END USER LICENSE AGREEMENT (EULA)

This End User License Agreement (“EULA”) is a legal agreement between you (“you” or “Licensee”) and the developer of Car,Play Widget Speedometer (“Licensor,” “Developer,” “we,” “us,” or “our”) for the software application Car,Play Widget Speedometer (the “Licensed Application”), including free and Premium features, updates, and related documentation.

By downloading, installing, or using the Licensed Application, you agree to this EULA, our Terms of Use, and our Privacy Policy. If you do not agree, do not download or use the Licensed Application.

This EULA is in addition to the Licensed Application End User License Agreement terms required by Apple for apps distributed through the App Store. If there is a conflict between this EULA and Apple’s standard Licensed Application EULA on a point Apple mandates, Apple’s mandated term controls for that point.

1. LICENSE GRANT

Subject to your compliance with this EULA, Licensor grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the Licensed Application on Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions / App Store Rules.

The Licensed Application is licensed, not sold, to you.

2. SCOPE OF USE

You may use the Licensed Application for personal, non-commercial use, unless we expressly authorize otherwise in writing. You may not distribute, rent, lease, lend, sell, sublicense, or publicly perform the Licensed Application.

3. PREMIUM FEATURES

Certain features may require a paid subscription or in-app purchase processed by Apple. Premium access is licensed only for the active subscription period and only under Apple’s purchase and restore rules. Cancellation, renewal, and billing are managed by Apple unless mandatory law provides otherwise.

4. RESTRICTIONS

Except as expressly allowed by mandatory law, you shall not:

• Copy the Licensed Application except for backup permitted by Apple’s rules.

• Modify, translate, adapt, or create derivative works of the Licensed Application.

• Reverse engineer, decompile, or disassemble the Licensed Application.

• Remove proprietary notices.

• Use the Licensed Application to develop a competing product by improperly extracting our code, assets, or themes.

• Circumvent technical protections, Premium gates, or usage limits.

• Use the Licensed Application in any unlawful manner or in violation of traffic / device distraction laws.

5. OWNERSHIP

Licensor and its licensors retain all right, title, and interest in and to the Licensed Application, including all intellectual property rights. No ownership rights are transferred to you. All trademarks remain the property of their respective owners.

Apple Inc. and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you. The Licensed Application is not affiliated with, endorsed by, or sponsored by Apple Inc. CarPlay and related Apple marks belong to Apple Inc.

6. DATA AND PRIVACY

Use of the Licensed Application may involve processing of personal data as described in the Privacy Policy. You are responsible for permissions you grant on your device.

7. UPDATES

We may provide updates, patches, or replacements. Updates may be required for continued use. This EULA applies to updates unless accompanied by a separate license.

8. THIRD-PARTY COMPONENTS

The Licensed Application may include or interoperate with third-party software, APIs, streams, or services. Those components may be subject to separate terms. We are not responsible for third-party services outside our reasonable control.

9. NO WARRANTY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. LICENSOR DISCLAIMS ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT.

GPS SPEED, TRIP, MAP, WEATHER, VIN, AND AI REPAIR OUTPUTS ARE INFORMATIONAL AND MAY BE INACCURATE. THE LICENSED APPLICATION IS NOT A CERTIFIED MEASURING INSTRUMENT AND IS NOT A SUBSTITUTE FOR PROFESSIONAL AUTOMOTIVE DIAGNOSIS OR SAFE DRIVING PRACTICES.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES. IN SUCH CASES, EXCLUSIONS APPLY TO THE MAXIMUM EXTENT PERMITTED.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING DAMAGES FOR LOSS OF PROFITS, DATA, BUSINESS, OR OTHER LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE LICENSED APPLICATION, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

LICENSOR’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE LICENSED APPLICATION OR PREMIUM ACCESS DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY U.S. DOLLARS (USD $50), WHICHEVER IS GREATER.

NOTHING IN THIS EULA LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

11. EXPORT AND COMPLIANCE

You may not use or otherwise export or re-export the Licensed Application except as authorized by the laws of the United States, the laws of the jurisdiction in which the Licensed Application was obtained, and other applicable law. By using the Licensed Application, you represent that you are not located in a country subject to a comprehensive U.S. Government embargo and are not listed on any U.S. Government list of prohibited or restricted parties, to the extent such representations are required by Apple’s distribution rules.

12. TERMINATION

This EULA is effective until terminated. Your rights terminate automatically if you fail to comply with any term. Upon termination, you must cease all use and delete all copies of the Licensed Application. Subscription cancellations are handled through Apple. Survival: Sections 5, 9, 10, 12, 13, and 14 survive termination.

13. GOVERNING LAW

This EULA is governed by the laws of the Republic of Turkey, excluding conflict-of-law principles, except where Apple’s standard Licensed Application EULA requires application of the laws of the State of California for a specific mandated clause between you and Apple, or where mandatory consumer law of your residence applies. Disputes between you and Licensor shall be subject to the competent courts of Istanbul, Türkiye, without prejudice to mandatory consumer venue rights.

14. CONTACT

For EULA questions, use the developer support contact on the App’s Apple App Store listing and include “EULA – Car,Play Widget Speedometer” in your message.

15. ENTIRE AGREEMENT

This EULA, together with the Terms of Use and Privacy Policy, constitutes the entire agreement between you and Licensor regarding the Licensed Application and supersedes prior understandings on that subject, except for Apple’s separate agreements with you.
