TERMS OF USE

1. ACCEPTANCE OF TERMS
By downloading, accessing, or using Banner Prompt Pro (“the App”), you agree to these Terms of Use.
If you do not agree, do not use the App.
2. WHAT THE APP DOES
Banner Prompt Pro is a prompt-generation tool for live sellers and content creators.
The App creates formatted text prompts that can be copied and used with third-party image-generation platforms such as ChatGPT and Midjourney.
Banner Prompt Pro does not generate images itself.
3. USER RESPONSIBILITIES
You are solely responsible for all information you enter into the App, including:
• Product names and descriptions
• Pricing
• Selling points
• Product claims
• Images and screenshots
• Perks, warranties, guarantees, or shipping claims
Banner Prompt Pro does not verify the accuracy, legality, or completeness of user-submitted information or generated prompts.
You agree not to use the App to create unlawful, misleading, defamatory, fraudulent, infringing, or harmful content.
You are responsible for ensuring that you have permission to use any trademarks, product images, copyrighted material, or other content you provide to the App or a third-party platform.
4. NO GUARANTEE OF RESULTS
Banner Prompt Pro does not guarantee:
• Sales or revenue
• Conversion rates
• Viewer engagement
• Image quality
• Accuracy of third-party AI output
• Acceptance of a prompt by a third-party platform
Results depend on the information you provide and services outside Banner Prompt Pro’s control.
5. INTELLECTUAL PROPERTY
The App’s original design, code, branding, and functionality are owned by Banner Prompt Pro and are protected by applicable intellectual-property laws.
These Terms do not transfer ownership of the App to you.
You may not copy, modify, distribute, resell, reverse engineer, or create unauthorized derivative works from the App except where applicable law expressly permits such activity.
You retain responsibility for and any rights you hold in content you enter into the App.
6. THIRD-PARTY PLATFORMS
The App is designed to create prompts for third-party services.
Banner Prompt Pro is not affiliated with, endorsed by, or sponsored by OpenAI, ChatGPT, Midjourney, TikTok, Instagram, Facebook, Amazon, YouTube, or any other third-party platform.
Use of third-party platforms is subject to their own terms, privacy policies, availability, restrictions, and pricing.
Banner Prompt Pro is not responsible for:
• Third-party platform availability
• Third-party fees or subscriptions
• Generated image results
• Changes to third-party services
• Third-party account restrictions
• Third-party handling of your information
7. IN-APP PURCHASE
The App offers an optional one-time, non-consumable in-app purchase that unlocks unlimited prompt generation and prompt history.
This purchase:
• Is processed through Apple’s App Store
• Is subject to Apple’s payment terms
• Is not a subscription
• Does not renew automatically
Previous eligible purchases may be restored using the Restore Purchase option in the App.
Refund requests and purchase disputes are handled according to Apple’s applicable policies.
8. FREE USAGE
The App may provide a limited number of free prompt generations before requiring the one-time purchase.
Trial usage information may be stored using Apple’s Keychain and may remain on the device after the App is deleted and reinstalled.
Attempting to bypass purchase requirements or manipulate access controls is prohibited.
9. AVAILABILITY AND CHANGES
Banner Prompt Pro may be updated, modified, suspended, or discontinued when reasonably necessary.
Features may change because of operating-system updates, App Store requirements, security concerns, or changes to third-party platforms.
We do not guarantee uninterrupted or error-free availability.
10. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the App is provided “as is” and “as available,” without warranties of any kind, express or implied.
We do not warrant that the App will always be available, error-free, secure, or compatible with every device or third-party service.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
11. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Banner Prompt Pro will not be liable for indirect, incidental, special, consequential, or punitive damages arising from:
• Use or inability to use the App
• User-submitted product claims
• Generated prompts
• Third-party AI output
• Third-party platform actions
• Loss of sales, revenue, data, or business opportunities
These limitations apply only to the extent permitted by applicable law.
12. TERMINATION
You may stop using the App at any time.
Your permission to use the App may be terminated if you materially violate these Terms or use the App unlawfully.
Sections intended to survive termination, including intellectual-property, disclaimer, liability, and governing-law provisions, will remain effective.
13. CHANGES TO THESE TERMS
These Terms may be updated when the App, purchase model, or legal requirements change.
Updates will be identified by a revised effective date. Continued use after updated Terms become effective constitutes acceptance where permitted by law.
14. GOVERNING LAW
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
15. APPLE
Apple is not responsible for the App or its content.
Your use of the App is also subject to applicable App Store terms and Apple’s standard end-user licensing provisions.
