Terms of Service

General TOS

• You must be 18 years or older to commission me & must be willing to provide a valid, government issued ID upon request. Minors are prohibited from commissioning or otherwise accessing my work.

• I request public credit when posting my artwork but it isn't required.

• I reserve the right to refuse service & terminate a commission or sale.

• You do not have permission to use my artwork in any form to create NFTs or similarly resell my work on the blockchain.

• I do not allow for cancellations or refunds unless there's error on my end or under other specifically discussed circumstances.

• You must remain professional during interactions. Do not flirt or otherwise make advances on me. This is a business transaction & I will not tolerate inappropriate behavior towards me.

• I work on Monday-Friday, 9am to 5pm. I do not respond to business emails or related messages outside of these hours.

• For payment, I accept Paypal. I use the business app to make invoices for all transations. You must be the cardholder. I do not accept payments from anyone other than the commissioner, meaning that a friend cannot pay for you. I accept payment plans when order total is over $450 but they are required to be 50/50 payments & paid within 4 weeks. You will not recieve the final product until fully paid for.

• Commissions may take time. Expect a 1 to 2 month maximum turnaround time for my work but it's often completed quicker. I work on projects based on the motivation I have. Some days I work better with traditional pieces, some days I want to work on my 3D modeling. It's a creativity-based job. I strive to give you my best work & I work best when I focus on what I'm most inspired to do.

• On the topic of commissions or responses taking time, I do have chronic illnesses that make it difficult at times to function when flareups occur. Please be patient with me if it takes a few days to hear back from me or see updates. If something needs my attention urgently, don't hesitate to message me again.

• My home is dog-friendly so please keep that in mind if you purchase any physical products from me. While we keep them away from the workspace, stray fur can come into contact with your product. If you have major allergies to dogs, I do not suggest purchasing from me.

• I don't offer printing or other similar services. I just make the artwork & cannot produce most products like that on my own. I can help you figure out the next step after the artwork is made though! Artwork from commissions is NOT for commerical-use unless otherwise agreed to.

• For any shipped items, I am not responsible for the package once it leaves my hands. I ship via USPS priority or first class mail. If an item is lost in the post, please contact me & we'll figure something out.

For adoptable sales:

• You are required to pay in full before you will recieve the final version.

• Full payment for adopts is required within 24 hours of claiming.

• Adoptables are digital files & are not physical pieces of artwork.

• I reserve the right to refuse service.

• I reserve the right to cancel a sale & blacklist if needed.

• I request that designs are not resold for a higher cost than paid for unless extra artwork has been added.

• I do not allow for sale of my designs for use as NFTs or similar blockchain technology.

• I do not allow refunds on adoptable sales. Sales are final.

• You will receive the high quality & unwatermarked version of the adoptable via email after purchase.

For artwork commissions:

• Commissions take around 1-2 months but often the turnaround time is shorter. Some types of commissions take longer to complete & you'll be given an estimate on when your project will be completed. My Trello is publicly available so you can check your commission's progress anytime.

• Unless otherwise stated, I reserve the rights to share or display the artwork across my platforms or in a portfolio.

• I reserve the right to refuse service.

• I reserve the right to cancel a commission & blacklist if needed.

• A blacklist is defined as being banned from purchasing any products or commissions from me at any point.

• Commissions are NOT for commercial use unless otherwise agreed upon. Meaning, you are not allowed to use my artwork for merchandise or advertising. Commercial-use artwork is an additional fee & must be discussed prior to the commission starting.

For toy model purchases & design commissions:

• Customer has the exclusive rights to create and sell products utilizing the final 3D sculpt.

• Customer has the right to resell or otherwise transfer exclusive rights for this same use of this design. However, I reserve the right of first refusal. Meaning, a shop will be obligated to offer to sell the model back to me before anyone else.

• For 3D sculpting commissions, expect around a 1-2 month turnaround time. Concept art turnaround time is within 1-3 weeks.

• I provide production edits for 2-3 months after the initial purchase.

• All commissions are part of my "After Dark" Trello project queue. You can use Trello to check the status of your commission anytime.

• As part of the transaction, I would like 1 copy of the toy in my preferred specs. You must provide this toy within 3 months of the toy being in production or there will be a fee of the retail cost of the toy.

• You do not have rights to use my artwork or models for advertising or merchandise unless otherwise agreed upon. Commercial-use is an additional fee.

• I also offer line art & .PSD files for an additional fee. Please refer to the "Artwork Pricing" page for more information.

• I accept model design commissions as well. Meaning, you can get a design concept made from your ideas. I offer both 3D models & digitally drawn concept art for these projects.

By purchasing any products from me, you confirm that you have read & agree to my Terms of Service.
