END USER LICENSE AGREEMENT (EULA)

1. AGREEMENT SCOPE
This End User License Agreement ("Agreement") is between you ("User") and Calm Down Oscar ("Company", "we", "us") only, and not Apple Inc. ("Apple"). Company, not Apple, is solely responsible for ClearSpace ("App") and its content.
2. LICENSE GRANT
Subject to your compliance with this Agreement, Company grants you a limited, non-transferable, non-exclusive license to use the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
3. RESTRICTIONS
You may not:
- Transfer, redistribute, or sublicense the App
- Use the App on devices you do not own or control
- Reverse engineer, decompile, or disassemble the App
- Use the App for commercial purposes beyond personal use
- Remove or alter any proprietary notices
4. SUBSCRIPTION TERMS
ClearSpace Pro Features:
- Unlimited photo deletion: Mark unlimited photos for deletion without the 5-photo limit
- Unlimited trash emptying: Empty trash as many times as needed without daily restrictions
- No advertisements: Enjoy an ad-free experience
Subscription Options:
- Monthly Subscription: $2.99/month, automatically renewed monthly
- Annual Subscription: $19.99/year, automatically renewed yearly
- Lifetime Purchase: $29.99 one-time payment, permanent access
Auto-Renewal:
- Payment charged to iTunes Account at confirmation of purchase
- Subscription automatically renews unless auto-renew is turned off at least 24 hours before current period ends
- Account charged for renewal within 24 hours prior to end of current period
- Manage subscriptions and turn off auto-renewal in Account Settings after purchase
5. PRIVACY
Your privacy is important to us. Please review our Privacy Policy at https://sites.google.com/view/calmdownoscar/privacy-policy which describes how we collect, use, and protect your information.
6. MAINTENANCE AND SUPPORT
Company is solely responsible for providing maintenance and support for the App. Apple has no obligation to provide maintenance or support services.
7. WARRANTIES
Company makes no warranties about the App beyond what is required by law. Apple disclaims all warranties with respect to the App and any warranty claims should be directed to Company.
8. PRODUCT LIABILITY
Company, not Apple, is responsible for addressing any claims relating to the App or your use of it, including:
- Product liability claims
- Claims that the App fails to conform to legal requirements
- Claims under consumer protection or privacy laws
9. THIRD PARTY BENEFICIARY
You acknowledge that Apple is a third-party beneficiary of this Agreement and has the right to enforce it against you.
10. TERMINATION
This Agreement is effective until terminated. Your rights terminate automatically if you fail to comply with any terms. Upon termination, you must cease using the App and delete it from your devices.
11. GOVERNING LAW
This Agreement is governed by the laws of California, United States, without regard to conflict of law principles.
