suspend or terminate your account if:

• You violate these Terms

• You engage in fraudulent activity

• We discontinue the Service

• Required by law

12.3 Effect of Termination

Upon termination:

• Your right to use the App ceases immediately

• Your data will be deleted (except as required by law)

• Unpaid fees become due immediately

• Sections that should survive termination will continue (e.g., disclaimers, indemnification)

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to conflict of law principles.

13.2 Dispute Resolution

Any disputes arising from these Terms or the App shall be resolved through:

1. Good faith negotiation

2. Mediation (if negotiation fails)

3. Binding arbitration or court proceedings in Turkey

13.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive the right to participate in class actions or representative proceedings.

14. Apple App Store Terms

14.1 Acknowledgment

You acknowledge that:

• These Terms are between you and Ibrahim Molla, not Apple

• Apple has no obligation to provide support for the App

• Apple is not responsible for the App or its content

14.2 Third-Party Beneficiary

Apple is a third-party beneficiary of these Terms and may enforce them against you.

14.3 Apple Requirements

You must comply with:

• Apple App Store Terms of Service

• Usage rules in the App Store Terms

• Any applicable third-party terms

15. General Provisions

15.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the App.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

15.3 Waiver

Our failure to enforce any right or provision shall not be deemed a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

15.5 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control (e.g., natural disasters, pandemics, server outages, third-party service failures).

15.6 Language

These Terms are provided in English. Translations may be provided for convenience, but the English version shall govern in case of conflicts.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Sending email notifications for significant changes

Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

18. Acknowledgment

By creating an account or using the App, you acknowledge that:

• You have read and understood these Terms of Service

• You have read and understood the Privacy Policy

• You agree to be bound by these Terms

• You are at least 13 years old

• You meet all eligibility requirements

Auto-Renewable Subscription Summary

• Payment charged to Apple ID at confirmation of purchase

• Subscription automatically renews unless canceled at least 24 hours before end of current period

• Account charged for renewal within 24 hours prior to end of current period

• Manage and cancel subscriptions in App Store account settings

• No cancellation of current subscription allowed during active period
