BMDE Reading Rescue: Terms and Conditions

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ENROLLING IN BMDE READING RESCUE. BY ENROLLING IN THE PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS.
1. Services Provided:
BMDE Reading Rescue ("the Program") provides one-on-one online reading instruction to students ("Students") by BMDE Learning ("the Instructor"). The Program focuses on developing foundational reading skills, including phonological awareness, phonics, fluency, vocabulary, and comprehension. Instruction is individualized based on an initial assessment and ongoing progress monitoring. The Program may include access to online resources, materials, and "Book Buddy" sessions (as applicable to the specific program purchased).
2. Enrollment and Payment:
Enrollment: Enrollment is confirmed upon receipt of a completed enrollment form and payment of the applicable fees.
Fees: The fees for the Program are as outlined on the BMDE Learning website/pricing sheet (view here) and are subject to change.
Payment Methods: Accepted payment methods are Bank Transfers, PayPal, Venmo, Zelle, Check.
Payment Schedule: Payment is due monthly in advance.
Late Payments: A late fee of 15% may be applied to overdue payments.
Refunds: If you cancel your enrollment after the program has started, you will be refunded for any unused sessions, less a 20% administrative fee.
Taxes: All fees are exclusive of applicable taxes.
3. Scheduling and Attendance:
Scheduling: Session times will be mutually agreed upon by the Instructor and the Student/Parent.
Attendance: Students are expected to attend all scheduled sessions.
Cancellations:
By Student/Parent: If you need to cancel or reschedule a session, you must provide at least 24 hours' notice. Failure to provide sufficient notice may result in forfeiture of the session fee.
By Instructor: If the Instructor needs to cancel a session, they will provide as much notice as possible and reschedule the session at a mutually convenient time.
Tardiness: If a student is late for a session, the session will still end at the scheduled time.
4. Student Responsibilities:
Attend Sessions: Attend all scheduled sessions on time and be prepared to participate.
Complete Assignments: Complete any assigned practice activities between sessions.
Respectful Conduct: Behave respectfully towards the Instructor and any other students (if participating in group activities).
Technology Requirements: Ensure you have a reliable internet connection, a working computer/tablet, and a quiet workspace for online sessions.
5. Parent/Guardian Responsibilities (if applicable):
Support Learning: Provide a supportive learning environment at home.
Ensure Attendance: Ensure the Student attends all scheduled sessions.
Communication: Communicate regularly with the Instructor regarding the Student's progress and any concerns.
Technology Support: Provide assistance with technology as needed.
6. Instructor Responsibilities:
Provide Instruction: Provide high-quality, individualized reading instruction.
Develop ILP: Develop and update the Individualized Learning Plan (ILP).
Monitor Progress: Regularly assess the Student's progress and adjust instruction as needed.
Communicate with Parents/Learners: Communicate regularly with parents/adult learners about progress and any concerns.
Maintain Confidentiality: Maintain the confidentiality of all Student information.
7. Intellectual Property:
All materials provided by BMDE Reading Rescue (including but not limited to lesson plans, worksheets, and online resources) are the intellectual property of BMFE Learning and may not be reproduced or distributed without permission.
8. Termination of Services:
By Student/Parent: You may terminate services at any time by providing 5 days' written notice.
By Instructor: The Instructor may terminate services if the Student/Parent violates these Terms and Conditions, or for any other reason deemed appropriate by the Instructor (e.g., consistent non-attendance, disrespectful behavior).
9. Disclaimer of Warranties:
BMDE Reading Rescue makes no warranties, express or implied, regarding the Student's reading progress. While the Instructor will make every effort to provide effective instruction, individual results may vary.
10. Limitation of Liability:
BMDE Learning shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the Program.
11. Governing Law:
These Terms and Conditions shall be governed by and construed in accordance with the laws of Jamaica.
12. Entire Agreement:
These Terms and Conditions constitute the entire agreement between the parties and supersede any prior or contemporaneous communications and proposals, whether oral or written.
13. Modifications:
BMDE Reading Rescue reserves the right to modify these Terms and Conditions at any time. Any changes will be posted on the BMDE Learning website and/or communicated to clients via email.
