These Terms of Service (“Terms”) govern your use of CheckBUY (“CheckBUY,” “the App”), developed by Kello Solutions (“Kello Solutions,” “we,” “our,” or “us”).

By downloading, accessing, or using CheckBUY, you agree to these Terms. If you do not agree with these Terms, please do not use the App.

1. About CheckBUY

CheckBUY is a product information and decision-support application that allows users to:

• Photograph or upload products for analysis.

• Scan QR codes associated with products.

• Identify products and provide product information.

• Generate an estimated authenticity assessment.

• Provide estimated average online prices.

• Compare a user's purchase price with estimated market prices.

CheckBUY is designed to help users make more informed purchasing decisions.

2. No Account Required

CheckBUY does not require users to create an account, register, log in, or create a user profile.

You are responsible for ensuring that your use of the App complies with these Terms and applicable laws.

3. Authenticity Assessments

CheckBUY does not guarantee that a product is authentic or counterfeit.

Authenticity percentages and related results are estimates generated based on the images, QR-code information, product information, and other information available to the App.

For example, a result such as “92% Likely Authentic” does not mean that CheckBUY has verified the product with certainty.

The assessment may be affected by:

• Image quality

• Lighting

• Missing product details

• Product variations

• Limited reference information

• Incomplete labels or serial numbers

• Changes in manufacturing

• Counterfeit products that closely replicate genuine products

For expensive or high-value purchases, users should obtain professional authentication from an appropriate authentication service.

4. Product Information

CheckBUY may identify products and provide information such as:

• Brand

• Product/model

• Category

• Color or variation

• Product characteristics

• Other publicly available or estimated information

Product information may not always be complete or accurate.

Kello Solutions does not guarantee that every product will be correctly identified.

5. Price Information

CheckBUY may provide estimated average online prices and typical price ranges.

Price information is provided for informational purposes only.

Prices can vary depending on:

• Country

• Currency

• Product condition

• Size

• Colorway

• Availability

• Seller

• Marketplace

• Product version

• Time of purchase

Kello Solutions does not guarantee that a displayed price represents the actual current selling price of a product.

A “Good Deal” or similar indication is an estimate based on available price information and should not be considered financial advice or a guarantee of savings.

6. User-Provided Content

You may provide photographs, product information, QR-code information, or other content to CheckBUY.

You represent that you have the right to provide such content and that your use of the App does not violate another person's rights or applicable law.

You should not intentionally submit:

• Personal identification documents

• Payment card information

• Passwords

• Sensitive personal information

• Content belonging to another person without permission

• Illegal or harmful content

7. Camera and Photo Permissions

Certain CheckBUY features require access to your device camera or photo library.

You may choose whether to grant these permissions.

If you do not provide the necessary permission, certain App functionality may not be available.

8. Third-Party Services

CheckBUY may use third-party technology providers to provide functions such as image analysis, product identification, QR-code processing, hosting, or other technical services.

Information submitted to the App may be processed by these providers as necessary to provide the requested functionality.

Your use of third-party services may also be subject to their own terms and policies.

9. No Professional Authentication Service

CheckBUY is not a professional authentication service.

The App does not replace:

• Professional product authentication

• Brand verification

• Expert inspection

• Physical examination of a product

• Legal or financial advice

You should independently verify important purchasing decisions, particularly when purchasing expensive products.

10. User Responsibility

You are solely responsible for decisions you make based on information provided by CheckBUY.

Before purchasing a product, you should consider additional factors such as:

• Seller reputation

• Product condition

• Original purchase documentation

• Serial numbers

• Packaging

• Return policy

• Professional authentication

• Marketplace buyer protection

Kello Solutions is not responsible for losses resulting from a user's decision to purchase, sell, or otherwise transact based on a CheckBUY result.

11. Prohibited Uses

You agree not to use CheckBUY:

• For unlawful purposes.

• To violate another person's rights.

• To submit malicious or harmful content.

• To interfere with or damage the App.

• To attempt to gain unauthorized access to the App or its systems.

• To reverse engineer, modify, or exploit the App except where permitted by applicable law.

• To use automated systems to abuse or overload the App.

• To use CheckBUY results to intentionally mislead other people.

12. Intellectual Property

CheckBUY, including its software, design, branding, logos, graphics, text, interface, and other original materials, is owned by or licensed to Kello Solutions and is protected by applicable intellectual-property laws.

You may use the App for personal, lawful purposes in accordance with these Terms.

You may not copy, reproduce, distribute, modify, sell, or commercially exploit the App or its proprietary materials without our prior written permission, except where permitted by applicable law.

13. Availability of the App

We may modify, update, suspend, or discontinue parts of CheckBUY at any time.

We do not guarantee that the App will always be available, uninterrupted, or error-free.

Certain features may depend on third-party services, internet connectivity, device capabilities, or operating-system functionality.

14. Updates

We may release updates to CheckBUY to improve functionality, security, performance, compatibility, or features.

You may need to install updates to continue using certain features.

15. Disclaimer of Warranties

To the maximum extent permitted by applicable law, CheckBUY is provided on an “as is” and “as available” basis.

Kello Solutions does not guarantee that:

• Product identification will always be accurate.

• Authenticity assessments will always be correct.

• Authenticity percentages will accurately reflect the true authenticity of a product.

• Price information will always be accurate or current.

• The App will operate without interruption or errors.

• All App features will be available on every device.

16. Limitation of Liability

To the maximum extent permitted by applicable law, Kello Solutions will not be liable for indirect, incidental, special, consequential, or other losses arising from your use of or reliance on CheckBUY.

This includes losses related to:

• Purchasing a counterfeit product.

• Purchasing a product based on an inaccurate authenticity assessment.

• Incorrect product identification.

• Incorrect or outdated price information.

• Seller disputes.

• Marketplace transactions.

• Loss of money resulting from a purchasing decision.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

17. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Kello Solutions from claims, losses, liabilities, damages, and expenses arising from your unlawful use of CheckBUY, violation of these Terms, or infringement of another person's rights.

18. Third-Party Websites and Services

CheckBUY may provide information originating from or referring to third-party websites, marketplaces, or services.

Kello Solutions does not control and is not responsible for the availability, accuracy, content, security, or policies of third-party services.

Any transaction you make with a third party is between you and that third party.

19. Privacy

Your use of CheckBUY is also governed by our Privacy Policy.

CheckBUY is designed without user accounts or profiles and does not intentionally collect or maintain personal user information.

20. Termination

You may stop using CheckBUY at any time by deleting the App from your device.

We may suspend or discontinue access to the App where necessary to protect the App, comply with legal requirements, address misuse, or for other legitimate operational reasons.

21. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will update the Effective Date at the beginning of these Terms.

Your continued use of CheckBUY after updated Terms become effective constitutes acceptance of the updated Terms, to the extent permitted by applicable law.

22. Governing Law

These Terms are governed by the applicable laws of the jurisdiction in which Kello Solutions operates, without prejudice to any mandatory consumer protection rights that may apply to you under the laws of your country of residence.

Nothing in these Terms is intended to remove or limit rights that cannot legally be waived.
