Terms of Service for BudgieWise

1. Acceptance of Terms

By downloading, installing, or using BudgieWise ("the App"), you agree to these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, please do not use the App.

2. Description of Service

BudgieWise is a personal finance tracking application designed to help users monitor income, expenses, budgets, and financial habits. The App provides AI-powered financial insights through an integrated chat assistant powered by Google Gemini.

BudgieWise is intended for personal, non-commercial use only.

3. Not Financial Advice — Important Disclaimer

BudgieWise and its AI assistant provide general financial information for educational and informational purposes only.

Nothing in this App constitutes professional financial, investment, legal, or tax advice. You should not make significant financial decisions based solely on information or suggestions provided by this App or its AI assistant.

Always consult a qualified financial advisor before making major financial decisions. BudgieWise and its developers are not liable for any financial outcomes resulting from use of the App.

4. User Responsibilities

You are solely responsible for:

• The accuracy of the financial data you enter into the App

• Any financial decisions you make based on App content or AI suggestions

• Managing and backing up your device and its data

• Maintaining the security of your account and device

BudgieWise stores your transaction data locally on your device. If you uninstall the App, reset your device, or lose access to it, your transaction history may be permanently lost. We are not responsible for any data loss under these circumstances.

5. AI Assistant Usage

The App includes an AI chat assistant ("Budgie AI") powered by Google Gemini. By using this feature you acknowledge and agree that:

• A summary of your financial data (budget, spending totals, income totals, recent transaction categories) is sent to Google Gemini to generate responses

• AI responses are for informational purposes only and do not constitute financial advice

• The AI may occasionally produce inaccurate or incomplete information — always verify important figures yourself

• Free accounts are limited to 35 AI messages per month. Pro and VIP accounts are limited to 600 messages per month

• We reserve the right to adjust these limits at any time with reasonable notice

• Attempting to manipulate, jailbreak, or bypass the AI system's instructions is prohibited

6. Accounts and Authentication

The App uses Google Firebase Authentication to verify your identity, manage login sessions, and track subscription status. You are responsible for:

• Maintaining access to your Google account

• Keeping your device secure

• Notifying us if you suspect unauthorized access to your account

We reserve the right to suspend or terminate accounts that violate these Terms.

7. Subscriptions and Payments

BudgieWise offers optional Pro and VIP subscription tiers with enhanced features.

• Payments are processed securely through Google Play Billing and managed via RevenueCat

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period

• You can manage or cancel your subscription at any time through your Google Play account settings

• Refunds are handled according to Google Play's refund policy — we do not process refunds directly

• We reserve the right to change subscription pricing with reasonable advance notice

• Subscription benefits are tied to your account and are non-transferable

8. Acceptable Use

You agree not to:

• Use the App for illegal, fraudulent, or harmful activities

• Attempt to reverse engineer, decompile, or modify the App

• Attempt to bypass, manipulate, or abuse the AI assistant or backend services

• Create multiple accounts to circumvent usage limits

• Attempt to access another user's data

• Use automated tools or scripts to interact with the App

We reserve the right to restrict or terminate access without notice if misuse is detected.

9. Intellectual Property

The App, including its design, code, branding, and content, is owned by the developer and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal purposes only.

You may not copy, reproduce, distribute, or create derivative works from the App without explicit written permission.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• BudgieWise is provided "as is" without warranties of any kind, express or implied

• We do not guarantee the accuracy, completeness, reliability, or availability of the App or its AI features

• We are not liable for any financial losses, data loss, loss of profits, or indirect, incidental, or consequential damages arising from your use of the App

• Our total liability to you for any claim arising from use of the App shall not exceed the amount you paid for your subscription in the 3 months preceding the claim

11. Third-Party Services

The App integrates with third-party services including Google Firebase, Google Gemini, Google Play, and RevenueCat. These services operate under their own terms and privacy policies. We are not responsible for the practices or content of these third-party services.

12. Updates and Changes

We may update the App and these Terms at any time. We will make reasonable efforts to notify users of significant changes. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.

We do not guarantee that the App will always be available and may discontinue or modify features at any time.

13. Termination

We may suspend or terminate your access to the App if you violate these Terms, if the App is discontinued, or if required by law or platform policies. Upon termination, your right to use the App ceases immediately. Locally stored data remains on your device until you delete it.

14. Governing Law

These Terms are governed by the laws of Pakistan. Any disputes arising from your use of BudgieWise shall first be attempted to be resolved through good faith negotiation. If unresolved, disputes shall be subject to the jurisdiction of the courts of Pakistan. Any disputes shall be resolved through good faith negotiation before pursuing legal remedies.
