End User License Agreement (EULA) for BP Med Tracker

IMPORTANT — PLEASE READ CAREFULLY
This End User License Agreement ("EULA") is a legal agreement between you ("User") and BP Med Tracker ("we," "us," or "our") for the use of the BP Med Tracker mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by the terms of this EULA.
1. License Grant BP Med Tracker grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on any Apple-branded device that you own or control, solely for your personal, non-commercial purposes, subject to the terms of this EULA and the Apple App Store Terms of Service.
2. Restrictions You may not:
Copy, modify, or distribute the App
Reverse engineer or attempt to extract the source code
Sell, rent, lease, or sublicense the App
Remove any proprietary notices or labels on the App
Use the App for any unlawful or unauthorized purpose
3. Apple App Store This EULA is between you and BP Med Tracker only, not with Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
4. Medical Disclaimer BP Med Tracker is not a medical device. The App is designed for personal health tracking purposes only and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. Always consult a qualified healthcare professional before making any medical decisions. Do not rely on the App as a substitute for professional medical advice, diagnosis, or treatment.
5. Subscriptions The App offers auto-renewable Pro subscriptions:
Monthly: $2.99/month
Yearly: $24.99/year
A 14-day free trial is available for new subscribers. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel your subscription in iPhone Settings → Apple ID → Subscriptions.
6. Privacy Your use of the App is also governed by our Privacy Policy, available at https://sites.google.com/view/bpmedtracker/home. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.
7. User Data You retain ownership of all health data you enter into the App. We do not sell your health data to third parties. You may request deletion of your account and data at any time through Settings → Account → Delete Account.
8. Intellectual Property The App and all content, features, and functionality are owned by BP Med Tracker and protected by applicable intellectual property laws. This EULA does not grant you any rights to trademarks or service marks of BP Med Tracker.
9. Termination This EULA is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies.
10. Disclaimer of Warranties The App is provided "as is" and "as available" without warranties of any kind, either express or implied. BP Med Tracker does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
11. Limitation of Liability To the maximum extent permitted by applicable law, BP Med Tracker shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.
12. Third Party Claims BP Med Tracker, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of the App, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
13. Intellectual Property Claims In the event of any third party claim that the App or your possession and use of the App infringes a third party's intellectual property rights, BP Med Tracker, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
14. Governing Law This EULA is governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions.
