Welcome to ChartWizard AI. By downloading, accessing, or using our mobile application ("the App"), you agree to be bound by these Terms of Use. Please read them carefully before using the App.

1. Acceptance of Terms

By accessing or using ChartWizard AI, you agree to comply with and be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

2. Purpose of the App

ChartWizard AI is developed and provided for educational and informational purposes only. The App is designed to help users understand chart patterns and trading concepts using AI-powered tools.

Important: The App does not provide financial, investment, or trading advice. Nothing in the App should be interpreted as a recommendation to buy, sell, or hold any financial instrument.

3. No Financial Advice Disclaimer

• Trading and investing involve significant risk, including the risk of losing money.

• You agree that you will not rely on the App as financial advice or as a substitute for professional guidance.

• Always consult a licensed financial advisor in your country before making any investment or trading decisions.

• ChartWizard AI is not a registered investment advisor and does not provide personalized financial advice.

• Past performance or hypothetical results shown in the App do not guarantee future results.

4. Eligibility

You must be at least 18 years old (or the legal age of majority in your country) to use the App. By using the App, you confirm that you meet this age requirement.

If you are under the legal age, you may only use the App under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

5. Subscription Terms

ChartWizard AI offers auto-renewable subscriptions that provide access to premium features.

Subscription Options:

• Weekly Subscription: Billed every week

• Monthly Subscription: Billed every month

Pricing is displayed in the App and may vary by region. All prices include applicable taxes where required.

Payment and Billing:

Payment will be charged to your iTunes Account (for iOS users) or Google Play Account (for Android users) at confirmation of purchase.

Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same subscription price.

Managing Your Subscription:

You can manage and cancel your subscriptions by going to your account settings in the app store where you made the purchase.

For Apple App Store users:

• Or go to: Settings > [Your Name] > Subscriptions on your iOS device

For Google Play Store users:

• Manage subscriptions at: https://play.google.com/store/account/subscriptions

• Or open: Google Play Store app > Menu > Subscriptions

Cancellation:

You may cancel your subscription at any time. If you cancel, you will continue to have access to premium features until the end of your current billing period. No refunds will be provided for partial subscription periods unless required by law.

Free Trials:

If a free trial is offered, you will be charged at the end of the trial period unless you cancel at least 24 hours before the trial ends. You can cancel during the trial period in your app store subscription settings without being charged.

Refunds:

All purchases are subject to the refund policy of the platform where the purchase was made.

Changes to Subscription Terms:

We reserve the right to modify subscription pricing and terms with advance notice. Changes will not affect your current subscription period. You will be notified of any changes before they take effect.

6. User Responsibilities

When using the App, you agree to:

• Use the App only for lawful, non-commercial, and personal purposes.

• Not misuse, hack, or interfere with the functionality of the App.

• Not reverse engineer, decompile, or attempt to extract the source code of the App.

• Accept full responsibility for any financial or trading decisions you make based on information from the App.

• Not use the App to engage in any fraudulent, abusive, or unlawful activity.

• Provide accurate information when creating an account (if applicable).

7. Account and Data

If you create an account:

• You are responsible for maintaining the confidentiality of your account credentials.

• You agree to notify us immediately of any unauthorized use of your account.

• We reserve the right to suspend or terminate accounts that violate these Terms.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

ChartWizard AI and its developers, affiliates, and partners are not responsible for any direct, indirect, incidental, consequential, or punitive damages arising from:

• Your use or inability to use the App

• Any trading or investment decisions made based on the App

• Loss of profits, revenue, or data

• Technical malfunctions or interruptions

You use the App entirely at your own risk. ChartWizard AI makes no warranties, express or implied, regarding the accuracy, reliability, or availability of the App.

9. Intellectual Property

All features, content, designs, algorithms, logos, trademarks, and other intellectual property in the App are the exclusive property of ChartWizard AI or its licensors.

You may not:

• Copy, modify, reproduce, or distribute any part of the App

• Use our trademarks, logos, or branding without written permission

• Create derivative works based on the App

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.

10. Privacy

We value your privacy and are committed to protecting your personal information.

By using the App, you consent to our data practices as described in the Privacy Policy.

11. Third-Party Services

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, for:

• Violation of these Terms of Use

• Fraudulent, abusive, or illegal activity

• Any reason at our sole discretion

Upon termination, your right to use the App will immediately cease.

13. Updates to Terms

We may revise these Terms of Use at any time. Updated terms will be published in the App with a new "Effective Date" at the top.

Continued use of the App after changes are posted means you accept the revised terms. We encourage you to review these Terms periodically.

14. Governing Law and Dispute Resolution

These Terms of Use are governed by and construed in accordance with the laws of the Republic of Ghana, without regard to its conflict of law principles.

Jurisdiction: If a dispute arises, you agree to submit to the exclusive jurisdiction of the courts located in Ghana.

Arbitration (Optional): Any disputes may be resolved through binding arbitration in accordance with the rules of the Ghana Arbitration Centre, if both parties agree.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of law, the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and ChartWizard AI regarding your use of the App. They supersede any prior agreements or understandings.
