1. Do not install or use the App if you have not read and accepted these terms.
2. This application (the App) allows you to chat with Artificial Intelligence (AI).
3. You are solely responsible for using the App at your own risk. Ensure that your utilization of the App aligns with local laws, and please observe public order and personal privacy. You bear full responsibility for any consequences resulting from your use of the App, as well as any subsequent sharing or distribution of content you input or generate through the App.
4. I, Kristaps Ozols, grant you a limited, non-exclusive, non-transferable, non-sublicensable, non-assignable, and revocable right to access and use the App.
5. Please respect our intellectual property rights to source code, UI/UX design, content material, and trademarks.
6. The App integrates OpenAI API, API terms & policies are available at https://openai.com/api/policies/service-terms/. When you share your User Content* you agree to comply with the terms of OpenAI Sharing & Publication Policy. * User Content is any content generated by AI via the App, as well as your input content.
7. All rights not expressly granted herein are reserved.
8. To access the App, individuals must be at least 18 years old. Users aged between 13 and 17 must demonstrate that they have obtained consent from a parent or guardian. The App is not permissible for individuals under the age of 13
10. You are not allowed to upload or generate User Content that shows at least one of the following signs:
is irreconcilable towards any identity; promotes hate or violence; implies harassment, threat or bullying;
is meant for sexual services, contains a description of sexual activity, or is intended for arousing sexual excitement;
celebrates the suffering or humiliation of others;
contains unsolicited bulk content;
attempts to generate malicious software;
encourages suicide, cutting, eating disorders, and other self-harming activity; produces provocative political statements or is intended for campaigning purposes; is false or misleading, attempts to defraud individuals or spread disinformation;
may be considered illegal or inappropriate for other reasons.
11. We are not responsible for the way you use the App. If your behavior is reported to violate these terms, we may take any legal measures pursuant to the applicable laws.
12. We may change or update the App without any prior notice.
13. The App is provided on a free basis. However, certain features may require a subscription.
14. You may try paid features within the trial period. If you don’t cancel your subscription 24 hours before the end of the trial period, you’ll be charged automatically after a trial expires, and your subscription will be activated on a regular basis.
15. Complete details regarding subscription plans can be accessed on the signup screen displayed prior to making a purchase. We retain the right to modify, terminate, or make other amendments to our offered subscription plans at any time.
16. Subscriptions, including those initiating with a free trial period, will be automatically renewed for a new billing period, with the charge processed within 24 hours before the commencement of the new billing period. If you wish to cancel your subscription, the cancellation will take effect from the upcoming billing period. You have the autonomy to manage your subscriptions.
17. When you uninstall the App, it doesn’t remove your subscription.
18. You are solely responsible for all charges imposed by your communication services provider, including data roaming charges. If you fail to settle the bills associated with your mobile phone or tablet device, we assume that you have obtained permission from the responsible party before incurring any of these charges.

20. The App is provided “as is” and “as available”. We make no warranty that your access to the App or its functions will be uninterrupted or error-free.
21. If your use of the App caused a violation of any kind, we assume no liability or responsibility for that. You are the one who shall be held liable for any breach of the intellectual property rights of third parties or any other illegal/inappropriate action damaging a third party. You agree to hold harmless and indemnify us, our successors, assigns, licensees, partners, affiliates, officers, directors, and employees from and against any and all claims, liabilities, complaints, losses, expenses, and damages of any kind or nature arising out of your use of the App.
22. We shall not be held responsible for damages arising in connection with products, services, or information provided by third parties.

User Content Terms
We do not assert any rights or ownership over your User Content, which includes both input and output content. You retain all rights and assume all associated risks regarding your User Content. It is your responsibility to ensure that you have all the necessary rights, licenses, and permissions for the input content. While you are free to derive benefits from the use of a digital version of your User Content, ensure compliance with relevant laws. We encourage you to confirm that User Content either (a) belongs to you or (b) you have acquired the right to use it as you do within the App.
User Content must adhere to legal and social norms and should not violate public order. It should not infringe upon the rights of third parties, including copyright and privacy rights. It is acknowledged that output content may not be unique, and other users may receive similar content from our App. Output content generated for and requested by other users is not considered your output content. You are prohibited from utilizing output content to develop artificial intelligence models that directly compete with OpenAI products and services. However, you are permitted to use output content to (i) create artificial intelligence models primarily intended for categorizing, classifying, or organizing data (such as embeddings or classifiers), provided these models are not distributed or commercially available to third parties, and (ii) fine-tune models offered as part of OpenAI services.
