Terms and Policies

1. Payment Terms

I do not accept same day request unless within my discretion. A 50% NON-REFUNDABLE deposit is required to secure your order, this will then go towards the rest of your payment. Deposit is accepted through PayPal, Venmo and Cash. Please have exact change if you choose to pay with cash, I may not have change for you The remaining balance must be paid no later than 24hrs prior to pickup of the item, whether PayPal or Venmo. No Deposit, No Order. 

If deposit is not received within the specified time frame (no later than 5 days before pickup), the order may be cancelled. 

2. Cancellation Changes

Cancellation by Customer: If the Customer cancels the order within 24hrs of expected pickup, the deposit will not be refunded. Cancellations made less than 2 days prior to pickup, will result in the full balance being forfeited. Deposits must be made at least 7 days in advance of the pickup date to ensure the refund of your deposit at our discretion. 

Cancellation by Chocolatease876: If I (Chocolatease876) am unable to fulfill the order due to unforeseen circumstances (e.g., illness, equipment failure), the Customer will receive a full refund of any amounts paid.

Changes to Order: Any changes to the order must be made in writing and submitted to me at least 3 days before order deadline. I will make reasonable efforts to accommodate changes but cannot guarantee all requests.

Cakes and baked goods are perishable and are made to order. Once I have started production on said cake, it cannot be refunded or cancelled (specifically design and flavor preferences). 

3. Delivery and Pickup

Pickup: As of right now I can only offer pickup services and as such I apologize for any inconvenience this may cause. I am based in Concord, NC 28027, the exact address will be given the day prior or the day of pickup for safety reasons. The Customer agrees to pick up their order at the scheduled time. There is a 15min grace period before and after scheduled pickup of your order with no charge to the customer. If the customer is late and has not communicated with me stating they are running late, I may charge a late fee after the grace period has passed or be unable to accommodate the late pickup and as such will not be responsible for the quality or condition of the item.

4. Allergy and Dietary Information

The Customer is responsible for informing me of any allergies, dietary restrictions, or specific preferences at the time of order. I will take reasonable care to avoid cross-contamination but cannot guarantee a 100% allergen-free product. I will not assume liability for adverse reactions as such. 

Gluten-free, vegan and other specialty options are not available at this time.

5. Product Quality and Satisfaction

Product Quality: Orders are either made the day of or the day prior to pickup to remain as fresh as possible. I RESERVE THE RIGHT TO REFUSE ANY ORDER!  I will ensure orders meet the specifications outlined in this Agreement. However, slight variations in color, design, and texture may occur due to the handmade nature of the product.

Satisfaction: In the unlikely event that the Customer is dissatisfied with the product, the customer must notify me within 24hrs hours after pickup. I will work with the Customer to resolve any issues.

6. Limitation of Liability

I am not liable for any damages or losses beyond the total order amount. The Customer agrees to hold me harmless from any liability after pickup of the item (mishandling, transportation or improper storage by the customer), consumption, or other issues that may arise. I am not liable for any order once it has been picked up unless it was a mistake on my end. Products must be stored in a cool dry place to avoid affecting the quality and longevity of the product(s).

7. Photographs and Marketing

We reserve the rights to photograph our cakes and other dessert items for promotional use on our website and social media platforms or other marketing mediums. If you provide us with photos that you have taken of our cakes or desserts and do not wish for them to be shared publicly then please let us know. 

8. Agreement to Terms

By submitting your order, both parties acknowledge that they have read and understood all terms and conditions. 

This Agreement represents the entire understanding between the parties and supersedes all prior discussions or agreements. This contract is intended to ensure clear communication and set expectations between Chocolatease876 and Customer.
