1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Enes Ayata ("Company," "we," "us," or "our") concerning your access to and use of the CleanX AI mobile application (the "App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the App.

We reserve the right to change or modify these Terms at any time. Your continued use of the App following any changes constitutes acceptance of those changes.

2. Description of Service

CleanX AI is a mobile application that uses artificial intelligence technology to:

• Analyze surface cleanliness through image recognition

• Provide cleanliness level assessments

• Offer cleaning recommendations and tips

• Track cleaning history and progress

• Provide personalized cleaning schedules

The App is designed for informational and educational purposes to assist with household and commercial cleaning tasks.

3. Eligibility

You must be at least 13 years of age to use the App. If you are between 13 and 18 years old (or the age of legal majority in your jurisdiction), you may only use the App with the consent and supervision of a parent or legal guardian.

By using the App, you represent and warrant that:

• You meet the age requirements

• You have the legal capacity to enter into these Terms

• You will comply with all applicable laws and regulations

4. User Accounts

4.1 Account Creation

To access certain features, you may need to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information

• Maintain and promptly update your account information

• Keep your password secure and confidential

• Notify us immediately of any unauthorized access

• Accept responsibility for all activities under your account

4.2 Account Termination

You may delete your account at any time through the App settings. We reserve the right to suspend or terminate your account if:

• You violate these Terms

• You engage in fraudulent or illegal activity

• You abuse or misuse the App

• You provide false or misleading information

• We are required to do so by law

5. Subscriptions and Payments

5.1 Premium Features

CleanX AI offers premium features through paid subscriptions:

• Monthly Subscription: Billed monthly

• Annual Subscription: Billed annually (with discount)

Premium features may include:

• Unlimited scans and analyses

• Advanced AI recommendations

• Custom cleaning schedules

• Priority support

• Ad-free experience

5.2 Billing and Payment

• All payments are processed through the Apple App Store

• Prices are displayed in your local currency

• Payment is charged to your Apple ID account at confirmation of purchase

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period

• You can manage and cancel subscriptions in your Apple ID account settings

5.3 Free Trial

We may offer a free trial period for premium features:

• Free trial duration will be clearly stated at sign-up

• You must provide payment information to start a trial

• You will be charged when the trial ends unless you cancel before the trial period expires

• You can cancel during the trial without charge

5.4 Refund Policy

• All purchases are final and non-refundable except where required by law

• Refund requests must be directed to Apple through the App Store

• We follow Apple's refund policies and procedures

• Exceptions may be made at our sole discretion for technical issues or service failures

5.5 Price Changes

We reserve the right to change subscription prices at any time. Price changes will:

• Not affect active subscriptions during their current billing cycle

• Be communicated to you in advance

• Take effect at your next renewal date

6. Acceptable Use

6.1 Permitted Use

You may use the App only for lawful purposes and in accordance with these Terms. You agree to:

• Use the App for personal or commercial cleaning purposes

• Respect the intellectual property rights of others

• Comply with all applicable laws and regulations

• Use accurate information when creating content

6.2 Prohibited Conduct

You agree NOT to:

• Use the App for any illegal or unauthorized purpose

• Attempt to gain unauthorized access to the App or its systems

• Interfere with or disrupt the App's functionality

• Reverse engineer, decompile, or disassemble the App

• Remove or modify any proprietary notices or labels

• Use the App to harass, abuse, or harm others

• Upload viruses, malware, or malicious code

• Collect or harvest user data without consent

• Impersonate another person or entity

• Engage in automated use or data scraping

• Resell or redistribute the App or its content

• Use the App in a manner that violates these Terms

Violation of these restrictions may result in account termination and legal action.

7. Intellectual Property Rights

7.1 Our Rights

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, design, and the selection and arrangement thereof) are owned by Enes Ayata and are protected by:

• Copyright laws

• Trademark laws

• Patent laws

• Other intellectual property rights

• Unfair competition laws

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control

• Access and use the App for personal or internal business purposes

• Use the App in accordance with these Terms

This license does not include the right to:

• Modify, copy, or create derivative works

• Distribute, sell, or sublicense the App

• Use the App for commercial redistribution

• Publicly display or perform the App

7.3 User Content

When you upload photos or create content in the App:

• You retain ownership of your content

• You grant us a limited license to process and analyze your content

• We may use aggregated, anonymized data to improve our AI

• You represent that you have the right to upload the content

• You will not upload content that infringes others' rights

8. AI Technology and Limitations

8.1 AI Analysis

Our AI technology provides cleanliness assessments based on image analysis:

• Results are estimates and recommendations, not guarantees

• Accuracy may vary based on image quality, lighting, and other factors

• AI models are continuously improved but may contain errors

• Results should not replace professional cleaning assessments

8.2 No Professional Advice

The App provides general information only and does not constitute:

