1. EligibilityYou must be at least 13 years of age (or the minimum age in your country) to use the App. If you are under 18, you should use the App only with the consent of a parent or guardian. By using the App, you represent that you meet these requirements.2. Use of the App
You may use the App only for personal, non-commercial purposes in accordance with these Terms and applicable law.
You may not: (a) copy, modify, or distribute the App or its content; (b) reverse engineer or attempt to extract the App’s source code; (c) use the App for any illegal or unauthorized purpose; (d) upload content that infringes others’ rights or is harmful, offensive, or illegal; (e) use automated means (e.g. bots) to access the App without our permission; (f) circumvent any access or payment controls.
You are responsible for keeping your device secure and for all activity that occurs through your use of the App.
3. Account and subscriptions
Some features may require an account or subscription. You must provide accurate information and keep it updated.
Subscriptions and in-app purchases are processed by Apple (App Store) or Google (Play Store). Their terms and payment policies apply. Refund requests must be directed to Apple or Google in line with their policies.
We may change subscription plans, pricing, or features with notice where required by law. Continued use after changes may constitute acceptance.
4. User content and photos
You may upload or select photos (e.g. of your baby or child) only to use the App’s template and generation features. You retain ownership of your content. By using the App, you grant us a limited license to process and display your content only to provide the service (e.g. generating your personalized image).
You must have the right to use any content you provide (e.g. consent of parents/guardians for minors). You may not upload content that violates law or third-party rights. We may remove content that we reasonably believe violates these Terms or the law.
We do not use your photos or facial data for identity verification, recognition, or to train AI models. See our Privacy Policy for details.
5. Intellectual propertyThe App, including its design, text, graphics, logos, and software, is owned by us or our licensors and is protected by copyright and other intellectual property laws. You do not acquire any ownership rights by using the App. You may not use our trademarks or branding without our prior written permission.6. Disclaimers
The App and its content are provided "as is" and "as available." We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
We are not responsible for the quality, accuracy, or legality of user-generated content or for any results you obtain from using the App.
To the fullest extent permitted by law, we disclaim all warranties (express or implied), including merchantability and fitness for a particular purpose.
7. Limitation of liability
To the maximum extent permitted by law, we (and our affiliates, directors, employees, and agents) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.
Our total liability for any claims arising from or related to the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or, if no payment was made, fifty (50) USD (or equivalent).
Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, the above limitations apply to the fullest extent permitted.
8. IndemnificationYou agree to indemnify, defend, and hold harmless us and our affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the App; (b) your violation of these Terms or any law; (c) your content or conduct; or (d) any third-party claim that your content or use infringes their rights.9. Termination
We may suspend or terminate your access to the App at any time, with or without cause or notice, including for violation of these Terms.
You may stop using the App at any time. If you have a subscription, cancellation and refunds are handled by Apple or Google according to their policies.
Sections that by their nature should survive (e.g. intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive termination.
10. Governing law and disputesThese Terms are governed by the laws of Turkey, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey, except where prohibited by mandatory law.
11. Changes to the TermsWe may update these Terms from time to time. We will post the updated Terms in the App and/or on our website and update the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the revised Terms. If you do not agree, you must stop using the App. For material changes, we may provide additional notice (e.g. in-app or by email) where required by law.12. General
If any part of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.
Our failure to enforce any right or provision does not waive that right or provision.
These Terms, together with our Privacy Policy and any in-app terms to which we refer, constitute the entire agreement between you and us regarding the App.
