利用規約 (Terms of Service)

この利用規約（以下、「本規約」といいます）は、B&R CANOPY STUDIO（以下、「当方」といいます）が提供するスマートフォン向けアプリケーション「SlowBlink」（以下、「当アプリ」といいます）の利用条件を定めるものです。ユーザーの皆様（以下、「ユーザー」といいます）は、本規約に同意した上で当アプリをご利用ください。

第1条（適用および同意）

1. 本規約は、当アプリの利用に関する当方とユーザーとの間の権利義務関係を定めることを目的とし、当アプリの利用に関わる一切の事項に適用されます。

2. ユーザーは、当アプリをダウンロード、インストール、または利用を開始した時点で、本規約のすべての条項に同意したものとみなされます。

第2条（獣医学的診断に関する免責・重要事項）

1. 本アプリが提供する「まばたき対話」「感情診断」およびその他の分析・解説機能は、学術研究や一般的な動物行動学の知見を参考にして作成されたエンターテインメントおよび日常コミュニケーション支援を目的とするものです。

2. 本アプリのいかなる機能も、獣医師法等に基づく獣医学的診断、治療、健康状態の保証を行うものではありません。

3. 愛猫の体調不良、異常行動、病気・怪我の兆候が見られる場合は、当アプリの診断結果に依存することなく、速やかに獣医師にご相談ください。

4. 当アプリの利用または利用不能により生じた猫や飼い主の健康上・身体的・精神的な損害について、当方は一切の責任を負いません。

第3条（有料サブスクリプション「SlowBlink Premium」）

1. 当アプリは、一部の機能を有料定期購入（サブスクリプション「SlowBlink Premium」）として提供します。

2. 利用料金・プラン:

   • 月額プラン: ¥680 / 月（税込）

   • 年額プラン: ¥6,800 / 年（税込） ※価格はストアの改定や為替変動等により変更される場合があります。

3. 自動更新:

   • サブスクリプションは、有効期間終了の24時間前までに解約されない限り、同一料金・同一期間で自動的に更新されます。

4. 解約方法:

   • サブスクリプションの解約は、ご利用のプラットフォームのストア管理画面（Apple App Store または Google Play）からユーザーご自身で行う必要があります。アプリをアンインストール・削除しても定期購入は自動解約されませんのでご注意ください。

5. 返金:

   • 購入後の返金およびクーリングオフは、各アプリストア（Apple / Google）の規約・方針に従います。当方から直接返金を行うことはできません。

第4条（禁止事項）

ユーザーは、当アプリの利用にあたり、以下の行為を行ってはなりません。

1. 法令または公序良俗に違反する行為

2. 動物を故意に傷つけたり、過度なストレスを与えたりする目的での利用

3. 撮影中に危険な場所や体勢で端末を操作する行為

4. 当アプリのリバースエンジニアリング、逆コンパイル、ソースコードの改ざん

5. 当方または第三者の知的財産権、名誉、プライバシーを侵害する行為

6. その他、当方が不適切と判断する行為

第5条（アプリの中断・変更・終了）

1. 当方は、メンテナンス、障害対応、天災、その他やむを得ない事情がある場合、事前の予告なく当アプリの提供を一時中断または停止することがあります。

2. 当方は、当方の都合により、当アプリの機能追加・変更または提供を終了することができます。

第6条（免責事項）

1. 当方は、当アプリがすべての端末において正常に動作すること、およびエラーや不具合が存在しないことを保証しません。

2. 当方は、当アプリの利用により生じたユーザーのいかなる直接的・間接的損害についても、当方の故意または重過失による場合を除き、一切の責任を負いません。

第7条（規約の変更）

当方は、必要に応じて本規約を変更できるものとします。変更後の規約は、アプリ内または公式Webページに掲載された時点から効力を生じるものとします。

第8条（準拠法および管轄裁判所）

1. 本規約の準拠法は日本法とします。

2. 本規約または当アプリに関して紛争が生じた場合、当方の所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。

These Terms of Service ("Terms") govern your use of the mobile application "SlowBlink" ("the App"), developed and provided by B&R Canopy Studio ("we," "our," or "us"). By downloading, installing, or using the App, you ("User") agree to be bound by these Terms.

Article 1 (Application and Acceptance)

1. These Terms apply to all users of the App and govern all aspects of use.

2. By downloading, installing, accessing, or using the App, you signify your full acceptance of and agreement to these Terms.

Article 2 (Veterinary Medical Disclaimer & Important Notice)

1. The slow-blink interaction, emotional analysis, diagnostics, and advice provided by this App are developed for entertainment, educational, and daily pet-owner bonding purposes based on published animal behavioral research.

2. The App is NOT a substitute for professional veterinary diagnosis, examination, medical care, or animal health certification.

3. If your cat exhibits signs of illness, physical injury, unusual distress, or behavioral anomalies, do not rely on the App’s assessments and consult a licensed veterinarian immediately.

4. We assume no liability for any physical, emotional, medical, or other damages to pets or owners resulting from the use or inability to use the App.

Article 3 (Paid Subscriptions: "SlowBlink Premium")

1. Certain advanced features of the App are offered through auto-renewing subscriptions ("SlowBlink Premium").

2. Plans and Pricing:

・Monthly Plan: ¥680 / month (or equivalent local currency as displayed in the App/Store)

・Annual Plan: ¥6,800 / year (or equivalent local currency as displayed in the App/Store)

*Pricing is subject to change depending on platform adjustments and currency exchange rates.

3. Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours prior to the end of the current subscription period.

4. Cancellation: You may cancel your subscription at any time through your device’s platform account settings:

・iOS: Settings ➜ Apple ID ➜ Subscriptions

・Android: Google Play Store ➜ Payments & subscriptions ➜ Subscriptions

Uninstalling or deleting the App does not automatically cancel your subscription.

5. Refunds: All subscription purchases, cancellations, and refunds are governed strictly by the policies and terms of Apple Inc. (App Store) or Google LLC (Google Play). We cannot process direct refunds.

Article 4 (Prohibited Conduct)

Users agree not to engage in any of the following activities:

1. Violating any applicable domestic or international laws or regulations.

2. Causing harm, distress, physical danger, or undue stress to animals.

3. Operating the device in hazardous locations or postures while using the camera.

4. Reverse-engineering, decompiling, disassembling, or modifying the App's source code.

5. Infringing upon intellectual property, privacy, publicity, or other rights of us or any third party.

6. Any other activity deemed inappropriate or harmful by us.

Article 5 (Service Modifications and Termination)

1. We reserve the right to temporarily suspend or discontinue the App without prior notice due to maintenance, system failures, natural disasters, or other unavoidable circumstances.

2. We reserve the right to modify features or discontinue the App at our discretion.

Article 6 (Disclaimer of Warranties & Limitation of Liability)

1. The App is provided on an "as is" and "as available" basis. We make no warranty that the App will be uninterrupted, error-free, or compatible with every smartphone hardware model.

2. To the maximum extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of or inability to use the App.

Article 7 (Modifications to Terms)

We may amend these Terms at our discretion. The updated Terms become effective immediately upon being posted on this website or within the App.

Article 8 (Governing Law and Jurisdiction)

1. These Terms shall be governed by and construed in accordance with the laws of Japan.

2. Any legal dispute or controversy arising out of or related to these Terms or the App shall be subject to the exclusive jurisdiction of the district court having jurisdiction over our principal location.
