Liability Release, Waiver, and Indemnity Agreement for Personal Computer Support Services
The computer setup and repair services provided by Bill Clarke Software is done on a first-come, first-served basis. There may be circumstances under which Bill Clarke Software may not be able to, or may choose not to, repair computing equipment. Bill Clarke Software reserves the right to refuse installation of hardware and/or software if I believe that such installation may cause damage or create problems once installed.
Bill Clarke Software has been trained to perform hardware and software work, but Bill Clarke Software is not an authorized service dealer. No verbal or written warranty, expressed or implied, is offered on the services rendered by Bill Clarke Software. Work performed by Bill Clarke Software staff may void existing equipment warranties, and in the process of working on computer equipment, there is a potential for data loss. If, in the process of working on computer equipment, material is discovered which indicates a possible violation of provincial, state, or federal law, Bill Clarke Software will forward this information to the appropriate department or law enforcement agency. Additionally, Bill Clarke Software is not responsible for computers or accessories left more than thirty (30) days.
Bill Clarke Software shall not be responsible at any time for any loss, alteration or corruption of any software, data or files due to pre-existing problems or diagnostics. I will utilize every reasonable precaution to protect my data. I understand that INTENSIVE system diagnostics, repair of a crashed operating system, badly configured hardware, hardware problems/failures, or hard drive testing on a possible bad, faulty hard drive can stress the hard drive which can, in rare situations, result in data damage, where the integrity of the data may become compromised and potentially irretrievable.
I understand that Bill Clarke Software makes no warranty or guarantee as to the success of its attempts to repair / save my hard drive / recover data. Furthermore, I release Bill Clarke Software from any liability for any data loss which may occur during, or as a result of, this procedure. I also release
Bill Clarke Software from any liability for any theft, loss, damage or destruction to the drive and any other hardware delivered to Bill Clarke Software in connection with this Waiver.
ADDITIONAL PROBLEMS Bill Clarke Software is not responsible for additional problems that are preexisting, but not discovered by customer or issues that in rare cases occur during repair. Repair of additional issues will be at the customer’s expense, with approval.
I understand the above policies and authorize Bill Clarke Software and other associated staff to perform work on my computer and any accessories or peripherals associated with my computer. I certify that I am the owner of the computer being presented for technical service. Further, I agree to release, indemnify, and hold harmless Bill Clarke Software and its associates from liability for any claims or damages of any kind or description that may arise from any computer work performed on my computer, even if caused by negligence of Bill Clarke Software or agents. If you are under 18 years of age, a parent, guardian or guarantor must also read and agree to the above statement.
