These Terms of Service (“Terms”) govern your use of BREATHE | Calm & Focus (“BREATHE”, “the App”), developed by Kello Solutions (“Kello Solutions”, “we”, “us”, or “our”).

By downloading, accessing, or using BREATHE, you agree to these Terms. If you do not agree with these Terms, please do not use the App.

1. About BREATHE

BREATHE is a wellness application designed to provide guided breathing exercises and related features intended to support:

• Relaxation

• Stress relief

• Sleep preparation

• Focus

• Mindful breathing

• Short breathing breaks

• Personal wellness routines

The App does not require an account, registration, or user profile for its core functionality.

2. Wellness and Medical Disclaimer

BREATHE is intended for general wellness and relaxation purposes only.

The App is not a medical device and does not provide medical advice, diagnosis, treatment, or professional healthcare services.

The breathing exercises and other content available through BREATHE should not be considered a substitute for advice from a qualified healthcare professional.

You should consult a healthcare professional before using breathing exercises if you have a medical condition or concerns about whether a particular exercise is appropriate for you.

Stop an exercise immediately if you experience dizziness, light-headedness, shortness of breath, discomfort, pain, or any other unusual symptoms.

If you experience a medical emergency, contact the appropriate emergency services rather than relying on BREATHE.

3. Eligibility

You may use BREATHE only if you are legally permitted to use the App under the laws applicable to you.

If you are under the age required to independently agree to these Terms in your jurisdiction, you should use the App only with the involvement and permission of a parent or legal guardian where required.

4. Acceptable Use

You agree to use BREATHE only for lawful purposes and in accordance with these Terms.

You must not:

• Attempt to reverse engineer, decompile, disassemble, or modify the App;

• Attempt to gain unauthorized access to the App or its systems;

• Interfere with the operation or security of the App;

• Copy, redistribute, sell, lease, or commercially exploit the App without permission;

• Remove copyright, trademark, or other proprietary notices;

• Use the App to violate applicable laws or regulations;

• Attempt to circumvent technical restrictions or security measures.

5. App Content

All content provided through BREATHE, including but not limited to:

• Breathing exercises

• Instructions

• Text

• Illustrations

• Graphics

• Animations

• Sounds

• User interface designs

• Logos

• Branding

• Wellness information

is owned by or licensed to Kello Solutions and is protected by applicable intellectual property laws.

You may use the content solely as part of your personal use of the App.

You may not reproduce, distribute, modify, publicly display, sell, or commercially exploit App content without our prior written permission.

6. No Professional Advice

Information provided through BREATHE is general informational and wellness content.

It is not intended to replace:

• Medical professionals

• Mental health professionals

• Sleep specialists

• Therapists

• Physicians

• Emergency services

• Other qualified professionals

Kello Solutions does not guarantee that any particular breathing exercise will provide a specific physical, psychological, sleep, or performance benefit.

7. Breathing Exercises and Personal Responsibility

You are responsible for deciding whether an exercise is appropriate for you.

You should use BREATHE in a safe environment and should not use the App while:

• Driving

• Operating machinery

• Performing activities requiring continuous attention

• In situations where distraction could create a safety risk

Do not intentionally restrict your breathing beyond what is comfortable or instructed by the App.

Kello Solutions is not responsible for injuries or adverse effects resulting from improper use of the App, ignoring safety instructions, or using an exercise that is unsuitable for your individual circumstances.

8. Notifications and Reminders

BREATHE may provide optional reminders for breathing sessions.

You can enable or disable notifications through the App or your iOS device settings.

Reminder notifications are intended only as optional wellness prompts. They are not emergency alerts, medical reminders, or safety notifications.

Kello Solutions does not guarantee that a notification will always be delivered at a particular time.

9. Progress and Local Data

BREATHE may provide features such as:

• Session history

• Session duration

• Breathing progress

• Streaks

• Exercise preferences

• Reminder preferences

Some of this information may be stored locally on your device.

Because BREATHE does not require an account, this information is not designed to create a centralized user profile.

You are responsible for maintaining appropriate backups of any information you wish to retain.

Deleting the App or resetting its data may result in the loss of locally stored information.