• Professional cleaning services

• Health or safety advice

• Recommendations for specific cleaning products or chemicals

• Guarantees of sanitation or hygiene levels

8.3 User Responsibility

You are solely responsible for:

• Interpreting and acting on AI recommendations

• Selecting appropriate cleaning methods and products

• Ensuring safety when using cleaning materials

• Verifying cleanliness for health or safety purposes

• Complying with industry standards and regulations

9. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the App, you consent to our Privacy Policy and agree that we may:

• Collect and process your personal data as described

• Use cookies and similar tracking technologies

• Transfer data internationally as necessary for service provision

10. Third-Party Services

The App may contain links to third-party websites, services, or integrations:

• We are not responsible for third-party content or practices

• Third-party services have their own terms and privacy policies

• Your use of third-party services is at your own risk

• We do not endorse or guarantee third-party services

Current third-party integrations include:

• Apple App Store

• RevenueCat (payment processing)

• Cloud storage providers

11. Disclaimers and Limitations of Liability

11.1 Service "As Is"

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability

• Fitness for a particular purpose

• Non-infringement

• Accuracy or reliability

• Uninterrupted or error-free operation

• Security or freedom from viruses

11.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages

• Loss of profits, revenue, data, or use

• Damages resulting from use or inability to use the App

• Damages caused by third-party services

• Damages exceeding the amount you paid us in the past 12 months

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

11.3 Indemnification

You agree to indemnify and hold harmless Enes Ayata and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App

• Your violation of these Terms

• Your violation of any rights of others

• Your content or conduct

12. Service Availability and Modifications

12.1 Service Interruptions

We strive to provide uninterrupted service but do not guarantee:

• Continuous, error-free operation

• Availability at all times

• Freedom from bugs or technical issues

• Compatibility with all devices or operating systems

We may suspend or discontinue the App temporarily or permanently for:

• Maintenance and updates

• Security reasons

• Legal or regulatory compliance

• Business reasons

12.2 Modifications to App

We reserve the right to:

• Modify, update, or discontinue features

• Change the App's design or functionality

• Add or remove premium features

• Adjust service offerings

We will provide reasonable notice of material changes when possible.

13. Termination

13.1 Termination by You

You may stop using the App and delete your account at any time. Deleting the App does not automatically cancel paid subscriptions.

13.2 Termination by Us

We may terminate or suspend your access immediately, without notice, for:

• Violation of these Terms

• Fraudulent or illegal activity

• Abuse or misuse of the service

• Non-payment

• Any reason at our discretion

13.3 Effect of Termination

Upon termination:

• Your right to use the App ceases immediately

• Your account and data may be deleted

• Paid subscriptions continue until the end of the billing period

• Sections of these Terms that should survive termination will remain in effect

14. Dispute Resolution

14.1 Informal Resolution

Before filing a claim, you agree to contact us at enesayata21@gmail.com to attempt informal resolution. We will work in good faith to resolve disputes within 30 days.

14.2 Governing Law

These Terms are governed by the laws of Turkey, without regard to conflict of law principles.

14.3 Jurisdiction

For users in Turkey:

• Disputes will be resolved in Turkish courts

• Subject to Turkish law

For users in the EU/EEA:

• You may bring claims in your country of residence

• EU consumer protection laws apply

For users in California:

• California consumer protection laws apply

• You may bring claims in California courts

14.4 Arbitration (Where Applicable)

Where permitted by law, disputes may be resolved through binding arbitration rather than in court. This does not apply where prohibited by law.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign our rights and obligations without restriction.

15.5 Force Majeure

We are not liable for failure to perform obligations due to circumstances beyond our reasonable control (e.g., natural disasters, wars, pandemics, government actions).

15.6 Language

These Terms are provided in English. Any translations are for convenience only. In case of conflict, the English version prevails.

16. Updates to Terms

We may update these Terms from time to time. Changes will be effective when we post the revised Terms in the App.

Material changes will be communicated through:

• In-app notification

• Email to your registered address

• Notice on the App's main screen

Your continued use after changes constitutes acceptance of the revised Terms.

18. Special Provisions for Specific Jurisdictions

18.1 European Union Users

EU consumer protection laws apply. You have the right to:

• Withdraw from the contract within 14 days

• Receive refunds for defective digital content

• Bring claims in your country of residence

• Benefit from mandatory consumer protection provisions

18.2 California Users

California Civil Code Section 1789.3 rights apply. You may contact the Complaint Assistance Unit of the Division of Consumer Services in writing at 1625 North Market Blvd., Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.

18.3 Turkish Users (KVKK Compliance)

Users in Turkey have specific rights under Law No. 6698:

• Right to learn whether personal data is processed

• Right to request information about processing

• Right to request correction or deletion

• Right to object to processing
