End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you, either an individual or an entity ("User") and Alexey Elin, ("Licensor"), regarding the use of the Carto mobile application ("App").

By installing, downloading, accessing, or using the App, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, you may not install, download, access, or use the App.

1. Grant of License

Licensor grants User a non-exclusive, non-transferable, and limited license to use the App on a single iOS device owned or controlled by User, solely for personal, non-commercial use. This license does not include any right to modify, translate, or create derivative works of the App.

The App is the copyrighted work of Licensor. User acknowledges and agrees that Licensor owns all right, title, and interest in the App, including but not limited to all copyrights, trademarks, trade secrets, and other intellectual property rights.

4. Warranty

Licensor warrants that the App will substantially conform to the description and specifications set forth in this EULA for a period of thirty (30) days from the date of installation or download. If the App does not conform to this warranty, User may notify Licensor, and Licensor will, at its option and expense, either correct the nonconformity or provide User with a replacement copy of the App. This warranty is exclusive and in lieu of all other warranties, express or implied.

5. Disclaimer of Warranties

Except as expressly set forth in this EULA, Licensor makes no warranties, express or implied, with respect to the App, including but not limited to, any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

6. Limitation of Liability

In no event will Licensor be liable for any damages, including, but not limited to, direct, indirect, special, incidental, consequential, or exemplary damages arising out of or in connection with the use or performance of the App, even if Licensor has been advised of the possibility of such damages.

7. Termination

This EULA will terminate immediately upon any breach by User of its terms. Upon termination, User must cease all use of the App and delete all copies of the App from User's device.

8. Indemnification

User agrees to indemnify and hold harmless Licensor from and against any and all claims, losses, damages, liabilities, costs, and expenses (including attorneys' fees) arising out of or in connection with User's use of the App.

9. Amendment

Licensor may amend this EULA at any time by posting the amended EULA on the App Store or Licensor's website. The amended EULA will become effective immediately upon posting. User's continued use of the App after the effective date of the amended EULA will constitute User's acceptance of the amended EULA.

10. Entire Agreement

This EULA constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.

11. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the Republic of Belarus.

12. Severability

If any provision of this EULA is held to be invalid or unenforceable, such provision will be struck from this EULA and the remaining provisions will remain in full force and effect.

13. Waiver

No waiver of any provision of this EULA will be effective unless in writing and signed by both parties.

14. Counterparts

This EULA may be executed in one or more counterparts, each of which will be deemed an original, but all of which together will constitute one and the same instrument.

15. Binding Effect

This EULA is binding upon and inures to the benefit of the parties hereto and their respective successors and permitted assigns.
