These terms apply when you use the BenchWork app. They sit alongside Apple’s Standard Licensed Application End User License Agreement, which also applies. By using BenchWork, you agree to both.
BenchWork is made by Michael Collett, a sole trader based in the United Kingdom, trading as MJC Studio. You can contact us at benchworksupport@gmail.com.
BenchWork is a tool that helps tradespeople prepare quotes and invoices. It adds up the costs, labour, markup, tax and deposits that you enter. It is intended for business use by tradespeople, not for personal or household use.
BenchWork only works with the figures and settings you give it. Before you send any quote or invoice, you must check that the prices, quantities, tax rates, totals and details are correct. You are responsible for:
the prices you charge and the profit you make;
the tax you charge and pay, including VAT and CIS, and following HMRC (or your local tax authority’s) rules on invoices and record keeping;
the content of every document you send to your customers;
keeping your own records and backups.
BenchWork does not give tax, legal, accounting or financial advice. Any tax settings or labels in the app are there for convenience only. If you are unsure, ask an accountant or adviser.
The jobs, customers, quotes and invoices you create are stored on your device and, if iCloud is turned on, in your own private iCloud account so they sync between your devices. We do not collect your data, cannot see it, and do not store it on our own servers. See our Privacy Policy for details. We cannot recover lost data, so please keep your device and iCloud backed up.
We work hard to make BenchWork accurate and reliable, but we can’t promise it will always be error-free, uninterrupted or suitable for your particular business. We may change, update or remove features at any time.
As far as the law allows:
we are not liable for any loss of profit, income, business, contracts or opportunity, or for any indirect or consequential loss;
we are not liable for any loss caused by figures, settings or documents you did not check, including underpriced quotes, unpaid invoices, or tax penalties;
our total liability to you for anything related to BenchWork is limited to the amount you paid for the app and any in-app purchases in the 12 months before the claim.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot legally be limited.
We may update these terms from time to time. The date at the top shows when they were last changed. If you keep using BenchWork after a change, the updated terms apply.
These terms are governed by the law of England and Wales. Any dispute will be dealt with by the courts of England and Wales, unless the law where you live gives you the right to bring a claim there.