10. In-App Purchases and Subscriptions

BREATHE may offer optional paid features, subscriptions, or one-time purchases through Apple's App Store.

If purchases or subscriptions are available:

• Payment is processed by Apple.

• Your purchase is subject to Apple's applicable terms and conditions.

• Prices are displayed before purchase.

• Subscription terms, including the applicable billing period and price, are presented at the time of purchase.

• Subscriptions may automatically renew unless cancelled in accordance with Apple's subscription management procedures.

• You can manage subscriptions through your Apple account settings.

Kello Solutions does not receive or store your complete payment card information.

Refunds for purchases are generally handled according to Apple's applicable policies and procedures.

11. Intellectual Property

BREATHE and all associated intellectual property rights remain the property of Kello Solutions or its licensors.

Nothing in these Terms grants you ownership of:

• The App

• The source code

• The design

• The branding

• The content

• The illustrations

• The animations

• The underlying technology

You receive a limited, personal, non-exclusive, non-transferable, revocable license to use the App for its intended purpose.

12. Third-Party Services

BREATHE may depend on services provided by Apple or other third-party providers for certain functionality.

Third-party services may be subject to their own terms, conditions, and privacy policies.

Kello Solutions is not responsible for the availability, functionality, security, or policies of third-party services that are outside our control.

13. Availability of the App

We aim to keep BREATHE available and functioning properly, but we do not guarantee that:

• The App will always be available;

• The App will operate without interruption;

• All features will always be available;

• The App will be compatible with every future version of iOS;

• Errors or defects will always be corrected immediately.

We may modify, update, suspend, or discontinue features of the App at any time.

14. Updates

We may release updates to BREATHE from time to time.

Updates may include:

• Bug fixes

• Security improvements

• New features

• Changes to existing features

• Performance improvements

• Design changes

• Compatibility updates

You understand that certain features may require an updated version of the App or iOS.

15. Disclaimer of Warranties

To the maximum extent permitted by applicable law, BREATHE is provided “as is” and “as available.”

Kello Solutions makes no warranties, express or implied, regarding:

• The accuracy or completeness of App content;

• The suitability of an exercise for a particular individual;

• Specific wellness, sleep, stress, or focus outcomes;

• Continuous availability;

• Error-free operation;

• Compatibility with all devices;

• Fitness for a particular purpose.

Your use of BREATHE is at your own discretion and risk.

16. Limitation of Liability

To the maximum extent permitted by applicable law, Kello Solutions and its officers, employees, contractors, affiliates, and licensors shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, BREATHE.

This includes, where legally permitted, losses relating to:

• Personal use of breathing exercises;

• Loss of locally stored data;

• Device problems;

• Service interruptions;

• Reliance on wellness information;

• Third-party services;

• Unauthorized access caused by circumstances outside our reasonable control.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

17. Your Responsibility

You are responsible for:

• Using the App appropriately;

• Following the instructions provided;

• Determining whether an exercise is suitable for you;

• Keeping your device secure;

• Maintaining backups of information stored locally on your device;

• Complying with applicable laws.

18. Privacy

Your use of BREATHE is also governed by our Privacy Policy, which explains how information is handled by the App.

The Privacy Policy forms part of these Terms.

19. Termination

You may stop using BREATHE at any time by deleting the App from your device.

We may suspend or discontinue access to the App or particular features where reasonably necessary, including for security, legal, technical, or operational reasons.

Upon termination, provisions that by their nature should continue to apply will remain effective, including intellectual property, disclaimers, limitations of liability, and applicable legal provisions.

20. Changes to These Terms

We may update these Terms from time to time.

If we make changes, we will update the Effective Date shown at the beginning of the Terms.

Your continued use of BREATHE after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

21. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable to Kello Solutions, without prejudice to any mandatory consumer protection rights you may have under the laws of your country of residence.

If you are a consumer in the European Union, nothing in these Terms is intended to deprive you of mandatory rights or protections provided by applicable EU or national consumer protection laws.

22. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect.

The invalid provision will be interpreted or replaced to the extent necessary to make it enforceable while preserving its original purpose as closely as possible.

23. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms applicable to specific features or purchases, constitute the agreement between you and Kello Solutions regarding your use of BREATHE.
