1. Agreement to Terms

By downloading, installing, or using Calio AI ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the App.

2. Description of Service

Calio AI is a mobile application that uses artificial intelligence to estimate the nutritional content of food from photos and track daily calorie and macronutrient intake. Nutritional estimates are generated algorithmically and are provided for informational purposes only.

3. Eligibility

You must be at least 13 years old to use Calio AI. By using the App, you represent that you meet this requirement and that any health information you provide is accurate to the best of your knowledge.

4. User Accounts

You may need to create an account to access certain features. You are responsible for:

• Maintaining the confidentiality of your account credentials

• All activities that occur under your account

• Providing accurate and current information

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

5. Acceptable Use

You agree not to:

• Use the App for any illegal or unauthorized purpose

• Attempt to reverse engineer, decompile, or hack the App or its AI systems

• Upload photos that are not of food (e.g., inappropriate, offensive, or illegal content)

• Interfere with or disrupt the App's servers or networks

• Use automated scripts or bots to access the App

• Impersonate another person or misrepresent your identity

6. AI-Generated Estimates Disclaimer

IMPORTANT: Calio AI provides estimated nutritional information based on AI analysis of food photos and user input. These estimates are approximations and may not be 100% accurate. Factors such as portion size variation, cooking methods, ingredients, and image quality affect accuracy.

You acknowledge that:

• Calio AI is not a medical device and does not provide medical advice

• The App does not replace professional dietary counseling, medical advice, diagnosis, or treatment

• You should consult a healthcare professional or registered dietitian before making significant dietary changes, especially if you have medical conditions (e.g., diabetes, eating disorders, food allergies)

• We are not liable for health outcomes resulting from reliance on our nutritional estimates

7. Intellectual Property

All content, code, designs, logos, and AI models within Calio AI are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

You retain ownership of the photos you upload. By uploading food photos, you grant us a license to process them for AI analysis and to use anonymized versions for improving our services.

8. Subscriptions and Payments (if applicable)

Certain features may require a paid subscription. By subscribing:

• You agree to the pricing and billing terms presented at purchase

• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date

• You may cancel through your Google Play account settings

• All purchases are final; refunds are handled per Google Play policy

9. Termination

We may suspend or terminate your access at any time, with or without notice, for violations of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the App ceases immediately.

10. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind

• We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement

• We are not liable for any indirect, incidental, special, consequential, or punitive damages

• Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 if you have not paid

11. Indemnification

You agree to indemnify and hold harmless Calio AI, its affiliates, officers, and employees from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of the USA.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through the App. Your continued use after changes constitutes acceptance.
